MINUTES of a regular meeting of the Mayor and the Board of Trustees of the Village of
Skokie, Cook County, Illinois held in the Council Chambers at 5127 Oakton Street at 8
p.m. on Monday April 6, 2020
Until further notice, meetings of the Skokie Village Board will be held
electronically, with a majority of Village officials participating via remote access in
order to comply with the State of Illinois Stay-At-Home order. Members of the
public who wish to comment as to an item on the published agenda or to comment during
public comments must submit their statement or question in writing to the Village
Manager’s Office no later than by noon (12 p.m.) on the day of the scheduled meeting and
all properly submitted statements or questions will be presented and read during the
relevant portion of the meeting. Written comments may be submitted by email to
citizencomments@skokie.org by mail to Village of Skokie, Village Manager's Office, 5127
Oakton Street, Skokie, Illinois, 60077; or via the Village’s drop box location by the public
entry to Village Hall.

Report of the Village Manager.
A. COVID-19 Presentation and Update.
Dr. Catherine Counard, Director of Health provided an update regarding the presence of
COVID-19 in the community. She spoke about the Covid-19 information on the Skokie website
and the IDPH web page. There are daily updates and guidance including a graph of the situation.
Dr. Counard answered questions from the Board.
Beth Lindley, Director of Human Services highlighted the services that the Village is providing
during this pandemic. She spoke about local resources including volunteer support, emergency
financial issues, Niles Township Food Pantry, Skokie Community Foundation and also the
COVID-19 Resource page.

B. Budget 2020-2021 Update.
The Village approved a two-year budget last year. May 1 will start the second year of the budget.
We are updating financial projections, but during this stage of the pandemic it is very
challenging to refine our forecasts.
* C. Excess Liability Coverage for Fiscal Year 2021 – Marsh/Allied World Assurance
Company - $233,946.
Motion to award a contract to Marsh/Allied World Assurance Company in the amount of
$233,946 for Excess Liability Coverage for Fiscal Year 2021.

*D. Village of Lincolnwood Transmission Main Construction Engineering Services – Gewalt
Hamilton Associates, Vernon Hills, Illinois - $116,400.

Motion to adopt an ordinance granting site plan approval to amend an existing site plan on a site
greater than one acre in size at 7787 Gross Point Road, Skokie, Illinois, in an R2 Single-Family
district, and relief from certain sections of Chapters 82 and 118 of the Skokie Village Code
(2020-06P). This item is on the consent agenda for second reading and adoption.

E. Request for a motion to extend the Village of Skokie Emergency Declaration for
Public Health, necessitated by the outbreak of the COVID-19 Pandemic, which was enacted by
Resolution Number 20-3-R-1460 on March 16, 2020. In recognition of the extension of the
Federal Emergency Declaration and the extension of Governor’s JB Pritzker’s Executive Order,
both through April 30, 2020, it is necessary to take this action. Therefore, pursuant to Section 3
of the Village of Skokie Emergency Declaration it shall be extended through Tuesday, May 5,
2020, to authorize the Village Manager to establish administrative rules and procedures for the
continuation of Village of Skokie finances and operations, including any and all payments and
financial actions to ensure the continued and uninterrupted day to day operations of the Village.

Citizen Comments
This question was submitted by email to the Village of Skokie
Madeleine England questioned if the Village plans to assist residents in obtaining
masks for the residents. She also asked about how the Village is planning to use the aftermath
of the COVID-19 crisis as a growth or retrenchment strategy to propel Skokie.
Trustee Roberts spoke about the possibility of a stimulus for Municipalities.
Trustee Sutker gave a Resource phone line for support.

