13368 MINUTES of a regular meeting of the Mayor and the Board of Trustees of the Village of Skokie, Cook County, Illinois held in the Council Chambers at 5127 Oakton Street at 8 p.m. on Monday May 18, 2020 Until further notice, meetings of the Skokie Village Board will be held electronically, with a majority of Village officials participating via remote access in order to comply with the State of Illinois Stay-At-Home order. Members of the public who wish to comment as to an item on the published agenda or to comment during public comments must submit their statement or question in writing to the Village Manager’s Office no later than by noon (12 p.m.) on the day of the scheduled meeting and all properly submitted statements or questions will be presented and read during the relevant portion of the meeting. Written comments may be submitted by email to citizencomments@skokie.org by mail to Village of Skokie, Village Manager's Office, 5127 Oakton Street, Skokie, Illinois, 60077; or via the Village’s drop box location by the public entry to Village Hall. Pledge of Allegiance led by Village Clerk Pramod C. Shah. The Mayor called the meeting to order. The Clerk called the Roll. Those present were Roberts, Sutker, Ulrich, Bromberg, Klein, Gray- Keeler and Mayor Van Dusen. The Trustees were joining by remote electronic access. Motion to approve the Consent Agenda with the exception of Item D on the Manager’s report. Omnibus vote. * Appointments, Reappointments and Resignations. A. Appointment Economic Development Commission: Dave Drehobl Omnibus vote. Report of the Village Manager. A. COVID-19 Update. Dr. Counard , Director of Health gave up update of the COVID-19. WE have 698 confirmed case, 207 in isolation, 12 hospitalized and 22 deaths. 30-4% in long term care facilities and 20 % over 65 with underlying health conditions. A graph was shown Skokie’s COVID 19 by occupations. Skokie is in the NE Region and is safely moving to Phase III. She also spoke about the Contact Tracing Program. Questions were answered from the Board. Manager Lockerby stated that Skokie has an Economic Recovery Task Force that has started meeting. Also, Skokie had 7.3 inches of rain in 2 days. The Village is working with Homeowners and Business on this issue. *B. Village of Skokie Green Alley Program – Baxter Woodman, Inc., Crystal Lake, Illinois – $116,500. Motion to award a contract to Baxter Woodman, Inc. Crystal Lake, Illinois in the amount of $116,500. Motion to award a contract to Joel Kennedy Construction, Chicago in the amount of $2,411,896.30 for 2020 Water Main & Sewer Rehabilitation Improvement Project. Omnibus vote. D. FY2021 Commercial Property Coverage Renewal – Affiliated FM Insurance - $85,567. Motion to award a contract to Affiliated FM Insurance in the amount of $85,567 for FY2021 Commercial Property Coverage Renewal. This was taken off the Consent Agenda. Ordinance 20-5-Z-4520 Motion to adopt an ordinance granting a special use permit to establish and operate a technical, trade and specialty school at 8150 McCormick Boulevard, Unit #228, Skokie, Illinois, in an M3 Industry district and relief from Chapter 118, Sections 118-211, 118-218(b)(1) and 118-218(b)(2)a, of the Skokie Village Code (2020-07P). This item is on the consent agenda for second reading and adoption. Omnibus vote. FIRST READING: C. An ordinance reducing the tax levy of the Village of Skokie for the fiscal year beginning May 1, 2019 and ending April 30, 2020 in the amount of $5,246,588.25. This item is on the agenda for first reading and will be on the June 1, 2020 agenda for second reading and adoption. D. Executive Session Motion to approve the request for an executive session in accordance with paragraph 2(c)(11) of the Illinois Open Meetings Act at the end of the regular meeting pertaining to the review and discussion of pending litigation and to adjourn therefrom. The Village is in contact with her. 13370 Meeting of the Mayor and Board of Trustee Monday May 18, 2020 Page Three Mayor Van Dusen stated that the Village’s 2020 Memorial Day observance will be live on the Village’s YouTube channel and the Skokie Police Department Facebook page on Monday, May 25 at 11 a.m. Due to the state-wide-stay-at-home order through May 30, residents may not gather in person for the Memorial Day observance, but all are encouraged to join remotely to honor our fallen heroes of the Armed Forces. Executive Session. 