MINUTES of a regular meeting of the Mayor and the Board of Trustees of the Village of
Skokie, Cook County, Illinois held in the Council Chambers at 5127 Oakton Street at 8
p.m. on Tuesday February 22, 2022
With Skokie and the entire State of Illinois now in Phase 5 of the Restore Illinois plan and the
lifting of restrictions on in-person gatherings, Skokie Village Board meetings are in-person in the
Council Chambers at Skokie Village Hall, 5127 Oakton Street. Village Board meetings begin at 8
p.m. and will continue to be broadcast live on the Village’s YouTube channel as well as on
SkokieVision cable television channels 17 (Comcast) and 25 (RCN). Meetings also are re-broadcast
on the cable channels in the weeks following each meeting, and the videos are archived on the
Village’s YouTube channel.
As of August 30, 2021, all individuals in Illinois shall be required to wear masks when indoors
including Village buildings.
Public comments may still be submitted to publiccomments@skokie.org; comments received prior
to the meeting or during the meeting will be provided to the Village Board and will not be read
aloud. Public comments also can be mailed or hand-delivered to Skokie Village Hall, 5127 Oakton
Street, Skokie, Illinois, 60077, Attention: Village Manager’s Office or placed in the exterior drop
box on the west side of Skokie Village Hall. Each Village Board meeting agenda includes time for
public comments, and individuals wishing to speak on an issue will be allocated three minutes to
address the Village Board.

dealers (2021-24P). This item is on the agenda for second reading and adoption.

Trustee Robinson asked questions pertaining to the routes that the trucks will go , timing of
deliveries , bird migration, bird strikes, sales tax that Carvana would bring to Skokie, billboard-
sign code, bond for demolition if the structure is vacant for 2 years, how the review process
works, the role of the Sustainable Environmental Advisory Commission (SEAC) and prohibited
uses. Manager Lockerby answered all of the questions.

Report of the Village Manager.
A. Old Orchard Center Business District Designation and Approvals.
Economic Development staff recommends approval of designating the Old Orchard Center
Business District, approving the Plan, making a determination and finding of a blighted area, and
authorizing the imposition of a 1% Retailer's Occupation and Service Occupation Tax in
connection with the proposed Old Orchard Center Business District,
Trustee Johnson had questions and comments on the proposed project regarding blighted areas.
Corporation Counsel, Manager Lockerby and Mayor Van Dusen answered questions from the
Board.
Motion to concur with staffs recommendations and request Mayor and Board to authorize
Corporation Counsel to draft the necessary code amendments and ordinances which would be
presented to the Board at the March 7, 2022 meeting,

Donna Pugh, partner of Foley & Lardner, Project Team Leader Robert Kusel spoke about lighting,
bird strike mitigations, adjustments, change of hours of truck delivery, land use, modifications,
change in hours of lighting.
Trustee Sutker commented on a land use decision and whether the Village, the petitioner
and the community stakeholders worked together to mitigate the impact.
Trustee Khoeun made a motion to request that an independent research study to monitor
bird strikes for at least one year on both the Carvana and adjacent Optima buildings. The
pm-pose of the study is to gain further understanding on bird impacts and the effectiveness
of mitigation measures to facilitate future policy in both Skokie and at regional and
national levels.

Trustee K!ein commented on demolition (if needed), saies, delivery hours -weekends? And safety
measures and if any mechanical work would be done on the property.
Attorney for Optima Steven Blonder introduced Asher Bronfeid, President of the Association
spoke about spot zoning, trucks during tiie day, character of the neighborhood, sales tax, sales
projections.

Marine Craft Dealer within the OR- Office Research District.

and Climate Action. He mentioned that the Village received a letter from Debra Shore, bead of
Environmental protection agency Midwest Region.
Ali the Trustees thanked the Plan Commission, Appearance Commission, Village Staff, residents
of Skokie for ti-ieir input and passion for Skokie, all the emails that were sent. The Village thanked
Caravana for the changes that were snade-changirsg the trucking route, delivery hours, treating the
glass, reducing the lighting and turning the off the lights on ai! four sides during the migratiosi
periods.