5 more commonly described as 8341 Lockwood Avenue, Skokie, Illinois (hereinafter “Subject
6 Property”), petitioned the Village of Skokie to amend the existing site plan in order to construct
7 an addition to the Niles Township (hereinafter “Township”) food pantry in an NX Neighborhood
8 Mixed-Use district; and
9 WHEREAS, the proposed addition, which will be constructed within a portion of the
10 existing community garden, was requested by the Township in order to increase the amount of
11 storage space for the donations. An area currently striped as a loading zone within the parking
12 lot to the north of the food pantry shall be converted back to two (2) parking spaces, increasing
13 the total number of parking spaces to 31, being three fewer than the Skokie Village Code
14 (hereinafter “Code”) requirement; and
15 WHEREAS, since the number of vehicle parking spaces falls short of the required
16 number, relief is sought from Chapter 118, Section 118-218, of the Code, in order to allow 31
17 parking spaces rather than the required 34 spaces; and
18 WHEREAS, the Skokie Plan Commission, at a public hearing duly held on January 16,
19 2020: (i) determined that proper legal notice had been achieved, (ii) made the appropriate
20 findings of fact in the affirmative, as required under Section 118-6(g) of the Skokie Village
21 Code, and (iii) voted to recommend to the Mayor and Board of Trustees that (a) the requested
22 site plan approval be granted subject to the conditions contained in the Plan Commission
23 Report dated March 2, 20202, and (b) relief be granted from Chapter 118, Section 118-218,
24 of the Skokie Village Code; and
25 WHEREAS, the Mayor and Board of Trustees, at a public meeting duly held on March 2,
26 2020, voted to concur in the aforesaid recommendations and findings of fact of the Skokie Plan
27 Commission;
28 NOW, THEREFORE, BE IT ORDAINED by the Mayor and Board of Trustees of the
29 Village of Skokie, Cook County, Illinois:
30 Section 1: That the site plan approval requested by the petitioner to modify an
31 existing site plan in order to construct an addition to the food pantry located at the property
32 legally described above and commonly known as 8341 Lockwood Avenue, Skokie, Illinois, in
33 an NX Neighborhood Mixed-Use district, is hereby granted and approved subject to each of
34 the conditions set forth below:
35 1. The petitioner shall develop the Subject Property in substantial conformance with the
36 final Village approved site plan dated February 20, 2020; Niles Township Food Pantry
37 Addition floor, demolition, and ceiling plans dated December 13, 2019; landscape plan
38 dated February 20, 2020; and Niles Township Food Pantry south, north, and east
39 elevations dated December 13, 2019;
40 2. Any new parking lot and exterior lighting shall meet Illuminating Engineering Society of
41 North America (IES) standards, be full cut-off design, and be directed away from
42 adjacent properties, subject to the approval of the Engineering Division;

1 3. Any outdoor sound systems shall at all times maintain audio levels that are compliant
2 with the Skokie Village Code;
3 4. All existing damaged public sidewalks or public sidewalks damaged due to the
4 implementation of this plan shall be replaced;
5 5. No objects are allowed within a 10' sight distance triangle in R1, R2, R3, and R4
6 districts, or within a 15' sight distance triangle in all other districts, between 30" and
7 84" in height from grade except traffic control devices listed in the Manual on Uniform
8 Traffic Control Devices;
9 6. Prior to the issuance of building permits, the petitioner shall submit a temporary
10 pedestrian and bicycle circulation plan, including routing, signage, and barriers, to be in
11 place prior to the commencement of construction, subject to the approval of the
12 Engineering Division;
13 7. All fencing, walls, sidewalks, driveways, curbs, wheel stops, parking areas, signage,
14 landscaping, structures, and any other facilities or infrastructure on the Subject Property
15 shall be maintained in a good state of repair, and when needed, be repaired or replaced
16 in a timely manner;
17 8. All private and public sidewalks shall be maintained free of snow, ice, sleet, or other
18 objects that may impede travel;
19 9. Trash shall only be allowed within a designated trash enclosure and shall be screened
20 from public view in an enclosure approved by the Appearance Commission. All trash
21 shall be contained in such a way as to remain out of sight at all times, except for waste
22 receptacles referenced in Condition Number 14 below;
23 10. Waste receptacles shall be placed on the Subject Property for use by patrons, and the
24 Health Department shall determine the size, type, and location of these units;
25 11. All off-street parking spaces shall be legibly striped and maintained;
26 12. Any plan to modify parking lot striping must be approved by the Director of Engineering;
27 13. The proposed development shall have a minimum of 31 off-street vehicle parking
28 spaces including 3 handicapped parking spaces, as indicated on the Subject Property
29 plan dated December 13, 2019;
30 14. The handicapped parking spaces shall be installed and maintained in compliance with
31 State of Illinois Accessibility Standards and the Skokie Village Code, including required
32 signage;
33 15. Vehicles shall not be allowed to be parked in or otherwise block common driveways,
34 sidewalks, aisles, or other points of access at any time, shall only be parked in
35 designated parking spaces, and shall not overlap the striped lines of designated parking
36 spaces;
37 16. The owner of the Subject Property [and its tenant] shall ensure that employees park on
38 the Subject Property;
39 17. No required parking space on the site may be for the exclusive use of any tenant;
40 18. All new utilities on the Subject Property or in adjacent right-of-way shall be placed or
41 relocated underground. The petitioner shall bear the full cost of any utility relocation
42 and/or conflicts;