567479v1 B C D A MML: 5/4/2020 1st Reading *5/18/2020 THIS ORDINANCE MAY BE CITED AS VILLAGE ORDINANCE NUMBER 20-5-C- AN ORDINANCE AMENDING CHAPTER 98, ARTICLE XVI, SECTION 98-391, OF THE SKOKIE VILLAGE CODE PERTAINING TO THE MUNICIPAL CANNABIS RETAILERS’ OCCUPATION TAX 1 WHEREAS, Chapter 98, Article XVI, Section 98-391, of the Skokie Village Code 2 provides for the collection of the Municipal Cannabis Retailers’ Occupation Tax; and 3 WHEREAS, on September 16, 2019, the Mayor and Board of Trustees adopted 4 Village Ordinance Number 19-9-C-4487 which amended the Skokie Village Code by 5 implementing an occupation tax pertaining to Cannabis Retailers, pursuant to Section 8-11-22 6 of the Illinois Municipal Code; and 7 WHEREAS, in accordance with the guidelines set out by the State of Illinois, the 8 Ordinance was sent to the Illinois Department of Revenue (hereinafter (“IDR”) for review. In 9 correspondence dated April 3, 2020 from the IDR, it was requested that the Village amend 10 the Village Code to reflect that retailers are authorized to reimburse themselves for their tax 11 liability by including the reimbursement as part of the Use Tax that they are required to 12 collect; and 13 WHEREAS, the Corporation Counsel recommended to the Mayor and Board of 14 Trustees that Chapter 98, Article XVI, Section 98-391 of the Skokie Village Code be amended 15 accordingly; and 16 WHEREAS, the Mayor and Board of Trustees at a public meeting duly held on May 4, 17 2020, concurred in the aforesaid recommendation of the Corporation Counsel; and 18 NOW, THEREFORE, BE IT ORDAINED, by the Mayor and Board of Trustees of the 19 Village of Skokie, Cook County, Illinois; 20 Section 1: That Chapter 98, Article XVI, Section 98-391 of the Skokie Village Code 21 be and the same is hereby amended in the manner hereinafter indicated. Remove the banners from the front of the building that are in violation of the Village 2 of Skokie Code of Ordinances, 3 b. Remove the signs for dedicated parking spaces that are in violation of the Village of 4 Skokie Code of Ordinances, 5 c. Remove the parking spaces along the west side of the building that are in violation of 6 the Village of Skokie Code of Ordinances, 7 d. Provide a scaled floor plan showing accurate depictions of the interior square 8 footages; 9 2. Prior to the issuance of an Occupancy Permit, the tenant for the Subject Site must 10 submit a copy of the State of Illinois license required for the Good to Great School to 11 operate; 12 3. The petitioner shall develop the Subject Site in substantial conformance with the final 13 Village approved floor plans dated February 11, 2020 and interior remodeling plans 14 dated July 30, 2019; 15 4. New parking lot and exterior lighting shall meet Illuminating Engineering Society of North 16 America (IES) standards, be full cut-off design, and be directed away from adjacent 17 properties, subject to the approval of the Engineering Division; 18 5. Any outdoor sound systems shall at all times maintain audio levels that are compliant 19 with the Skokie Village Code; 20 6. The owner of the Subject Property shall ensure that employees and tenants park on the 21 Subject Property; 22 7. No required parking space on the site may be for the exclusive use of any tenant; 23 8. All new construction, alterations, and remodeling shall meet current International 24 Building and NFPA Life Safety Codes as amended; 25 9. The petitioner shall obtain all required permits and approvals for improvements to 26 County, State, or Federal rights-of-way from the governing jurisdiction; 27 10. The Subject Property must conform to the Village's storm water control requirements as 28 contained in the Skokie Village Code, including the disconnection of any downspouts; 29 11. All signage shall conform to the Skokie Village Code, except as provided in this 30 ordinance. Any legal nonconforming sign on the Subject Property that shall conform 31 with the Village Code when it is damaged >50%, modified, or replaced in the future; 32 12. All modifications to building elevations, signage, and landscaping shall be subject to the 33 review and approval of the Skokie Appearance Commission; 34 13. The petitioner shall submit to the Planning Division electronic files of the plat of survey, 35 site plan, and landscape plan in their approved and finalized form. The files shall be 36 scaled 2-dimensional drawing files on non-compressed, non-read only CD-ROM *.dwg 37 AutoCAD format; 38 14. The owner shall hold and shall cause the developer and/or 6 contractor to hold, the Village of Skokie harmless and indemnify the Village for all claims 7 for property damage or personal injury related to work on or use of public property; 8 16. The petitioners shall comply with all Federal and State statutes, laws, rules and 9 regulations and all Village codes, ordinances, rules, and regulations; and 10 17. Failure to abide by any and all terms of this Ordinance shall be cause for the Village to 11 initiate hearings to determine whether the subject Ordinance, as well as any applicable 12 business licenses, should be revised or revoked. The petitioners shall pay all costs 13 related to any hearings conducted as a result of non-compliance with any of the 14 provisions of the enabling ordinance.
