13443 MINUTES of a regular meeting of the Mayor and the Board of Trustees of the Village of Skokie, Cook County, Illinois held in the Council Chambers at 5127 Oakton Street at 8 p.m. on Monday April 5, 2021 Until further notice, meetings of the Skokie Village Board will be held electronically, with a majority of Village officials participating via remote access in order to comply with the State of Illinois Gubernatorial Disaster Proclamation. Members of the public who wish to comment as to an item on the published agenda or to comment during public comments must submit their statement or question in writing to the Village Manager’s Office and all properly submitted statements or questions will be presented and read during the relevant portion of the meeting. Written comments may be submitted by email to citizencomments@skokie.org before or during the meetings; by mail to Village of Skokie, Village Manager's Office, 5127 Oakton Street, Skokie, Illinois, 60077; or via the Village’s drop box located by the public entry to Village Hall. Pledge of Allegiance led by Village Clerk Pramod C. Shah. The Mayor called the meeting to order. The Clerk called the Roll. Those present were Trustees Roberts, Sutker, Ulrich, Bromberg. Klein, Gray-Keeler and Mayor Van Dusen. The Trustees were joining by remote electronic access. Motion to approve the Consent Agenda with the exception of Item B on the Manager’s Report. Mayor Van Dusen recognized Eric P. Cook, Director of Engineering on his retirement from the Village and thanked him for his expertise and the many projects and improvements that he was involved with. Proclamations and Resolutions. A. Proclamations Active Transportation Alliance 35th Anniversary Mayor Van Dusen read a Proclamation honoring Active Transportation Alliance in providing technical assistance to the Village of Skokie to develop a Complete Streets Policy, a Complete Streets demonstration project on Lawler Avenue and a walk audit in downtown Skokie. Peggy Reins and Heather Schady thanked the Village for the recognition and honor. * National Public Health Week - April 5-11, 2021 Skokie Village Board, the Skokie Board of Health and our residents , all recognize the outstanding services that the Skokie Department of Health and Human Service’s staff, Medical Reserve Corp and volunteers provide to the Village and express our gratitude to you for your dedication , professionalism and innovation in response to a one in a century public health crisis. Omnibus vote. Recognition, Awards and Honorary Presentations. A. Award Presentation Fire Prevention Commendation to Ammeraal Beltech & Megadyne Fire Chief Hoeflich along with Captain Tom Doran presented the Fire Prevention Commendation plaque to Patrick Lightner, Manufacturing Engineer and Operations Safety Manager for Ammeraal Beltech & Megadyne. While employees were operating manufacturing equipment, a fire occurred in the laminating machinery. Report of the Village Manager. A. COVID-19 Update. Mike Charley, Director of Health and Human Services gave the update. To date, Skokie has 5,832 cases, 121 deaths. 7 day moving average 10.5/day. Positivity rate 4.3%-has gone up slightly. He spoke about the variants. The CDC is monitoring the variants with the help from the Illinois Department of Public Health. Information can be found-skokie.org, SkokieNews, Covid hotline, and by email. The Johnson and Johnson vaccine will be for homebound residents. There will be a Johnson and Johnson 3 hr. clinic starting the week of April 20. B. 115 Trust Agreement to Manage the Retirement Healthcare Funding Plan for Collective Bargaining Employees. Resolution 21-4-R-1490 Motion to approve the 115 Trust Agreement to manage the retirement healthcare funding plan for collective bargaining employees. Finance Director Julian Prendi answered questions from the Board. Prospect, IL in the amount of $3,928,888.88 for 2021 non-arterial street resurfacing program. Omnibus vote. Resolution 21-4-R-1491 Motion to approve a Resolution for improvement under the Illinois Highway Code for the 2021 Non-arterial street resurfacing Program using Motor Fuel Tax Funds. Omnibus vote. Motion to concur with the Plan Commission that the petitioner’s requests for a special use permit for a new construction limited service restaurant with a drive-through facility and outdoor dining at 