1 19. The owner of the Subject Property shall cooperate with any public utility project;
2 20. The petitioner shall sign an "Agreement for Installation and Maintenance of
3 Landscaping" to assure that the Subject Property and parkway landscaping is
4 completed and maintained, including trimming, watering, and replacing of dead plant
5 materials in a timely manner in accordance with the final approved landscape plan. A
6 copy of said Agreement is attached hereto, marked Exhibit “A” and hereby made part of
7 this Ordinance. This “Agreement for Installation and Maintenance of Landscaping" shall
8 be recorded at the petitioner’s expense;
9 21. All new construction, alterations, and remodeling shall meet current International
10 Building and NFPA Life Safety Codes as amended;
11 22. The petitioner shall obtain all required permits and approvals for improvements to
12 County, State, or Federal rights-of-way from the governing jurisdiction;
13 23. The Subject Property must conform to the Village's storm water control requirements as
14 contained in the Skokie Village Code, including the disconnection of any downspouts;
15 24. All signage shall conform to the Skokie Village Code, except as provided in this
16 ordinance. Any legal nonconforming sign on the Subject Property that shall conform
17 with the Village Code when it is damaged >50%, modified, or replaced in the future;
18 25. All modifications to building elevations, signage, and landscaping shall be subject to the
19 review and approval of the Skokie Appearance Commission;
20 26. The petitioner shall submit to the Planning Division electronic files of the plat of survey,
21 site plan, and landscape plan in their approved and finalized form. The files shall be
22 scaled 2-dimensional drawing files on non-compressed, non-read only CD-ROM *.dwg
23 AutoCAD format;
24 27. Prior to the issuance of building permits, the petitioner shall submit to the Planning
25 Division of the Community Development Department the name, property address, email
26 address, and telephone number of the company and contact person responsible for site
27 maintenance in compliance with this site plan approval;
28 28. If work is to be performed on public property or if public property is utilized or impacted
29 during construction and/or development, the owner shall provide, or shall cause the
30 developer and/or contractor to provide, the Village of Skokie with a certificate of
31 insurance naming the Village of Skokie as additionally insured for any and all claims
32 related to any and all work. The owner shall hold, and shall cause the developer and/or
33 contractor to hold, the Village of Skokie harmless and indemnify the Village for any and
34 all claims for property damage or personal injury related to work on or use of public
35 property;
36 29. The petitioner shall comply with all Federal and State statutes, laws, rules and
37 regulations and all Village codes, ordinances, rules, and regulations;
38 30. Failure to abide by any and all terms of this Ordinance shall be cause for the Village to
39 initiate hearings to determine whether the subject Ordinance, as well as any applicable
40 business licenses, should be revised or revoked. The petitioner shall pay all costs
41 related to any hearings conducted as a result of non-compliance with any of the
42 provisions of the enabling ordinance. The costs shall include but not be limited to court
43 reporter fees, attorney fees, and staff time required researching and conducting said
44 hearing;

1 31. A screened garbage corral with an impermeable surface shall be provided to contain all
2 dumpsters;
3 32. No tables or eating counters shall be allowed at food establishments. The addition of
4 tables or eating counters shall constitute the addition of a food service use at that
5 location, and all additional regulations for that food service use shall apply; and
6 33. At least once during every 4 hours of operation and before opening and closing of the
7 business, employees shall patrol the Subject Property and clear it of debris.
8 Section 2: That relief from Chapter 118, Section 118-218 of the Skokie Village
9 Code to provide 31 parking spaces rather than the required 33 spaces, is hereby granted.
10 Section 3: That Village Ordinance Number 18-10-Z-4415 pertaining to the previous
11 site plan approval at the Subject Property, be and the same is hereby repealed. Any previous
12 Village Ordinances which were repealed by the foregoing ordinances shall remain repealed and
13 are null and void. Nothing in this Ordinance shall be construed to reinstate any previously
14 repealed ordinances.
15 Section 4: That a notice of the approval of this Ordinance incorporating the
16 conditions contained herein shall be executed by the owner of the property in writing and
17 duly recorded with the Cook County Recorder of Deeds Office at the owner’s expense.
18 Section 5: That this Ordinance shall be in full force and effect from and after its
19 passage, approval, and recordation as provided by law.