2022-2023 Community Development Block Grant Public Hearing #3_
The Public Hearing was presented by Carrie J Haberstich, Planning Supervisor
The CDBG entitlement amount remains unknown, so an estimate of $600,000 is in the budget.
In addition to the new entitlement, $105,000 in unobtigated funds and $7,200 in program income

funds will be retained for emergencies for construction-related activities. The total estimated
budget is $712,200.
For the ninth year in a row, the Department of Housing and Urban Development (HUD) is
requesting that the Village not submit its Annual Action Plan until the entitlement amount is
known. We are proceeding with our typical public hearing schedule on the condition that
flexibility is incoq^orated into the draft plan to accommodate a range of funding level
possibilities. The following guidelines utilize a ±20% contingency if the funding is greater than,
equal to, or less than the base entitlement estimate of $600,000;
• Less than $480,000: A substantial amendment to the Action Plan will be necessary.
" Less than $600,000: An across-the-board proportional reduction will be pursued.
" $600.000: ("full funding") the funding will be distributed as budgeted.
• Less than $712,200: The balance of the 15% services cap will be applied to the Village
social worker position, and the balance of the entitlement funds will be applied to the
Village's Home Improvement Program up to $90,000, and any remaining balance will be
applied to the Neighborhood Enhancement Program.
Greater than $712,200: The balance above $712,200 will be carried forward to the
following program year. No substantial amendment to the Action Plan will be pursued,
• No project or service funding level will be less than $3,000.

A. Establishing a PACE (Pro^)ertv_Assessed Clean Eneravl Area and Prociram
to Finance Enemy Efficiency and Water Use Improvement Projects.
This proposed, innovative program facilitates furthering environmental
sustainabiiity by providing an environmentaliy specific financing mechanism.
Under Illinois law, municipalities may establish Commerciat Property Assessed
Clean Energy (C-PACE) programs in order to offer for-profit and non-profit owners
of commerciai, industrial, and muiti-family (5 or more units) properties long-term,
fixed-rate financing for up to 100% of the costs of their respective alternative
energy, energy efficiency, renewable energy, resiliency, and water use
improvement projects. This proposal is intended to be a demonstration project
that can be rolled out Village-wide and serve as an additional strategy to help
advance the Village's sustainability efforts.
Due to the commitment to the environment by both the Hilton Hotel Brand and
E&M Development, the Homewood Suites by Hilton to be constructed at the
northeast corner of Oakton Street and Miles Avenue in downtown Skokie, is a
strong candidate for this program. Specifically, the eligible expenses include
construction materials made from recycled content, technology-based energy
climate controls and improved storm water retention.
If approved, Skokie nor taxpayers would have any cost or liability. In addition, the
hotel developer E&M would enter into an assessment contract with the Village,
and a bond issue secured by the assessment contract funds the Energy Project.
Such PACE bonds would be repaid through a special assessment lien imposed
on the hotel property pursuant to the assessment contract PACE bonds for the
hotel would be issued by the Illinois Finance Authority to finance energy projects
in accordance with the PACE Act. The bonds which are anticipated to be $12.3
Million of the project cost will be purchased by one of the hotels Capital Providers
(Castle Green, LLC). I concur with staff's recommendation and respectfully
request Mayor and Board approval of an ordinance establishing a PACE Area and
Program to finance energy projects and other related environmenta! matters.

B. Replacement Fire Hvdrants and Accessories ~ Core and_MairL_Lake_BlufL
Uimpis - $62,656 and Ziebell Water Service Products. Elk Grove Village,
Illinois - $62,656 and Water Products Company. Aurora. Illinois - $9.630.
The Skokie Fire Department has an ongoing Fire Hydrant Maintenance Program
and the replacement of several fire hydrants and related parts is now necessary.
Core and Main, Ziebell and Water Products Company have sold the Village
equipment for a number of years with satisfactory results. Core and Main and
Ziebell will provide the hydrants and Water Products Company will supply the
valve boxes. The contract aiso contains a clause allowing the Village to extend
the awarded price for up to two additional years. I concur with staff's
recommendation and respectfully request Mayor and Board approval of contracts
in the amount of $125,312, to be awarded to Core and Main and Ziebell Water
Service Products for the purchase of the hydrants, and $9,630 to Water Products
Company for the purchase of the valve boxes.
C. Main Street Landscaped Median and Channel Park Gateways Maintenance &
Services - Moore Landscapes, Northbrook, Illinois - $31,760.
There are 35 landscaped medians on Main Street from Lincoln Avenue to
McCormick Boulevard and eight landscaped gateway areas for Channel Park that
run along McConnick Boulevard from Golf Road to Touhy Avenue that require
landscape services, such as spring dean-up, weeding, litter removal, plant
fertilization, mulching and pruning. Five bid responses were received with Moore
Landscapes the lowest responsive and responsible bidder. The Village has
worked with Moore Landscapes in the past with favorable results. Therefore, I
concur with staff's recommendation and respectfully request Mayor and Board
approval of a contract in the amount of $31.760 to be awarded to Moore
Landscapes.

