13413 MINUTES of a regular meeting of the Mayor and the Board of Trustees of the Village of Skokie, Cook County, Illinois held in the Council Chambers at 5127 Oakton Street at 8 p.m. on Monday December 7, 2020 Until further notice, meetings of the Skokie Village Board will be held electronically, with a majority of Village officials participating via remote access in order to comply with the State of Illinois Gubernatorial Disaster Proclamation. Members of the public who wish to comment as to an item on the published agenda or to comment during public comments must submit their statement or question in writing to the Village Manager’s Office and all properly submitted statements or questions will be presented and read during the relevant portion of the meeting. Written comments may be submitted by email to citizencomments@skokie.org by mail to Village of Skokie, Village Manager's Office, 5127 Oakton Street, Skokie, Illinois, 60077; or via the Village’s drop box located by the public entry to Village Hall. Pledge of Allegiance led by Village Clerk Pramod C. Shah. The Mayor called the meeting to order. The Clerk called the Roll. Those present were Trustees Roberts, Sutker, Ulrich, Bromberg. Klein, Gray-Keeler and Mayor Van Dusen. The Trustees were joining by remote electronic access. Motion to approve the Consent Agenda. Appointments, Reappointments and Resignations. A. Swearing in of Brian Baker as Police Chief by Village Clerk Pramod Shah. Mayor Van Dusen congratulated the new Police Chief who introduced his family. Police Chief Baker thanked the Mayor , Village Board and Police Department for the opportunity to serve. Former Chief Scarpelli also congratulated him. * B. Reappointments Appearance Commission: Michael Lynk as Chair Board of Fire and Police Commissioners: Beryl Rabinowitz as Vice Chair and Will Evans, Jr. as Chair Omnibus Vote. Presentations and Reports. A. Presentation Comprehensive Annual Financial Report (CAFR) Presentation by Jaime Wilkey of Lauterbach & Amen, LLP. Jaime Wilkey of Lauterbach & Amen, LLP., made a brief presentation on the annual audit. The 2020 CAFR includes the clean audit opinion from the auditors, who attest that the Village has property reported its financial position in accordance with accounting standards. Report of the Village Manager. A. COVID-19 Update. Mike Charley, Director of Health and Human Services gave an update on COVID 19. Up to date, Skokie has 3,599 cases, 54 deaths, 47.8 7 day moving average . Total cases for Nov. 1397 . Skokie’s positivity rate- 15%. Contact tracking is done 7 days a week, calling all positive reports within 24 hours. He gave a vaccine update-2 doses 3 weeks apart, people over 18, available by the end of December 2020. 13414 Meeting of the Mayor and Board of Trustees Monday December 7, 2020 Page Two POD Point of Dispensing -Village’s First Responders, Employees, the Public. The goal is to vaccinate 38,000 residents. Skokie’s Long-Term Care facilities and Group Homes will be vaccinated through Walgreens or CVS. Skokie Health & Human Services Department has been planning for the POD. B. Village Stormwater Plan Review Engineering Agreement – Christopher B. Burke Engineering, Ltd., Rosemont, Illinois - $426,780. Resolution 20-12-R-1482 Motion to concur with staff’s recommendation and request Mayor and Board approval of the Resolution authorizing a contract in an amount not to exceed $426,780 to be awarded to Christopher B Burke Engineering Ltd. Erik Cook, Director of Engineering answered questions from the Board. COVID Related Safety Measures and Furniture Upgrades for Village Hall. The Village has expended $57,987.49 on safety modifications at Village Hall utilizing various vendor. The purchases are being reimbursed through the FEMA/State COVID Grants. Omnibus vote. Report of the Corporation Counsel. * A. Ordinance 20-12-F-4541 Motion to adopt an ordinance providing for the levying and assessment of taxes for the fiscal year beginning May 1, 2020 and ending April 30, 2021 in the Village of Skokie, Cook County, Illinois. This item is on the consent agenda for second reading and adoption. Omnibus vote. * B. Ordinance 20-12-Z-4542 An ordinance granting a special use permit to allow outdoor dining at 3938 Dempster Street, Skokie, Illinois, in a B2 Commercial district and the repeal of Village Ordinance Numbers 81-6- Z-1367 and 94-8-Z-2451 (2020-13P). This item is on the consent agenda for second reading and adoption. Omnibus vote. FIRST READING: C. Resolution 20-12-R-1483 Motion to adopt a resolution approving and authorizing a Development Agreement with E&M Skokie, LLC for the property located at 4900-4930 Oakton Street, Skokie, Illinois. This item is on the agenda for first reading and approval. Mark Meyer from E&M Skokie LLC. thanked the Village of Skokie for the opportunity. Adjournment. 