1 1. At or near the time of execution of this Agreement, the VILLAGE granted an
2 Occupancy Permit, Business License, Site Plan Approval or Special Use Permit
3 hereinafter collectively referred to as “permit” pursuant to state statutes and local
4 ordinances.
5 2. By the terms of the aforesaid permit, the PROPERTY OWNER is required to install
6 and maintain landscaping in accordance with the plan dated February 20, 2020,
7 or as it may be subsequently revised with the approval of the Village Manager, or
8 designee, and the Corporation Counsel.
9 3. The parties to this Agreement recognize that the installation and maintenance of
10 landscaping is an integral part of the PROPERTY OWNER's plan for development
11 and/or use of the property and is necessary to carry out the purpose and intent of the
12 VILLAGE's land use objectives, and that the permit would not have been approved
13 by the VILLAGE without the assurance that this Agreement would be executed by
14 the PROPERTY OWNER.
15 4. The purpose of this Agreement is to assure:
16 (a) installation of the landscaping in accordance with the landscaping plan
17 approved by the VILLAGE, and
18 (b) continued maintenance and care of the landscaping, including any
19 landscaping indicated in the parkway area.
20 5. The property, which is the subject matter of this Agreement, is legally described
21 above. The portions of the Subject Property which are to be landscaped and
22 maintained pursuant to the terms and conditions of this Agreement are indicated on
23 the Landscape Plan attached hereto, marked Exhibit “1” and are hereby made a part
24 of this Agreement.
25 6. PROPERTY OWNER agrees that the installation and maintenance of the
26 landscaping which is required in accordance with the permit issued by the VILLAGE
27 and this Agreement will materially benefit the Subject Property. Such landscaping is
28 necessary in order for the PROPERTY OWNER to comply with the conditions of the
29 permit issued or granted by the VILLAGE for the PROPERTY OWNER’s requested
30 development or use of the property.
31 7. PROPERTY OWNER shall diligently maintain and care for the landscaping which is
32 installed and required by the permit and this Agreement, using generally accepted
33 methods of cultivation and watering. The PROPERTY OWNER shall maintain a
34 standard of care necessary to prevent the landscaping from deteriorating to the
35 extent that its value as landscaping is destroyed. If Exhibit “1”, attached hereto or
36 permit specifies maintenance standards or procedures, such procedures are hereby
37 adopted as part of this Agreement, and by such adoption, become enforcement
38 conditions of this Agreement.
39 8. Failure to maintain the landscaping as required by this Agreement shall be a
40 nuisance. In the event the PROPERTY OWNER fails to meet the standard of
41 maintenance necessary to keep the landscaping in a healthy condition as required
42 by this Agreement, the VILLAGE shall give written notice of the deficiency to the
43 PROPERTY OWNER who shall have 20 days to make the necessary correction or
44 replacement. If such correction or replacement is not made within the aforesaid 20-

1 day period, the VILLAGE may elect to abate the nuisance and take necessary action
2 to assure that the landscaping is replaced and/or maintained. In the event, the
3 VILLAGE so elects; the VILLAGE shall serve notice of its intent to enter the
4 premises for this purpose. The VILLAGE shall either personally serve the notice
5 upon the PROPERTY OWNER or mail a copy of it by certified mail to the
6 PROPERTY OWNER's last known address, or as shown on the tax rolls, at least 15
7 days in advance of the date when the VILLAGE or its agent intends to enter the
8 premises.
9 9. For this purpose, the VILLAGE or its agent may enter upon the property and perform
10 such work as it considers reasonably necessary and proper to restore, maintain, or
11 replace the landscaping required by this Agreement. The VILLAGE may act either
12 through its own employees or through an independent contractor.
13 10. The VILLAGE shall be entitled to reimbursement for abating the nuisance in
14 restoring, maintaining or replacing the landscaping, provided that the VILLAGE
15 follows the procedures set forth in this Agreement. Costs shall include but shall not
16 be limited to actual costs incurred by the VILLAGE and administrative costs. The
17 VILLAGE shall make demand upon the PROPERTY OWNER for payment. If the
18 PROPERTY OWNER fails to pay the costs within 30 days of the date on which
19 demand is made, the VILLAGE may cause a lien to be placed on the Subject
20 Property. The VILLAGE may record a notice with the Recorder of Deeds for Cook
21 County stating that it has incurred expenses under the terms this Landscape
22 Agreement. The VILLAGE shall be entitled to collect interest at the statutory rate on
23 the amount owed.
24 11. In addition to having a lien placed on the Subject Property, the VILLAGE may
25 institute a legal action to collect the amount owed. The PROPERTY OWNER agrees
26 to pay the VILLAGE a reasonable sum for attorney's fees and court costs.
27 12. If either party upon the execution of this Agreement or during the course of
28 performance considers that it is necessary to have the PROPERTY OWNER post
29 additional security to guarantee the performance of his obligations hereunder, the
30 VILLAGE may require the PROPERTY OWNER to post additional security. The
31 VILLAGE may require either a cash deposit or a surety bond guaranteeing
32 performance in a form signed by sureties satisfactory to the VILLAGE. The
33 condition of the security shall be that if the PROPERTY OWNER fails to perform any
34 obligation under this Agreement, the VILLAGE may, act on behalf of the
35 PROPERTY OWNER and use the proceeds of the cash bond, or in the case of a
36 surety bond, require the securities to perform the obligations of this Agreement.
37 13. The PROPERTY OWNER hereby agrees to indemnify and hold harmless the
38 VILLAGE, its trustees, officials, employees and agents for any costs, claims, actions
39 or causes of action for personal injury, property damage or otherwise, including
40 reasonable attorney’s fees, which may arise from the VILLAGE exercising any of its
41 rights or obligations and performance under this Agreement.
42 14. All notices required or to be given pursuant hereto shall be in writing and either
43 delivered personally or by a nationally recognized "over-night" courier service or
44 mailed by United States certified or registered mail, postage prepaid, addressed to
45 the VILLAGE and the PROPERTY OWNER as follows:

14 WHEREAS, the Subject Property, currently zoned M1 Office Assembly Industry,
15 contains an existing office building. The petitioner is proposing to rezone the Subject
16 Property from M1 Office Assembly Industry to R2 Single-Family in order to convert the
17 existing office building into an elementary and junior high school, child day care (pre-
18 nursery and nursery school programs) and gymnasium; and
19 WHEREAS, the zoning surrounding the Subject Property is as follows: to the north -
20 M1 Office Assembly Industry and M2 Light Industry, to the south - M1 Office Assembly and
21 R2 Single Family, and to the west - R2 Single-Family and M1 Office Assembly Industry; and
22 WHEREAS, at a public hearing of the Skokie Plan Commission, duly held on March
23 5, 2020, at which it was determined that proper notice had been achieved, two persons
24 spoke with concerns about the location of the proposed school, the proposed zoning, truck
25 traffic and the removal from the tax rolls. Additionally, two persons spoke citing the
26 importance of the school in the community; and
27 WHEREAS, after hearing all testimony, the Skokie Plan Commission: (i) made the
28 appropriate findings of fact in the affirmative as required under Section 118-6(h) of the
29 Skokie Village Code and (ii) voted to recommend to the Mayor and Board of Trustees that
30 the requested zoning reclassification be granted and the Official Zoning Map of the Village
31 of Skokie be amended to reflect this reclassification; and
32 WHEREAS, the Mayor and Board of Trustees, after public meeting duly held on
33 March 16, 2020, concurred in the aforesaid recommendation of the Skokie Plan
34 Commission;

2 exceeding both the 24 square foot sign area requirement and 10 foot distance above
3 grade requirements,
4 - a 37 square foot ground sign, which exceeds the allowed 35 square foot area
5 requirement,
6 - 40 bicycle parking spaces rather than the 80 required bicycle parking spaces; and
7 WHEREAS, the Appearance Commission at the September 11, 2019, meeting approved
8 the proposed development design, including the first floor addition and façade changes as
9 presented. At the October 23, 2019 meeting, the Appearance Commission approved the
10 requested signage; and
11 WHEREAS, in case 2020-05P, the Plan Commission, as the deciding body, approved a
12 parking determination of one (1) parking space for every three (3) seats which computes to 289
13 parking spaces for a maximum of 865 seats for the gymnasium assembly use on the Subject
14 Property; and
15 WHEREAS, the Skokie Plan Commission, at a public hearing duly held on March 5, 2020:
16 (i) determined that proper legal notice had been achieved, (ii) made the appropriate findings of fact
17 in the affirmative, as required under Section 118-6(g) of the Skokie Village Code, and (iii) voted to
18 recommend to the Mayor and Board of Trustees that (a) the requested site plan approval be
19 granted subject to the conditions contained in the Plan Commission Report dated March 16, 2020,
20 and (b) relief be granted from Chapter 82, Sections 82-26(c)(4)b., 82-26(c)(4)c., 82-26(c)(4)e. and
21 Chapter 118, Section 118-222, of the Skokie Village Code; and
22 WHEREAS, the Mayor and Board of Trustees, at a public meeting duly held on March 16,
23 2020, voted to concur in the aforesaid recommendations and findings of fact of the Skokie Plan
24 Commission;
25 NOW, THEREFORE, BE IT ORDAINED by the Mayor and Board of Trustees of the Village
26 of Skokie, Cook County, Illinois:
27 Section 1: That the site plan approval requested by the petitioner to establish a
28 planned development on a site greater than one acre in size at the property legally described
29 above and currently known as 7770 Frontage Road, Skokie, Illinois and will be known as 7787
30 Gross Point Road, Skokie, in an R2 Single-Family district, is hereby granted and approved subject
31 to each of the conditions set forth below:
32 1. Prior to the issuance of building permits, the petitioner shall:
33 a. Update existing easements to include new standard restoration language and ensure
34 access to such easements. Need easement for 6" water main and combined sewer,
35 b. A tree survey, final grading plan, tree preservation plan, and landscape plan with
36 plant list shall be submitted to the Community Development Department for review
37 and approval,
38 c. Submit for approval a lighting photometrics plan, fully developed civil engineering
39 plans that comply with the county WMO requirements and Village’s stormwater
40 control provisions, and redevelopment engineering plans to address all aspects of
41 private and public utility services. Any reconfigurations within state ROW will require
42 an IDOT highway/utility permit;