Executive Summary:
The Board will be asked to consider approving an environmentally specific financing mechanism
for construction of the Homewood Suites by Hilton (Northeast corner ofOakton and Niles
Avenue). To that end, under Illinois law, cities, villages, and incorporated towns may establish
Commercial Property Assessed Clean Energy ("C-PACE") programs for specific projects and
also create related 'PACE areas' in order to offer for-profit and non-profit owners of
commercial, industrial, and multi-family (of 5 or more units) properties long-term, flxed-rate
financing or refinancing for up to 100% of the costs of their respective alternative energy, energy
efficiency, renewable energy, resiliency, and water use improvement projects. The building is
adopting multiple guidelines as set forth by the Department of Energy, Village ofSkokie and
Hilton brand standards. Some of these include construction materials made from recycled
content with a high R-value insulation where possible, technology-based energy climate controls
and improved storm water retention that meets the Clean Water Act and all current
environmental standards. The PACE program is at no cost or liability for the Village and are
never general or moral obligation bonds of local or state taxpayers.
Given the urgency and importance of trying to achieve net zero emissions as well as embracing
energy efficiency, this project is the first PACE project which can hopefully be rolled out
Village-wide in the next couple of months. Furthermore, if approved, this will be the first PACE
project in the area and will help advance the Village's sustainability efforts as it could be used as
a tool through Skokie for applicable projects.
For projects such as the Hotel, PACE bonds are a more economical alternative to mezzanine debt
and are becoming increasingly popular throughout the State and U.S. If affirmed by the board
through this ordinance, PACE bonds for the Hotel would be issued by the Illinois Finance

Authority (per the lenders request) to finance energy projects in accordance with the PACE Act.
The Illinois Finance Authority (IFA) is a body politic and is authorized to issue PACE bonds
throughout Illinois, as defined in the PACE Act. For the hotel project, the bonds will be
purchased by one of the hotels Capital Providers (Castle Green, LLC), hence this request for
upcoming consideration.
Why PACE and IFA?
As allowed by state law, the IFA provides a "turn-key" financing and funding solution to
Governmental Units in the form of public processes and documents to expedite program
implementation and the closing of PACE projects. The IFA s standardized financing
documents reduce due diligence costs in the secondary market, and, as a result, the PACE
bonds issued by the IFA are easier to securitize, an option that will attract Capital Provider
to, and encourage the development and maturity of, the PACE market in Illinois. The IFA
has a long record of success as the State's largest issuer of federally tax-exempt conduit
bonds with more than $23 billion outstanding, including close to $2 billion in State
Revolving Loan water infrastructure bonds.
The PACE Act authorizes Governmental Units to procure and appoint a program
administrator to undertake all the substantive duties of the Governmental Units under the
PACE Act. PACE program administrators generally perform their duties at no cost to the
Governmental Unit. PACE program administrators typically are compensated by the property
owner. PACE program administrators charge an application or processing fee, usually a
percentage of the project cost being financed, which fee is capitalized as part of the
assessment and paid at the closing of the issuance of the PACE bond. To the extent there are
duties performed by the program administrator in connection with the administration of the
assessment contract, PACE program administrators may charge an annual fee, which fee can
be a percentage of the installment or the principal amount thereof or a fixed fee, and which fee
is added to the assessment installments.
If approved, Skokie would not have any liability under a properly established PACE Program.
The assessment contract, which is between the Governmental Unit and the private property
owner, is very clear on this point and includes broad exculpation and indemnification
provisions to benefit the Governmental Unit, among others. This indemnification obligation
runs with the land and is secured by the lien of the assessment (property taxes) and is senior to
all private debt andjudgments. Furthermore, the PACE bond is non-recourse, and the
Master Indenture also contains additional broad exculpation provisions.
If approved by the Board, the hotel developer (E&M) would enter into an assessment contract
with the Village, and a bond issue secured by the assessment contract funds the Energy Project.
Such PACE bonds would be repaid through a special assessment lien imposed on the hotel
(property) pursuant to the assessment contract. Combined, the aggregate amount financed or
refinanced under one or more Assessment Contracts cannot exceed 25% of the greater of (1) the
assessed value of the property or (2) the appraised value, as determined by a licensed appraiser.