582348v1 B C A MML/JP: 11/16/2020 Manager’s Report *12/7/2020 THIS ORDINANCE MAY BE CITED AS VILLAGE ORDINANCE NUMBER 20-12-F- AN ORDINANCE PROVIDING FOR THE LEVYING AND ASSESSMENT OF TAXES FOR THE FISCAL YEAR BEGINNING MAY 1, 2020 AND ENDING APRIL 30, 2021 IN THE VILLAGE OF SKOKIE, COOK COUNTY, ILLINOIS 1 NOW, THEREFORE, BE IT ORDAINED by the Mayor and Board of Trustees of the 2 Village of Skokie, Cook County, Illinois: 3 4 Section 1: That for the fiscal year beginning May 1, 2020 and ending April 30, 2021, 5 the sum of $11,591,615 is hereby levied upon all property within said Village of Skokie subject 6 to taxation for General Corporate purposes, and the sum of $12,276,686 is hereby levied upon 7 all property within the said Village of Skokie subject to taxation for the Skokie Public Library, 8 and the sum of $2,357,103 is hereby levied upon all property within the said Village of Skokie 9 subject to taxation for the Firefighters’ Pension Fund, and the sum of $949,794 is hereby 10 levied upon all property within said Village of Skokie subject to taxation for the Police Pension 11 Fund, and the sum of $3,262 is hereby levied upon all property within Special Service Area 12 (SSA) Number 10 of said Village of Skokie, subject to taxation for improvements within the 13 SSA, as hereinafter set forth. 14 15 The total sum to be levied, namely $27,178,460 shall, when received, be used for the 16 purpose of paying the items hereafter set forth, for each of which an appropriation has been 17 heretofore legally made and which is to be collected from the tax levy of the current fiscal year 18 of said Village of Skokie for General Corporate purposes, and for the Skokie Public Library, 19 and for the Firefighters’ Pension Fund, and for the Police Fund, and for Secial Service Area 20 Number 10. 21 22 That the excess of the amount appropriated for any item over the amount levied for any 23 item, or where no levy is made for any item shall be derived from sales taxes, license fees, 24 permit fees, and other revenues to be collected and received by the Village from sources other 25 than from this tax levy. Hours for the proposed outdoor dining will be no earlier than 8:00 am and no later than 7 10:00 pm, from April 1 to October 31 of each year or as otherwise allowed to facilitate safe outdoor 8 dining, take out and curbside pickup; and 9 WHEREAS, since outdoor dining is an intensification of the use, one bicycle parking space 10 will be provided. Since 2011, limited service restaurants without drive-throughs have been 11 permitted uses in the B2 Commercial district, therefore the two existing special use ordinances 12 should be repealed; and 13 WHEREAS, the Skokie Plan Commission, at a public hearing duly held on October 1, 14 2020, for which proper legal notice had been achieved and no interested parties appeared, (a) 15 made the appropriate findings of fact as required under Section 118-6(f) of the Skokie Village 16 Code; (b) recommended the repeal of Village Ordinances 81-6-Z-1367 and 94-8-Z-2451; and (c) 17 voted to recommend to the Mayor and Board of Trustees that the requested special use permit be 18 granted subject to the conditions contained in the Plan Commission Report dated November 2, 19 2020; and Page 1 of 10 VOSDOCS-#582241-v1-Ordinance__2020-13P__Special_Use__Outdoor_Dining__3938_Dempster 1 WHEREAS, the Mayor and Board of Trustees, at a public meeting duly held on November 2 2, 2020, concurred in the aforesaid recommendations and findings of fact of the Skokie Plan 3 Commission; 4 NOW, THEREFORE, BE IT ORDAINED by the Mayor and Board of Trustees of the Village 5 of Skokie, Cook County, Illinois: 6 Section 1: That the special use permit requested by the petitioner to allow outdoor 7 dining at an existing limited-service restaurant at the Subject Property, described above and 8 commonly known as 3938 Dempster Street, Skokie, Illinois, in a B2 Commercial district, be and the 9 same is hereby granted and approved subject to each of the conditions set forth below: 10 1. The petitioner shall develop the Subject Property in substantial conformance with 11 the final Village approved site and landscape plan dated October 19, 2020, floor 12 plan dated October 19, 2020, and building elevations dated October 19, 2020; 13 2. Prior to the issuance of building permits, the petitioner shall submit to the Village 14 for approval; a lighting photometrics plan, fully developed civil engineering plans 15 that comply with