1 2. The petitioner shall develop the Subject Property in substantial conformance with the final
2 Village approved site plan dated, January 3, 2020, engineering plans dated, January 6,
3 2020, landscape plans dated, January 2, 2020, sign plans dated, October 2, 2019 and
4 building elevations dated October 2, 2019;
5 3. Prior to the issuance of building permits, the petitioner shall submit for approval a lighting
6 photometrics plan, fully developed civil engineering plans that comply with the county WMO
7 requirements and Village’s stormwater control provisions, and redevelopment engineering
8 plans to address all aspects of private and public utility services. Any reconfigurations within
9 state ROW will require an IDOT highway/utility permit;
10 4. The proposed development shall have a maximum gymnasium assembly capacity of 865
11 seats predicated on the current 288 off-street vehicle parking spaces or as otherwise
12 established pursuant to Paragraph 5. The foregoing shall not apply to school programs
13 attended by the petitioner’s students, faculty and administration. The maximum total
14 capacity of the development shall be pursuant to Village of Skokie Fire Department
15 determination;
16 5. Valet parking that would use more than the 288 off-street vehicle parking spaces is not
17 approved as part of this request. Should the petitioner choose to request valet parking on a
18 regular basis that would use more than the 288 off-street vehicle parking spaces, formal
19 application shall be submitted for a parking determination through the Plan Commission and
20 a modified review of the site plan approval by the Village Board. Should the petitioner
21 choose to request valet parking for a special event or a non-reoccurring program that would
22 use more than the 288 off-street vehicle parking spaces, application shall be submitted to
23 the Village Manager for a special valet parking approval;
24 6. New parking lot and exterior lighting shall meet Illuminating Engineering Society of North
25 America (IES) standards, be full cut-off design, and be directed away from adjacent
26 properties, subject to the approval of the Engineering Division;
27 7. Any outdoor sound systems shall always maintain audio levels that are compliant with the
28 Skokie Village Code;
29 8. All existing damaged public sidewalks or public sidewalks damaged due to the
30 implementation of this plan shall be replaced;
31 9. No objects are allowed within a 10' sight distance triangle in R1, R2, R3, and R4 districts, or
32 within a 15' sight distance triangle in all other districts, between 30" and 84" in height from
33 grade except traffic control devices listed in the Manual on Uniform Traffic Control Devices;
34 10. Prior to the issuance of building permits, the petitioner shall submit a temporary pedestrian,
35 bicycle, and transit circulation plan, including routing, signage, and barriers, to be in place
36 prior to the commencement of construction, subject to the approval of the Engineering
37 Division;
38 11. All fencing, walls, sidewalks, driveways, curbs, wheel stops, parking areas, signage,
39 landscaping, structures, and any other facilities or infrastructure on the Subject Property
40 shall be maintained in a good state of repair, and when needed, be repaired or replaced in a
41 timely manner;
42 12. All private and public sidewalks shall be maintained free of snow, ice, sleet, or other objects
43 that may impede travel;
44 13. Trash shall only be allowed within a designated trash enclosure and shall be screened from
45 public view in an enclosure approved by the Appearance Commission. All trash shall
46 always be contained in such a way as to remain out of sight;

1 14. All off-street parking spaces shall be legibly striped and maintained;
2 15. Any plan to modify parking lot striping must be approved by the Director of Engineering;
3 16. The proposed development shall have a minimum of 288 off-street vehicle parking spaces
4 including 7 handicapped parking spaces;
5 17. The handicapped parking spaces shall be installed and maintained in compliance with State of
6 Illinois Accessibility Standards and the Skokie Village Code, including required signage;
7 18. Vehicles shall not be allowed to be parked in or otherwise block common driveways,
8 sidewalks, aisles, or other points of access at any time, shall only be parked in designated
9 parking spaces, and shall not overlap the striped lines of designated parking spaces;
10 19. The owner and lessee(s) of the Subject Property shall ensure that employees park on the
11 Subject Property;
12 20. All new utilities on the Subject Property or in adjacent right-of-way shall be placed or
13 relocated underground. The petitioner shall bear the full cost of any utility relocation and/or
14 conflicts;
15 21. The petitioner shall sign an "Agreement for Installation and Maintenance of Landscaping" to
16 assure that the Subject Property and parkway landscaping is completed and maintained,
17 including trimming, watering, and replacing of dead plant materials in a timely manner in
18 accordance with the final approved landscape plan. A copy of said Agreement is attached
19 hereto, marked Exhibit “A” and hereby made part of this Ordinance. This “Agreement for
20 Installation and Maintenance of Landscaping" shall be recorded at the petitioner’s expense;
21 22. All new construction, alterations, and remodeling shall meet current International Building
22 and NFPA Life Safety Codes as amended;
23 23. The petitioner shall obtain all required permits and approvals for improvements to County,
24 State, or Federal rights-of-way from the governing jurisdiction;
25 24. The Subject Property must conform to the Village's storm water control requirements as
26 contained in the Skokie Village Code, including the disconnection of any downspouts.
27 25. All signage shall conform to the Skokie Village Code, except as provided in this ordinance.
28 Any sign on the Subject Property that is in violation of that Code must be removed or
29 modified to conform with the Village Code prior to the issuance of an occupancy permit.
30 26. All modifications to building elevations, signage, and landscaping shall be subject to the
31 review and approval of the Skokie Appearance Commission;
32 27. The petitioner shall submit to the Planning Division electronic files of the site plan and
33 landscape plan in their approved and finalized form;
34 28. Prior to the issuance of building permits, the petitioner shall submit to the Planning Division
35 of the Community Development Department the name, property address, email address,
36 and telephone number of the company and contact person responsible for site maintenance
37 in compliance with this site plan approval;
38 29. If work is to be performed on public property or if public property is utilized or impacted
39 during construction and/or development, the owner shall provide, or shall cause the
40 developer and/or contractor to provide, the Village of Skokie with a certificate of insurance
41 naming the Village of Skokie as additionally insured for any and all claims related to any and
42 all work. The owner shall hold, and shall cause the developer and/or contractor to hold, the
43 Village of Skokie harmless and indemnify the Village for any and all claims for property
44 damage or personal injury related to work on or use of public property;