1 WHEREAS, the Village of Skokie (hereinafter “Skokie”), a village duly organized
2 and validly existing under the Constitution and the laws of the State of Illinois, is a
3 home rule unit of local government of the State of Illinois authorized pursuant to the
4 Property Assessed Clean Energy Act, 50 ILCS 50/1 et seq., as amended (hereinafter
5 “Act”) to establish a property assessed clean energy program (hereinafter “Program”),
6 create a PACE area (hereinafter “Area”) as defined in the Act and finance or refinance
7 energy projects as defined in the Act; and
8 WHEREAS, the Act states that a program such as the Program may be
9 administered by a program administrator, as set forth in the Act; and
10 WHEREAS, Skokie desires to designate CastleGreen Services, LLC, as the
11 program administrator (hereinafter “Program Administrator”) for the Program; and
12 WHEREAS, the Program Administrator has prepared the report attached hereto
13 as Exhibit “A” (hereinafter the “Program Report”) setting forth certain terms of the
14 proposed Program in conformity with the Act; and
15 WHEREAS, Skokie now desires to establish the Area, as legally described in
16 Exhibit “B” and attached hereto, and to establish the Program as further described
17 herein and in the Program Report and to finance or refinance energy projects; and
18 WHEREAS, the Illinois Finance Authority (hereinafter “IFA”), a body politic and
19 corporate duly organized and validly existing under and by virtue of the laws of the State
20 of Illinois, is authorized to issue PACE bonds, as defined in the Act, to finance or
21 refinance energy projects in accordance with the Act and pursuant to subsection (d) of
22 Section 825-65 of the Illinois Finance Authority Act, 20 ILCS 3501/801-1 et seq. (the
23 “IFA Act”); and
24 WHEREAS, the Mayor and Board of Trustees, after a public meeting duly held on
25 February 22, 2022, concurred in the aforesaid recommendations and findings of the
26 Village Manager and Economic Development Manager.

1 NOW, THEREFORE, BE IT ORDAINED by the Mayor and Board of Trustees of the
2 Village of Skokie, Cook County, Illinois:
3 Section 1: Incorporation of the Recitals. The Mayor and Board of Trustees
4 hereby finds that all of the recitals contained in the preambles to this Ordinance are
5 true, correct and complete and are hereby incorporated by reference thereto and are
6 made a part hereof.
7 Section 2: Designation of the Program Administrator. The Village of Skokie
8 hereby designates CastleGreen Services, LLC, as the program administrator for the
9 Program.
10 Section 3: Report of the Program Administrator; Creation of Area. The
11 Mayor and Board of Trustees hereby find as follows:
12 a. The financing or refinancing of energy projects is a valid public purpose and
13 serves an essential governmental function;
14 b. Skokie intends to facilitate access to capital from the Program Administrator
15 approved by the Mayor and Board of Trustees or as otherwise permitted by the Act, to
16 provide funds for energy projects which will be repaid by assessments on the property
17 as defined in the Act, benefitted with the agreement of the record owners (as defined in
18 the Act) of record for such property;
19 c. A description of the territory within the Area, the types of energy projects that
20 may be financed or refinanced, and the description of the proposed arrangements for
21 financing the Program through the issuance of PACE bonds under or in accordance
22 with Section 35 of the Act, which PACE bonds may be purchased by one or more
23 capital providers, as defined in the Act; are all set forth in the Program Report which is
24 attached hereto as Exhibit “A”. The Program Report is hereby incorporated by reference
25 thereto and made a part hereof. Skokie hereby approves the Program Report and
26 hereby establishes the Area as legally described in Exhibit “B”, attached hereto. The
27 Program Report shall be made available for public inspection in the office of the Skokie
28 Village Clerk.
29 Section 4: No Public Hearing; Program Established. Skokie hereby finds
30 that no public hearing shall be required in connection with the adoption of the Program
31 and hereby establishes the Program, in accordance with the Program Report.
32 Section 5: Assessment Contract. The form of the “Assessment Contract”, as
33 defined in the Act and attached hereto as “Appendix B” to the Program Report is hereby
34 approved. The Village Manager or designee, (hereinafter “Authorized Officer”) is hereby
35 authorized to negotiate, execute, and deliver one or more Assessment Contract(s) with
36 the record owners who have met the requirements set forth in the Program Report with
37 such changes, deletions, and insertions as shall be approved by the Authorized Officer
38 and such other supporting documents as may be necessary or appropriate to carry out
39 and comply with the provisions of such Assessment Contract, and upon execution to
40 record such Assessment Contract with the Cook County Clerk. The execution of such