the county WMO requirements and Village’s stormwater control 16 provisions, and redevelopment engineering plans to address all aspects of private 17 and public utility services. Any reconfigurations within state ROW will require an 18 IDOT highway/utility permit; 19 3. New parking lot and exterior lighting shall meet Illuminating Engineering Society 20 of North America (IES) standards, be full cut-off design, and be directed away 21 from adjacent properties, subject to the approval of the Engineering Division; 22 4. Any outdoor sound systems shall at all times maintain audio levels that are 23 compliant with the Skokie Village Code; 24 5. All existing damaged public sidewalks or public sidewalks damaged due to the 25 implementation of this plan shall be replaced; 26 6. No objects are allowed within a 10' sight distance triangle in R1, R2, R3, and R4 27 districts, or within a 15' sight distance triangle in all other districts, between 30" 28 and 84" in height from grade except traffic control devices listed in the Manual on 29 Uniform Traffic Control Devices; 30 7. Prior to the issuance of building permits, the petitioner shall submit a temporary 31 pedestrian, bicycle, and transit circulation plan, including routing, signage, and 32 barriers, to be in place prior to the commencement of construction, subject to the 33 approval of the Engineering Division; 34 8. All fencing, walls, sidewalks, driveways, curbs, wheel stops, parking areas, 35 signage, landscaping, structures, and any other facilities or infrastructure on the 36 Subject Property shall be maintained in a good state of repair, and when needed, 37 be repaired or replaced in a timely manner; 38 9. All private and public sidewalks shall be maintained free of snow, ice, sleet, or 39 other objects that may impede travel; 40 10. Trash shall only be allowed within a designated trash enclosure and shall be 41 screened from public view in an enclosure approved by the Appearance 42 Commission or Community Development Director. All trash shall be contained in 43 such a way as to remain out of sight at all times, except for waste receptacles Page 2 of 10 VOSDOCS-#582241-v1-Ordinance__2020-13P__Special_Use__Outdoor_Dining__3938_Dempster 1 referenced in Condition Number 11 below; 2 11. Waste receptacles shall be placed on the Subject Property for the use of 3 customers, and that the Health Department shall determine the size, type, and 4 location of these units; 5 12. All off-street parking spaces shall be legibly striped and maintained; 6 13. Any plan to modify parking lot striping must be approved by the Director of 7 Engineering; 8 14. The proposed development shall have a minimum of 20 off-street vehicle parking 9 spaces including 1 handicapped parking space, as indicated on the Subject 10 Property plan dated October 19, 2020; 11 15. The handicapped parking spaces shall be installed and maintained in compliance 12 with State of Illinois Accessibility Standards and the Skokie Village Code, including 13 required signage; 14 16. Vehicles shall not be allowed to be parked in or otherwise block common 15 driveways, sidewalks, aisles, or other points of access at any time, shall only be 16 parked in designated parking spaces, and shall not overlap the striped lines of 17 designated parking spaces; 18 17. The owner of the Subject Property [and its tenant, if any] shall ensure that 19 employees park on the Subject Property; 20 18. No required parking space on the site may be for the exclusive use of any tenant; 21 19. The petitioner shall sign an "Agreement for Installation and Maintenance of 22 Landscaping" to assure that the Subject Property and parkway landscaping is 23 completed and maintained, including trimming, watering, and replacing of dead 24 plant materials in a timely manner in accordance with the final approved 25 landscape plan. A copy of said Agreement is attached hereto, marked Exhibit “A” 26 and hereby made part of this Ordinance. This “Agreement for Installation and 27 Maintenance of Landscaping" shall be recorded at the petitioner’s expense; 28 20. All new construction, alterations, and remodeling shall meet current International 29 Building and NFPA Life Safety Codes as amended; 30 21. The petitioner shall obtain all required permits and approvals for improvements to 31 County, State, or Federal rights-of-way from the governing jurisdiction; 32 22. The Subject Property must conform to the Village's storm water control 33 requirements as contained in the Skokie Village Code, including the disconnection 34 of any downspouts; 35 23. All signage shall conform to the Skokie Village Code. Any sign on the Subject 36 Property