13489 MINUTES of a regular meeting of the Mayor and the Board of Trustees of the Village of Skokie, Cook County, Illinois held in the Council Chambers at 5127 Oakton Street at 8 p.m. on Monday October 4, 2021 With Skokie and the entire State of Illinois now in Phase 5 of the Restore Illinois plan and the lifting of restrictions on in-person gatherings, Skokie Village Board meetings are in-person in the Council Chambers at Skokie Village Hall, 5127 Oakton Street. Village Board meetings begin at 8 p.m. and will continue to be broadcast live on the Village’s YouTube channel as well as on SkokieVision cable television channels 17 (Comcast) and 25 (RCN). Meetings also are re-broadcast on the cable channels in the weeks following each meeting, and the videos are archived on the Village’s YouTube channel. As of August 30, 2021, all individuals in Illinois shall be required to wear masks when indoors including Village buildings. Public comments may still be submitted to publiccomments@skokie.org; comments received prior to the meeting or during the meeting will be provided to the Village Board and will not be read aloud. Public comments also can be mailed or hand-delivered to Skokie Village Hall, 5127 Oakton Street, Skokie, Illinois, 60077, Attention: Village Manager’s Office or placed in the exterior drop box on the west side of Skokie Village Hall. Each Village Board meeting agenda includes time for public comments, and individuals wishing to speak on an issue will be allocated three minutes to address the Village Board. A. Awards Presentation Eleventh Annual Public Health Partners of Excellence Awards presented by Dr. William Werner and Michael Charley. Awards were given out to each recipient. Arie Crown Hebrew Day School For being a partner, collaborator, champion and advocate during the COVID-19 pandemic. and donating the space at 7770 Frontage Road for many months in 2021 to serve as the Village’s mass vaccination site. Haatzalah Chicago -For Hatzalah’s staff and volunteers volunteering countless hours at the Village’s COVID -19 pandemic. North Park College Nursing Program-Nursing students and staff volunteering countless hours administering vaccine to thousands of individuals at the Village’s vaccination sites. Oakton Community College Nursing Program- Nursing students and staff volunteering countless hours administering vaccine to thousands of individuals at the Village’s vaccination sites. Skokie Park District- For Park District staff working countless hours at the Village’s mass vaccination site, providing the essential and professional staff necessary to ensure the site was run effectively and efficiently. Skokie Public Library-For the Skokie Public Library staff volunteering countless hours answering phone calls, providing the essential and professional staff the Village needed to ensure residents could speak with someone promptly and get their questions answered during the height of our vaccination campaign. Ordinance 21-10-Z-4569 Motion to adopt an ordinance correcting a scrivener’s error regarding the vacation of certain portions of an unopened and unimproved residential street and alley within an area bounded by Grove Street, East Prairie Road and Lake Street, in an R1 Single-Family district (2017-28P). This item is on the consent agenda for second reading and adoption .The first reading was on September 22, 2021. Omnibus vote. SECOND READING: B. Ordinance 21-10-Z-4570 Motion to adopt an ordinance granting a special use permit to allow cremation services at 7309 Monticello Avenue, Skokie, Illinois in an M3 Industry district and relief from Chapter 118, Section 118-218 of the Skokie Village Code (2021-19P). Absent: None. MOTION CARRIED D. An ordinance amending Chapter 2, Article VII, of the Skokie Village Code pertaining to the creation of the Skokie Police Engagement Commission. This item was on the agenda for first reading and was taken off and postponed for further review by the Public Safety Commission. Public Comment. Rich Demsch spoke about speeding and traffic issues in Skokie . Traffic at Touhy, Linder and Frontage. Speeding on Oakton to McCormick, Howard to McCormick, Howard & Skokie Boulevard-specifically at the Trail crossing. Vicki Wolfinger, expressed views concerning whether School Resource Officers (SRO) should be hired in District 219 buildings by the school administration and also security and Police accountability. Carrie Bradean, spoke about the proposed “Creation of the Skokie Police Engagement Commission” Louis Mercer spoke about racism and black family harassments Matt Timkin spoke about reading of Public Comments and systemic racism. Nicole Reynolds read a prepared statement for Shira Hammann about reading of Public Comments and the proposed “Police Engagement Commission” This Public Comment was forwarded to the Board. Although, occasionally there may be a limited number of family 21 members who wish to witness the entry of the deceased into the retort chamber; and 22 WHEREAS, Village staff were supportive of the request and the relief from Section 23 118-218 of the Code, as long as no more than five (5) non-employees will be permitted on- 24 site at any given time; and 25 WHEREAS, at a public hearing of the Skokie Plan