1 agreements and instruments shall be conclusive evidence of such approval. Prior to
2 execution of any Assessment Contract, the Authorized Officer shall make the
3 determination set forth in clause (i) below and shall have received evidence of items (ii)
4 through (xi) below, to be documented in a written notification to be filed with the Skokie
5 Village Clerk:
6 i. that the property to be assessed is entirely within the Area of Skokie;
7 ii. that there are no delinquent taxes, special assessments or water or sewer
8 charges on the property to be assessed;
9 iii. that there are no delinquent assessments on the property under a property
10 assessed clean energy program;
11 iv. whether there are any involuntary liens on the property, including, but not
12 limited to, construction or mechanics liens, lis pendens or judgments against the record
13 owner, environmental proceedings, or eminent domain proceedings;
14 v. that no notices of default or other evidence of property-based debt
15 delinquency have been recorded and not cured;
16 vi. that the record owner is current on all mortgage debt on the property, the
17 record owner has not filed for bankruptcy in the last two (2) years, and the property is
18 not an asset in a current bankruptcy proceeding;
19 vii. that all work requiring a license under any applicable law to acquire,
20 construct, install, or modify an energy project shall be performed by a licensed
21 contractor that has agreed to adhere to a set of terms and conditions through a process
22 established by Skokie or the Program Administrator and described in the Program
23 Report;
24 viii. the contractor or contractors to be used have signed a written
25 acknowledgement that Skokie or the Program Administrator will not authorize final
26 payment to the contractor or contractors until Skokie or the Program Administrator has
27 received written confirmation from the record owner that the energy project was properly
28 acquired, constructed, installed or modified and is operating as intended; provided,
29 however, that the contractor or contractors retain all legal rights and remedies in the
30 event there is a disagreement with the record owner; with the record owner;
31 ix. that the aggregate amount financed or refinanced under one or more
32 assessment contracts does not exceed 25% in relation to the greater of any of the
33 following:
34 (A) the value of the property as determined by the Office of the Cook
35 County Assessor; or
36 (B) the value of the property as determined by an appraisal conducted
37 by a licensed appraiser;

1 x. that an evaluation of the existing water or energy use and a modeling of
2 expected monetary savings have been conducted for any proposed energy efficiency
3 improvement, as defined in the Act, renewable energy improvement, as defined in the
4 Act, or water use improvement, as defined in the Act, unless the water use improvement
5 is undertaken to improve water quality in accordance with the procedures set forth in the
6 Program Report; and
7 xi. before entering into the Assessment Contract with Skokie, the record
8 owner shall have provided to the mortgage holders of any existing mortgages
9 encumbering or otherwise securing the property a notice of the record owner’s intent to
10 enter into the Assessment Contract with Skokie, together with the maximum principal
11 amount to be financed or refinanced and the maximum assessment necessary to repay
12 that amount, along with an additional request that the mortgage holders of any existing
13 mortgages consent to the record owner subjecting the property to the Program. Prior to
14 the execution of any Assessment Contract, Skokie shall have been provided with a copy
15 or other proof of those notices and the written consent of the mortgage holder for the
16 record owner to enter into the Assessment Contract which acknowledges that (a) the
17 existing mortgage or mortgages for which consent was received will be subordinate to
18 the Assessment Contract and the lien created thereby and that Skokie or, if applicable,
19 its permitted assignee, as defined in the Act, can foreclose the property if the
20 assessments are not paid.
21 Section 6: Additional Actions. The Authorized Officer is hereby authorized:
22 i. to approve the form of Program Handbook of the Program Administrator,
23 as defined in the Program Report, setting forth certain additional requirements,
24 procedures, and descriptions relating to the Program and to negotiate, execute, and
25 deliver such other supporting documents as may be necessary or appropriate to
26 implement the Program;
27 ii. in connection with the issuance of PACE bonds by the IFA to finance or
28 refinance energy projects in accordance with the Act and pursuant to subsection (d) of
29 Section 825-65 of the Authority Act, to negotiate, execute, and deliver one or more
30 agreements assigning to the IFA an Assessment Contract securing such PACE bonds;
31 and
32 iii. to approve changes, updates, amendments, modifications or supplements
33 to the Program Report to the extent such changes, updates, amendments, modifications
34 or supplements comply with the parameters and requirements set forth in the Act.
35 Section 7: Enactment. The provisions of this Ordinance are hereby declared
36 to be separable and if any section, phrase or provision shall for any reason be declared
37 by a court of competent jurisdiction to be invalid or unenforceable, such declaration
38 shall not affect the validity or enforceability of the remainder of the sections, phrases
39 and provisions hereof. All ordinances, orders and resolutions and parts thereof in
40 conflict herewith are to the extent of such conflict hereby repealed, and this Ordinance
41 shall take effect and be in full force immediately upon its adoption. No provision of the
42 Illinois Municipal Code or violation of any provision of the Illinois Municipal Code shall
43 be deemed to impair the validity of this Ordinance or the instruments authorized by this