1 30. The petitioner shall comply with all Federal and State statutes, laws, rules and regulations
2 and all Village codes, ordinances, rules, and regulations;
3 31. Failure to abide by any and all terms of this Ordinance shall be cause for the Village to
4 initiate hearings to determine whether the subject Ordinance, as well as any applicable
5 business licenses, should be revised or revoked. The petitioner shall pay all costs related to
6 any hearings conducted as a result of non-compliance with any of the provisions of the
7 enabling ordinance. The costs shall include but not be limited to court reporter fees,
8 attorney fees, and staff time required researching and conducting said hearing;
9 Section 2: That relief from Chapter 82, Sections 82-26(c)(4)b., 82-26(c)(4)c., 82-
10 26(c)(4)e and Chapter 118, Section 118-222, of the Skokie Village Code (hereinafter “Code”), in
11 order to allow the following:
12 - a 174 square foot in area Gross Point Road wall sign at also 26’-3.5” above grade,
13 exceeding both the 24 square foot sign area requirement and 10 foot distance above
14 grade requirements,
15 - a 27 square foot area Frontage Road wall sign at also 25’-6” above grade, exceeding
16 both the 24 square foot sign area requirement and 10 foot distance above grade
17 requirements,
18 - a second 91 square foot Gross Point road wall sign at also 13’-5“ above grade,
19 exceeding both the 24 square foot sign area requirement and 10 foot distance above
20 grade requirements,
21 - a 37 square foot ground sign, which exceeds the allowed 35 square foot area
22 requirement, and
23 - 40 bicycle parking spaces rather than the 80 required bicycle parking spaces;
24 is hereby granted.
25 Section 3: That a notice of the approval of this Ordinance incorporating the
26 conditions contained herein shall be executed by the owner of the property in writing and duly
27 recorded with the Cook County Recorder of Deeds Office at the owner’s expense.
28 Section 4: That this Ordinance shall be in full force and effect from and after its
29 passage, approval, and recordation as provided by law.

1 This Agreement is entered into this day of 2020 by and
2 between SIRIUS COMPUTER SOLUTIONS, LLC, hereinafter referred to as "PROPERTY
3 OWNER", and the VILLAGE OF SKOKIE, an Illinois municipal corporation, hereinafter referred
4 to as "VILLAGE". The parties to this Agreement hereby agree as follows:
5
6 PROPERTY OWNER is the owner of real property located in the Village of Skokie,
7 LOT 1 IN ARIE CROWN HEBREW DAY SCHOOL SUBDIVISION, BEING PART OF THE NORTHEAST
8 ¼ OF SECTION 29, TOWNSHIP 41 NORTH, RANGE 13, EAST OF THE THIRD PRINCIPAL MERIDIAN,
9 IN COOK COUNTY, ILLINOIS.

11 At or near the time of execution of this Agreement, the VILLAGE granted an Occupancy Permit,
12 Business License, Site Plan Approval or Special Use Permit hereinafter collectively referred to
13 as “permit” pursuant to state statutes and local ordinances.
14 1. By the terms of the aforesaid permit, the PROPERTY OWNER is required to install
15 and maintain landscaping in accordance with the plan dated January 2, 2020,
16 or as it may be subsequently revised with the approval of the Village Manager, or
17 designee, and the Corporation Counsel.
18 2. The parties to this Agreement recognize that the installation and maintenance of
19 landscaping is an integral part of the PROPERTY OWNER's plan for development
20 and/or use of the property and is necessary to carry out the purpose and intent of the
21 VILLAGE's land use objectives, and that the permit would not have been approved
22 by the VILLAGE without the assurance that this Agreement would be executed by
23 the PROPERTY OWNER.
24 3. The purpose of this Agreement is to assure:
25 (a) installation of the landscaping in accordance with the landscaping plan
26 approved by the VILLAGE, and
27 (b) continued maintenance and care of the landscaping, including any
28 landscaping indicated in the parkway area.
29 4. The property, which is the subject matter of this Agreement, is legally described
30 above. The portions of the Subject Property which are to be landscaped and
31 maintained pursuant to the terms and conditions of this Agreement are indicated on
32 the Landscape Plan attached hereto, marked Exhibit “1” and are hereby made a part
33 of this Agreement.

