13312 MINUTES of a regular meeting of the Mayor and the Board of Trustees of the Village of Skokie, Cook County, Illinois held in the Council Chambers at 5127 Oakton Street at 8 p.m. on Monday October 7, 2019 Pledge of Allegiance led by Cub Scout Pack #85 from Middleton School. The Mayor called the meeting to order. The Clerk called the Roll. Those present were Roberts, Sutker, Ulrich, Bromberg, Klein, Gray- Keeler and Mayor Van Dusen. Motion to approve the Consent Agenda. Executive Session. 560081v1 Agenda 2019-10-07 A B D E F G A MML: 9/16/19 *10/7/19 THIS ORDINANCE MAY BE CITED AS VILLAGE ORDINANCE NUMBER 19-10-C- AN ORDINANCE AMENDING CHAPTER 46, ARTICLE III, OF THE SKOKIE VILLAGE CODE BY ADDING SECTION 46-82 PERTAINING TO CANNABIS FEES 1 WHEREAS, Chapter 46, Article III, of the Skokie Village Code provides for fees for 2 businesses and occupations; and 3 WHEREAS, the State of Illinois adopted the Cannabis Regulation and Tax Act 4 (hereinafter “Act”) on June 4, 2019. The Act allows for adults over the age of 21 to legally 5 possess 30 grams of marijuana and five grams of marijuana concentrate for personal use 6 beginning January 1, 2020; and 7 WHEREAS, the Mayor and Board of Trustees adopted Village Ordinances 19-9-C- 8 4486, 19-9-C-4487 and 19-9-C-4488 on September 16, 2019, pertaining to cannabis retail 9 sales licensing, Municipal Cannabis Retailers’ Occupation Tax and cannabis zoning 10 classification and regulations; and 11 WHEREAS, in order to sell at retail cannabis products in the Village, an establishment 12 must obtain an annual cannabis retail sales license issued by the Cannabis Commissioner, 13 pursuant to Chapter 11, Article I, of the Skokie Village Code; and 14 WHEREAS, there shall be an initial fee of $20,000.00 for the initial license and 15 $5,000.00 for each subsequent yearly renewal; and 16 WHEREAS, the Village Manager and Corporation Counsel recommended to the 17 Mayor and Board of Trustees that Chapter 46, Article III, Section 46-82 be added to the 18 Village Code; and 19 WHEREAS, the Mayor and Board of Trustees at a public meeting duly held on 20 October 7, 2019, concurred in the aforesaid recommendation of the Village Manager and 21 Corporation Counsel; and 22 NOW, THEREFORE, BE IT ORDAINED, by the Mayor and Board of Trustees of the 23 Village of Skokie, Cook County, Illinois; 24 Section 1: That Chapter 46, Article III, of the Skokie Village Code be and the same 25 is hereby amended by adding Section 46-82 in the manner hereinafter indicated. Corporation Counsel determined that notice was proper and correct. Mr. J. Kelly Bufton of Seyfarth Shaw LLP, on behalf of the petitioner, presented the case. Mr. Paul Applebaum of Shure Incorporated was present but did not speak. As a brief summary, Mr. Bufton stated that they purchased the property and would like to slightly reconfigure the existing 2 lots which were previously subdivided by The Alter Group in 2001. They would like to have the building and parking lot as Lot 1 and keep Lot 2 for future plans of expansion. Staff requested that the report be entered into the record as presented. The site spans 4 acres which triggered the need for the Plan Commission recommendation and will be heard by the Village Board at a future meeting for final approval.