5 Section 8: That a notice of the approval of this Ordinance incorporating the
6 conditions contained herein shall be executed by the owner of the property in writing
7 and duly recorded with the Cook County Clerk’s Office at the owner’s expense.
8 Section 9: That this Ordinance shall be in full force and effect from and after
9 its passage, approval, and recordation as provided by law.

Comments:
This purchase is part of the on-going Fire Hydrant Maintenance Program performed by the
Skokie Fire Department, which has necessitated the replacement of a significant number of older
fire hydrants and their related parts. Since the implementation of this comprehensive testing and
maintenance program, many fire hydrants requiring repair were found to be obsolete and
replacement parts were unavailable. In addition to this increased need for fire hydrants, a number
ofhydrants purchased each year will replace those units that are damaged in accidents. A portion
of this expense will be reimbursable through insurance subrogation.
Core and Main, Ziebell and Water Products Company have supplied Skokie with fire hydrants and
water service supply items for many years. Staff is confident that each firm's performance on
this contract will equal the past high levels of service. Core and Main and Ziebell will be supplying
fire hydrants manufactured by Mueller, which is a Village approved brand. Water Products
Company will be supplying the valve boxes.
Additionally, staff has asked bidders to extend pricing for emergency or incidental needs, which
may occur during the course of the fiscal year. The recommended bidders have extended their
volume pricing for these incidental purchases. The contract also contains a clause allowing the
Village to extend the awarded price for up to two additional years, with the mutual written
agreement between the vendors and the Village.

Comments:
The work performed under this contract entails the regular landscape maintenance of the
Main Street medians and the Channel Park gateways & sign beds. There are 35
landscaped medians on Main Street that run 2.5 miles from Lincoln Avenue east to
McCormick Boulevard. They consist ofirrigated, landscaped areas that are planted with a

variety of perennials and shrubs amongst existing trees, with an approximate area of
9,405 square yards.
Channel Park runs along the east side ofMcCormick Blvd from Golf Rd south to Touhy
Ave. There are eight (8) landscaped gateway areas (non-imgated) that are included with
this contract. There are also four small beds around signs throughout the park. The total
approximate area of these landscaped areas is 1,538 square yards.
Work under this contract will entail landscape bed spring clean-up, weeding, litter
removal, plant fertiUzation, mulching and pruning. A horticulturist of the recommended
landscaping firm will provide regular assessments of the median's plant health,
performance and appearance relative to variables such as moisture and soil conditions.

with the restrictions listed for this use.
The Appendix A Use Table which provides a list of zoning uses, will be amended by adding
Car Dealers and Marine Craft Dealers as a restricted use in the OR Office Research district.
B Ordinance. 2021-25P. Site Plan Approval. Car Dealership. 9801 Woods Drive (to be known

Item B is on the agenda for second reading and adoption. The first reading was on February 7,
2022.
This Ordinance will grant site plan approval for the construction of a car dealership at 9801
Woods Drive, which subsequent to adoption, will be known as 9757 Woods Drive, in an OR
Office Research district. The property was previously the site of the Rand McNally campus and
has now been proposed as the site for a Carvana dealership and a 134-foot car tower.
Subsequent to Plan Commission meetings on November 18, 2021 and January 6, 2022, the
Plan Commission has amended their recommendation by revising and adding various
conditions to address the specific issues raised. In addition, Carvana has agreed to other
suggested condition amendments from the Village Board.