3900 Dempster St in a B2 Commercial district be approved subject to all conditions. Plan Commission Case 2021-07P – Special Use Permit: 3900 Dempster Street Outdoor Dining Motion to concur with the Plan Commission that the petitioner’s request for a special use permit for outdoor dining associated with a limited service restaurant with drive-through at 3900 Dempster Street be approved subject to all conditions. MOTION CARRIED 3 13446 Meeting of the Mayor and Board of Trustees Monday April 5, 2021 Page Four Public Comment. Leslie Nathan 7700 block Kedvale, shared comments on hopes for Skokie’s future. Judy Mendel, 24 Williamsburg Terrace, comments on Affordable Housing, Elana Jacobs, shared comments on creating more in-person dialogues that are in multiple languages, talk about difficult issues, increase funding for social workers and dealing with conflict. Maggie Vandermeer, commented contested elections, voter turnout, commitment to sustainability, policing, affordable housing, commitment to equity and anti-racism. Nicole Reynolds commented on non- partisan elections, climate action and sustainability, affordable housing and police reform. Laura Williams, President People for a Safer Society thanked the Village for support of SB568 and HB3245 and the stronger laws around the Firearm Owner Identification System.(FOID). There were 3 comments that were political in nature that was not read. Adjournment. Adjournment. 585735v1 B MML: 4/5/21 Manager’s Report THIS RESOLUTION MAY BE CITED AS VILLAGE RESOLUTION 21-4-R- A RESOLUTION AUTHORIZING THE VILLAGE TO CREATE A 115 TRUST AGREEMENT IN ORDER TO MANAGE THE RETIREMENT HEALTHCARE FUNDING PLAN FOR COLLECTIVE BARGAINING PARTICIPANT EMPLOYEES 1 WHEREAS, the Village of Skokie (hereinafter “Village”), an Illinois Municipal Corporation, 2 is a member of the Illinois Public Pension Fund Association (hereinafter "IPPFA"); and 3 4 WHEREAS, IPPFA has created a Retiree Healthcare Funding Plan (hereinafter "Plan") 5 for the use of its member jurisdictions. The IPPFA offers the Plan and a Trust Agreement to 6 governmental employers for the benefit of their respective employees and beneficiaries; and 7 8 WHEREAS, pursuant to Village Resolution Number 18-6-R-1394 passed on June 18, 9 2018, the Village adopted the Plan and a Trust Agreement as the choice of the International 10 Association of Firefighters Local #3033, for a retirement healthcare plan, authorizing a retirement 11 healthcare funding plan for the International Association of Firefighters Local #3033; and 12 13 WHEREAS, the Village Manager or designee, was appointed to be the Program 14 Coordinator and an agreement was authorized with Babbitt Municipalities, Inc. (hereinafter “BMI”) 15 for administration of the Plan. State Street Bank and Trust (hereinafter “State Street”) was named 16 as passive trustee of the Plan; and 17 WHEREAS, as a result of the most recent collective bargaining agreement with the 18 Fraternal Order of Police, Lodge 68, they too have opted to enroll in the Plan. While the Village 19 has already adopted the Plan, it has been recommended by BMI that for all payments to the Plan, 20 a Section 115 Trust Agreement (hereinafter “Trust”) be utilized. The Trust includes a death 21 benefit for non-tax dependents and will cover all eligible participants under the Plan; and 22 WHEREAS, the current trust agreement authorized in Resolution Number 18-6-R-1394 23 will remain in effect for all contributions prior to the effective date of this Resolution. Both BMI and 24 State Street are again named as Administrator and Trustee of the Trust; and 25 WHEREAS, the Village Manager recommended to the Mayor and Board of Trustees that the 26 Village of Skokie authorize the Section 115 Trust Agreement, a copy of which is attached here to 27 as Exhibit “1”, for the administration of the IPPFA Retiree Healthcare Funding Plan to benefit all 28 employees eligible to participate as specified; 29 30 NOW, THEREFORE, BE IT RESOLVED by the Mayor and Board of Trustees of the Village 31 of Skokie, Cook County, Illinois that the Village of Skokie hereby authorizes the creation of the 32 Section 115 Trust Agreement, a copy of which is attached hereto as Exhibit “1”, for the 33 administration of the IPPFA Retiree Healthcare Funding Plan and corresponding Specifications, 34 as may be amended from time