1 5. PROPERTY OWNER agrees that the installation and maintenance of the
2 landscaping which is required in accordance with the permit issued by the VILLAGE
3 and this Agreement will materially benefit the Subject Property. Such landscaping is
4 necessary in order for the PROPERTY OWNER to comply with the conditions of the
5 permit issued or granted by the VILLAGE for the PROPERTY OWNER’s requested
6 development or use of the property.
7 6. PROPERTY OWNER shall diligently maintain and care for the landscaping which is
8 installed and required by the permit and this Agreement, using generally accepted
9 methods of cultivation and watering. The PROPERTY OWNER shall maintain a
10 standard of care necessary to prevent the landscaping from deteriorating to the
11 extent that its value as landscaping is destroyed. If Exhibit “1”, attached hereto or
12 permit specifies maintenance standards or procedures, such procedures are hereby
13 adopted as part of this Agreement, and by such adoption, become enforcement
14 conditions of this Agreement.
15 7. Failure to maintain the landscaping as required by this Agreement shall be a
16 nuisance. In the event the PROPERTY OWNER fails to meet the standard of
17 maintenance necessary to keep the landscaping in a healthy condition as required
18 by this Agreement, the VILLAGE shall give written notice of the deficiency to the
19 PROPERTY OWNER who shall have 20 days to make the necessary correction or
20 replacement. If such correction or replacement is not made within the aforesaid 20-
21 day period, the VILLAGE may elect to abate the nuisance and take necessary action
22 to assure that the landscaping is replaced and/or maintained. In the event, the
23 VILLAGE so elects; the VILLAGE shall serve notice of its intent to enter the
24 premises for this purpose. The VILLAGE shall either personally serve the notice
25 upon the PROPERTY OWNER or mail a copy of it by certified mail to the
26 PROPERTY OWNER's last known address, or as shown on the tax rolls, at least 15
27 days in advance of the date when the VILLAGE or its agent intends to enter the
28 premises.
29 8. For this purpose, the VILLAGE or its agent may enter upon the property and perform
30 such work as it considers reasonably necessary and proper to restore, maintain, or
31 replace the landscaping required by this Agreement. The VILLAGE may act either
32 through its own employees or through an independent contractor.
33 9. The VILLAGE shall be entitled to reimbursement for abating the nuisance in
34 restoring, maintaining or replacing the landscaping, provided that the VILLAGE
35 follows the procedures set forth in this Agreement. Costs shall include but shall not
36 be limited to actual costs incurred by the VILLAGE and administrative costs. The
37 VILLAGE shall make demand upon the PROPERTY OWNER for payment. If the
38 PROPERTY OWNER fails to pay the costs within 30 days of the date on which
39 demand is made, the VILLAGE may cause a lien to be placed on the Subject
40 Property. The VILLAGE may record a notice with the Recorder of Deeds for Cook
41 County stating that it has incurred expenses under the terms this Landscape
42 Agreement. The VILLAGE shall be entitled to collect interest at the statutory rate on
43 the amount owed.
44 10. In addition to having a lien placed on the Subject Property, the VILLAGE may
45 institute a legal action to collect the amount owed. The PROPERTY OWNER agrees
46 to pay the VILLAGE a reasonable sum for attorney's fees and court costs.

1 11. If either party upon the execution of this Agreement or during the course of
2 performance considers that it is necessary to have the PROPERTY OWNER post
3 additional security to guarantee the performance of his obligations hereunder, the
4 VILLAGE may require the PROPERTY OWNER to post additional security. The
5 VILLAGE may require either a cash deposit or a surety bond guaranteeing
6 performance in a form signed by sureties satisfactory to the VILLAGE. The
7 condition of the security shall be that if the PROPERTY OWNER fails to perform any
8 obligation under this Agreement, the VILLAGE may, act on behalf of the
9 PROPERTY OWNER and use the proceeds of the cash bond, or in the case of a
10 surety bond, require the securities to perform the obligations of this Agreement.
11 12. The PROPERTY OWNER hereby agrees to indemnify and hold harmless the
12 VILLAGE, its trustees, officials, employees and agents for any costs, claims, actions
13 or causes of action for personal injury, property damage or otherwise, including
14 reasonable attorney’s fees, which may arise from the VILLAGE exercising any of its
15 rights or obligations and performance under this Agreement.
16 13. All notices required or to be given pursuant hereto shall be in writing and either
17 delivered personally or by a nationally recognized "over-night" courier service or
18 mailed by United States certified or registered mail, postage prepaid, addressed to
19 the VILLAGE and the PROPERTY OWNER as follows:

21 Either Party may change the names and addresses of the persons to whom notices or
22 copies thereof shall be delivered, by written notice to the other Party, as the case may
23 be, in the manner herein provided for the service of notice.

25 14. The Parties and the individuals whose signature is affixed to this Agreement, each
26 acting with due authority have executed this Agreement.
27 15. This Agreement pertains to, runs with the Subject Property, and shall be binding on
28 the successors, assigns, and heirs in interest.