that is in violation of that Code must be removed or modified to conform 37 with the Village Code prior to the issuance of an occupancy permit; 38 24. All modifications to building elevations, signage, and landscaping shall be subject 39 to the review and approval of the Skokie Appearance Commission; 40 25. The petitioner shall submit to the Planning Division electronic files of the site plan 41 and landscape plan in their approved and finalized form; 42 26. Prior to the issuance of building permits, the petitioner shall submit to the Page 3 of 10 VOSDOCS-#582241-v1-Ordinance__2020-13P__Special_Use__Outdoor_Dining__3938_Dempster 1 Planning Division of the Community Development Department the name, property 2 address, email address, and telephone number of the company and contact 3 person responsible for site maintenance in compliance with this special use 4 permit; 5 27. If work is to be performed on public property or if public property is utilized or 6 impacted during construction and/or development, the owner shall provide, or 7 shall cause the developer and/or contractor to provide, the Village of Skokie with 8 a certificate of insurance naming the Village of Skokie as additionally insured for 9 any and all claims related to any and all work. The owner shall hold, and shall 10 cause the developer and/or contractor to hold, the Village of Skokie harmless and 11 indemnify the Village for any and all claims for property damage or personal injury 12 related to work on or use of public property; 13 28. The petitioner shall comply with all Federal and State statutes, laws, rules and 14 regulations and all Village codes, ordinances, rules, and regulations; 15 29. Failure to abide by any and all terms of this Ordinance shall be cause for the 16 Village to initiate hearings to determine whether the subject Ordinance, as well as 17 any applicable business licenses, should be revised or revoked. The petitioner 18 shall pay all costs related to any hearings conducted as a result of non- 19 compliance with any of the provisions of the enabling ordinance. The costs shall 20 include but not be limited to court reporter fees, attorney fees, and staff time 21 required researching and conducting said hearing; 22 30. A screened garbage corral with an impermeable surface shall be provided to 23 contain all dumpsters; 24 31. No tables or eating counters shall be allowed at food establishments. The addition 25 of tables or eating counters shall constitute the addition of a food service use at 26 that location, and all additional regulations for that food service use shall apply; 27 32. At least once during every 4 hours of operation and before opening and closing of 28 the business, employees shall patrol the Subject Property and clear it of debris; 29 33. The owner of every occupied commercial premises used for the sale of packaged 30 or prepared food shall supply at least one approved covered container for litter at 31 the main entrance to the premises for use by customers. The owner of the 32 premises shall be responsible for the removal of litter every four hours; 33 34. Barriers, fencing, landscaping, and other features shall be utilized to define the 34 outdoor dining area; 35 35. Hours of operation for the outdoor dining shall be limited to between 8:00 AM and 36 10:00 PM, but not longer than the posted operational hours of the associated food 37 service facility, if the facility opens later and/or closes earlier than these hours; 38 36. Dates of operation shall be limited to between April 1 and October 31 in a 39 calendar year; 40 37. The outdoor dining area shall be exempt from the parking regulations if used or 41 set up less than 7 months in a calendar year; 42 38. All food preparation must take place inside the associated food service 43 establishment; 44 39. Adequate refuse disposal shall exist as determined by the Health Department; Page 4 of 10 VOSDOCS-#582241-v1-Ordinance__2020-13P__Special_Use__Outdoor_Dining__3938_Dempster 1 40. Advertising or promotional features shall be limited to umbrellas or canopies; 2 41. All applicable village and state health requirements shall be met; 3 42. Dining areas will be reviewed each year during the annual restaurant inspection. 4 The outdoor dining permit may be revoked by the Village Manager at any time on 5 14 days' notice for failure to comply with the regulations set forth in this 6 subsection; 7 43. The outdoor dining area shall not be enclosed on more than two sides with walls if 8 roofed over; 9 44. The outdoor dining area must be located on a surface approved by the Village 10 Manager or designee. 