Commission, duly held on July 15, 26 2021, for which proper legal notice had been achieved, interested parties who spoke included 27 a Skokie funeral director who spoke regarding climate control and the operations of the 28 crematory; and Page 1 of 4 VOSDOCS-#591467-v1-Ordinance__2021-19P__Special_Use__Cremation_Services__7309_Monticello Return to Corp Rpt 1 WHEREAS, subsequent to all discussion, the Skokie Plan Commission; (a) made the 2 appropriate findings of fact as required under Section 118-6(f) of the Skokie Village Code and 3 (b) voted to recommend to the Mayor and Board of Trustees that the requested special use 4 permit be granted subject to the conditions contained in the Plan Commission Report dated 5 August 16, 2021; and 6 WHEREAS, the Mayor and Board of Trustees, at a public meeting duly held on August 7 16, 2021, concurred in the aforesaid recommendations and findings of fact of the Skokie Plan 8 Commission; 9 WHEREAS, subsequent to the August 16, 2021 Village Board Meeting and the 10 presentation which is included in Plan Commission Report 2021-19P, staff determined that the 11 Plan Commission had inadvertently omitted the recommendation regarding the relief sought 12 from Chapter 118, Section 118-218, of the Code. While the request for relief was stated in the 13 Staff Report which was included in the Plan Commission Report, a separate vote on the 14 requested relief was not taken. It is believed that this was a procedural oversight; and 15 NOW, THEREFORE, BE IT ORDAINED by the Mayor and Board of Trustees of the 16 Village of Skokie, Cook County, Illinois: 17 Section 1: That the special use permit requested by the petitioner to allow 18 cremation services at the Subject Property, described above and commonly known as 7309 19 Monticello Avenue, Skokie, Illinois, in an M3 Industry district, be and the same is hereby 20 granted and approved subject to each of the conditions set forth below: 21 1. The petitioner shall develop the Subject Property in substantial conformance 22 with the final Village approved site plan and floor plan dated July 29, 2021; 23 2. Prior to the issuance of building permits, the petitioner must provide copies of 24 any and all necessary permit(s), licenses, and supporting documentation 25 required by the Illinois Environmental Protection Agency, the Illinois Pollution 26 Control Board, and the Illinois Office of the Comptroller authorizing the 27 construction and operation of the crematorium; 28 3. The petitioner shall provide to the Village annually, proof of inspection of the o 29 on site equipment utilized for cremation, including the levels of emitted gases 30 and particulate; 31 4. No more than 5 non-employees will be permitted to on-site at any given time; 32 5. The owner of the Subject Property shall ensure that all occupants of the 33 building containing the use must park on-site. Adjacent tandem or on-street 34 parking in the neighborhood is prohibited; 35 6. All fencing, walls, sidewalks, driveways, curbs, wheel stops, parking areas, 36 signage, landscaping, structures, and any other facilities or infrastructure on 37 the Subject Property shall be maintained in a good state of repair, and when 38 needed, be repaired or replaced in a timely manner; 39 7. All private and public sidewalks shall be maintained free of snow, ice, sleet, or 40 other objects that may impede travel; 41 8. Vehicles shall not be allowed to be parked in or otherwise block common 7 driveways, sidewalks, aisles, or other points of access at any time, shall only 8 be parked in designated parking spaces, and shall not overlap the striped lines 9 of designated parking spaces; 10 12. All signage shall conform to the Skokie Village Code; 11 13. All modifications to building elevations, signage, and landscaping shall be 12 subject to the review and approval of the Skokie Appearance Commission; 13 14. Prior to the issuance of building permits, the petitioner shall submit to the 14 Planning Division of the Community Development Department the name, 15 property address, email address, and telephone number of the company and 16 contact person responsible for site maintenance in compliance with this 17 special use permit; 18 15. If work is to be performed on public property or if public property is utilized or 19 impacted during construction and/or development, the owner shall provide, or 20 shall cause the developer and/or contractor to provide, the Village of Skokie 21 with a certificate of insurance naming the Village of Skokie as additionally 22 insured for any and all claims related to any and all work. The owner shall 23 hold, and shall cause the developer and/or contractor to hold, the Village of 24 Skokie harmless and indemnify the Village for any and all claims for property 25 damage or personal injury related to work on or use of public property; 26 16. The petitioner shall comply with all Federal and State statutes, laws, rules and 27 regulations and all Village codes, ordinances, rules, and regulations; and 28 17. Failure to abide by any and all terms of this Ordinance shall be cause for the 29 Village to initiate hearings to determine whether the subject Ordinance, as well 30 as any applicable business licenses, should be revised or revoked.