to time subject to the approval of the Corporation Counsel and 35 Village Manager or designee, to comply with changes in applicable laws, AUTHORIZING A SUPPLEMENTAL LOCAL PUBLIC AGENCY AMENDMENT #1 AGREEMENT FOR FEDERAL PARTICIPATION WITH THE STATE OF ILLINOIS PERTAINING TO BICYCLE LANE IMPROVEMENTS ON CHURCH STREET FROM LINDER AVENUE TO MCCORMICK BOULEVARD 1 WHEREAS, the Village of Skokie (hereinafter “Village”) pursuant to Village Resolution 2 Number 19-9-R-1444 authorized the execution of the Local Public Agency Agreement for Federal 3 Participation with the State of Illinois (hereinafter “State”) for Phase II design engineering services for 4 the Church Street Bicycle Lane Project. This action was taken due to the Congestion Mitigation 5 and Air Quality (hereinafter “CMAQ”) funds the Village received to undertake an improvement 6 project along Church Street between Linder Avenue and McCormick Boulevard (hereinafter 7 “Project”); and 8 WHEREAS, during the design process for the Project, the State has requested significant 9 improvements to three of the traffic signals within this project to safely accommodate the bike lanes. 10 As a result, the engineering and construction costs have increased; and 11 WHEREAS, subsequently, the Village requested an increase in funds with CMAQ for 12 construction to accommodate these improvements. However, in an effort to keep the project 13 moving expediently toward construction, some existing funds from construction have been 14 approved to be used for design; and 15 WHEREAS, the approved funds require an additional match from the Village, which has 16 also been shifted from construction funds. The total amount of the supplement required for this 17 project is $123,411.00. This was culminated with a 17" snowfall on February 14 and 15. This had the net effect of drastically reducing the roadway widths in many locations in Skokie, making the movements of emergency vehicles throughout the community extremely problematic. Moreover, clearing snow in multi-family areas of the community was particularly challenging, as there was little to no space available to push snow with conventional plows. Given the tremendous volume of snow, the Village needed to hire contracted leaders and operators to assist in our snow removal efforts. ITiese efforts included snow removal from. roadways and parking lots, industrial areas, and clearing and freeing of roadway drainage structures. Ill the interest of public safety and general welfare. Village staff enacted the Emergency Purchases Provision and obtained proposals for these services on a time and material basis. The proposal is to replace the existing Dunkin’ Donuts store with a drive-through with a new Dunkin’ store with a drive-through. The new plan increases the efficiency of the parking and traffic circulation, increases parking, provides an area for outdoor dining, significantly upgrades the landscaping, and replaces the aging structure with a more modern one. It will also continue the trend of new investment on this retail block. Discussion from the Commission included questions about trash collection and waste receptacles and timeline for construction. Environmental Health The Environmental Health Division notes that its final approval is contingent upon the Health Department Final Inspection at the time of building permit and certificate of occupancy. Traffic Engineering The parking requirement is met, with 17 parking spaces required and 17 provided. Minor modifications to the site plan need to be made: 1. The length of the landscape islands at each end of the southern tier of parking need to be increased to match the length of the parking spaces, making a consistent 24’ driveway width. 2. The 2 parking spaces on the east side of the building should be reduced to a stall depth of 16' with a 2' bumper overhang into the landscaped area. 3. The current Dunkin Donuts has been a tenant of the subject site for 10-15 years and the 60-70-year old building has served its useful life. It will be demolished and a new Dunkin Donuts with a drive-through facility which meets updated corporate standards will take its place with a slightly larger footprint. A commissioner asked if there were any citizen comments regarding the case. Staff replied that only 1 call came in from across Dempster Street; just being curious.