11 45. The outdoor dining area shall not be located in a required parking space or block 12 a public sidewalk; 13 46. The outdoor dining shall be on the same lot or within a development that received 14 site plan approval as its associated food service establishment; and 15 47. An outdoor dining area shall not be located within a 15-foot sight distance triangle 16 or within 3’ from any public alley. 17 18 Section 2: That Village Ordinance Numbers 81-6-Z-1367 and 94-8-Z-2451 are 19 hereby repealed. That any previous Village Ordinances repealed by these Ordinances, shall 20 remain repealed and remain null and void. Nothing in this Ordinance shall be construed to 21 reinstate the previously repealed ordinances. 22 Section 3: That a notice of the approval of this Ordinance incorporating the 23 conditions contained herein shall be executed by the owner of the property in writing and duly 24 recorded with the Cook County Recorder of Deeds Office at the owner’s expense. 25 Section 4: That this Ordinance shall be in full force and effect from and after its 26 passage, approval and recordation as provided by law. The parties to this Agreement hereby agree as follows: 5 6 PROPERTY OWNER is the owner of real property located in the Village of Skokie, 7 PARCEL 1: LOTS 52, 53, 54 AND 55 IN NORTHWESTERN EXTENSION REALTY COMPANY’S 8 SUBDIVISION IN THE SOUTH HALF OF THE WEST HALF OF THE SOUTHWEST QUARTER OF 9 SECTION 14, TOWNSHIP 41 NORTH, RANGE 13, EAST OF THE THIRD PRINCIPAL MERIDIAN, IN 10 COOK COUNTY, ILLINOIS. 11 PARCEL 2: THE SOUTH HALF OF VACATED ALLEY LYING IMMEDIATELY NORTH OF AND 12 ADJACENT TO THE EAST 21.16 FEET OF LOT 53 AND ALL OF LOTS 54 AND 55, AFORESAID. 13 PIN: 10-14-309-061-0000 14 1. At or near the time of execution of this Agreement, the VILLAGE granted an 15 Occupancy Permit, Business License, Site Plan Approval or Special Use Permit 16 hereinafter collectively referred to as “permit” pursuant to state statutes and local 17 ordinances. 18 2. By the terms of the aforesaid permit, the PROPERTY OWNER is required to install 19 and maintain landscaping in accordance with the site plan dated October 19, 2020, 20 or as it may be subsequently revised with the approval of the Village Manager, or 21 designee, and the Corporation Counsel. 22 3. The parties to this Agreement recognize that the installation and maintenance of 23 landscaping is an integral part of the PROPERTY OWNER's plan for development 24 and/or use of the property and is necessary to carry out the purpose and intent of the 25 VILLAGE's land use objectives, and that the permit would not have been approved 26 by the VILLAGE without the assurance that this Agreement would be executed by 27 the PROPERTY OWNER. 28 4. The purpose of this Agreement is to assure: 29 (a) installation of the landscaping in accordance with the landscaping plan 30 approved by the VILLAGE, and 31 (b) continued maintenance and care of the landscaping, including any 32 landscaping indicated in the parkway area. 33 5. The property, which is the subject matter of this Agreement, is legally described 34 above. The portions of the Subject Property which are to be landscaped and Page 6 of 10 VOSDOCS-#582241-v1-Ordinance__2020-13P__Special_Use__Outdoor_Dining__3938_Dempster 1 maintained pursuant to the terms and conditions of this Agreement are indicated on 2 the Landscape Plan attached hereto, marked Exhibit “1” and are hereby made a part 3 of this Agreement. 4 6. PROPERTY OWNER agrees that the installation and maintenance of the 5 landscaping which is required in accordance with the permit issued by the VILLAGE 6 and this Agreement will materially benefit the Subject Property. Such landscaping is 7 necessary in order for the PROPERTY OWNER to comply with the conditions of the 8 permit issued or granted by the VILLAGE for the PROPERTY OWNER’s requested 9 development or use of the property. 10 7. PROPERTY OWNER shall diligently maintain and care for the landscaping which is 11 installed and required by the permit and this Agreement, using generally accepted 12 methods of cultivation and watering. The PROPERTY OWNER shall maintain a 13 standard of care necessary to prevent the landscaping from deteriorating to the 14 extent that its value as landscaping is destroyed. If Exhibit “1”, attached hereto or 15 permit specifies maintenance standards or procedures, such procedures are hereby 16 adopted as part of this Agreement, and by such adoption, become enforcement 17 conditions of this Agreement. 18 8. Failure to maintain the landscaping as required by this Agreement shall be a 19 nuisance. In the event the PROPERTY OWNER fails to meet the standard of 20 maintenance necessary to keep the landscaping in a healthy condition as required 21 by this Agreement, the VILLAGE shall give written notice of the deficiency to the 22 PROPERTY OWNER who shall have 20 days to make the necessary correction or 23 replacement. If such correction or replacement is not made within the aforesaid 20- 24 day period, the VILLAGE may elect to abate the nuisance and take necessary action 25 to assure that the landscaping is replaced and/or maintained. In the event, the 26 VILLAGE so elects; the VILLAGE shall serve notice of its intent to enter the 27 premises for this purpose. The VILLAGE shall either personally serve the notice 28 upon the PROPERTY OWNER or mail a copy of it by certified mail to the 29 PROPERTY OWNER's last known address, or as shown on the tax rolls, at least 15 30 days in advance of the date when the VILLAGE or its agent intends to enter the 31 premises. 32 9. For this purpose, the VILLAGE or its agent may enter upon the property and perform 33 such work as it considers reasonably necessary and proper to restore, maintain, or 34 replace the landscaping required by this Agreement. The VILLAGE may act either 35 through its own employees or through an independent contractor. 36 10. The VILLAGE shall be entitled to reimbursement for abating the nuisance in 37 restoring, maintaining or replacing the landscaping, provided that the VILLAGE 38 follows the procedures set forth in this Agreement. Costs shall include but shall not 39 be limited to actual costs incurred by the VILLAGE and administrative costs. The 40 VILLAGE shall make demand upon the PROPERTY OWNER for payment. If the 41 PROPERTY OWNER fails to pay the costs within 30 days of the date on which 42 demand is made, the VILLAGE may cause a lien to be placed on the Subject 43 Property. The VILLAGE may record a notice with the Recorder of Deeds for Cook 44 County stating that it has incurred expenses under the terms this Landscape Page 7 of 10 VOSDOCS-#582241-v1-Ordinance__2020-13P__Special_Use__Outdoor_Dining__3938_Dempster 1 Agreement. The VILLAGE shall be entitled to collect interest at the statutory rate on 2 the amount owed. 3 11. In addition to having a lien placed on the Subject Property, the VILLAGE may 4 institute a legal action to collect the amount owed. The PROPERTY OWNER agrees 5 to pay the VILLAGE a reasonable sum for attorney's fees and court costs. 6 12. If either party upon the execution of this Agreement or during the course of 7 performance considers that it is necessary to have the PROPERTY OWNER post 8 additional security to guarantee the performance of his obligations hereunder, the 9 VILLAGE may require the PROPERTY OWNER to post additional security. The 10 VILLAGE may require either a cash deposit or a surety bond guaranteeing 11 performance in a form signed by sureties satisfactory to the VILLAGE. The 12 condition of the security shall be that if the PROPERTY OWNER fails to perform any 13 obligation under this Agreement, the VILLAGE may, act on behalf of the 14 PROPERTY OWNER and use the proceeds of the cash bond, or in the case of a 15 surety bond, require the securities to perform the obligations of this Agreement. 16 13. The PROPERTY OWNER hereby agrees to indemnify and hold harmless the 17 VILLAGE, its trustees, officials, employees and agents for any costs, claims, actions 18 or causes of action for personal injury, property damage or otherwise, including 19 reasonable attorney’s fees, which may arise from the VILLAGE exercising any of its 20 rights or obligations and performance under this Agreement. 21 14. This will bring 142 hotel 12 rooms, approximately 33,000 square feet of retail space on the first floor and rooftop and 13 approximately 10,000 square feet of banquet and event space to downtown Skokie. Public 14 parking will be provided as well as landscaping and right of way improvements; and 15 WHEREAS, Developer has provided supportive documentation to Skokie that, given 16 the costs associated with the site preparation and the construction of the Hotel Project, the 17 Hotel Project will not be feasible without financial assistance from Skokie. Skokie 18 recognizes that the development and operation of the Hotel Project on the Subject Property 19 prevents a condition of potential blight in a prime commercial and residential location within 20 the Redevelopment Zone; and 21 WHEREAS, in addition to Developer’s substantial financial commitment to achieve 22 the Hotel Project, Skokie will provide TIF funding to reimburse Developer for TIF eligible 23 costs related to the acquisition and the soil remediation of the Subject Property and the 24 construction and redevelopment of the Subject Property.