1 WHEREAS, Chapter 118, Article VIII, Section 118-175 of the Skokie Village Code
2 provides for the zoning requirements in the OR Office Research district; and
3 WHEREAS, Chapter 118, Appendix A Use Table, of the Skokie Village Code provides
4 for the listing of zoning uses in the Village of Skokie; and
5 WHEREAS, in Plan Commission Case 2021-24P, Carvana Co. petitioned the Village
6 of Skokie to amend the above sections of Chapter 118 of the Skokie Village Code by allowing
7 auto dealers and marine craft dealers as a restricted use, with certain conditions requiring that
8 all inventory be located within the building or within a parking space, and there would be no
9 auto repair or an outdoor intercom in the OR Office Research district; and
10 WHEREAS, this is a companion case to Plan Commission Case 2021-25P for site
11 plan approval; and
12 WHEREAS, at the Skokie Plan Commission public meeting duly held on November
13 18, 2021, for which proper legal notice had been achieved, at which many parties spoke and
14 over 100 emails were presented to the Plan Commission, and after hearing all testimony and
15 discussion, the Skokie Plan Commission voted to recommend to the Mayor and Board of
16 Trustees that Chapter 118, Article VIII, Section 118-175 and Appendix A Use Table of the
17 Skokie Village Code be amended accordingly; and
18 WHEREAS, at a public meeting duly held on February 7, 2022, the Plan Commission
19 recommended to the Mayor and Board of Trustees that Chapter 118, Article VIII, Section 118-
20 175, and Chapter 118, Appendix A Use Table of the Skokie Village Code be amended; and
21 WHEREAS, the Mayor and Board of Trustees at a public meeting duly held on

3 Sec. 118-175. OR Office Research district.
4 The OR Office Research district is established to allow the development of business and
5 professional offices, uses with "higher intensity", multifamily residences, and other compatible
6 uses in a planned park-like setting. The district is intended to serve the Village and the
7 surrounding urban region. Because of the unique character of properties located within this
8 district and its proximity to the Edens Expressway, the Old Orchard Interchange, Cook County
9 Forest Preserve and adjacent residential properties in other municipalities, all properties within
10 this district require site plan approval in accordance with Article II of this chapter. Relief from any
11 of the requirements of this district shall only be granted by the Mayor and Board of Trustees.
12 The petitioner shall have the burden of providing evidence and persuasion that any such relief is
13 necessary and desirable. Similarly granted relief to existing developments in the district shall not
14 be sufficient to base justification for approval upon an already existing development. Each
15 development shall be presented and judged on its own merits. The following requirements shall

23 WHEREAS, this is a companion case to 2021-24P, relating to an amendment to the
24 Skokie Village Code to allow Car Dealers and Marine Dealers in the OR Office Research

1 WHEREAS, the Subject Property was previously the site of the Rand McNally campus
2 and has now been proposed as a site for Carvana and its signature “Car Vending Machine”
3 tower. Included in the petition was a 134-foot car tower, as part of the car dealership; and
4 WHEREAS, the Skokie Plan Commission, at a public hearing duly held on November
5 18, 2021: (i) determined that proper legal notice had been achieved, (ii) made the appropriate
6 findings of fact in the affirmative, as required under Section 118-6(g) of the Skokie Village
7 Code, and (iii) voted to recommend to the Mayor and Board of Trustees that (a) the requested
8 site plan approval be granted subject to the conditions contained in the Staff Report dated,
9 November 18, 2021 and (b) relief be granted from Chapter 82, Section 82-28(b)(1)(a) and
10 Chapter 118, Section 118-175(3) & (4) of the Skokie Village Code; and
11 WHEREAS, subsequent to the Plan Commission Meeting on November 18, 2021, the
12 Chairman of the Plan Commission, brought the case back for a supplemental hearing on
13 January 6, 2022 to specifically address four (4) issues raised by one of the Commissioners on
14 November 18, 2021; and
15 WHEREAS, on January 6, 2022 the Plan Commission heard testimony and information
16 from a multitude of interested parties, Village staff and Carvana specifically on the following
17 issues: (a) Delivery truck route, (b) Delivery hours, (c) Sign and building lighting and (d) Bird
18 strike mitigation. As a result of the supplemental hearing, the Plan Commission voted to
19 amend their recommendation by revising and adding various conditions to address the specific
20 issues addressed; and
21 WHEREAS, the Mayor and Board of Trustees, at a public meeting duly held on
22 February 7, 2022, heard the report of the Plan Commission, comments from Carvana and from
23 many individuals; and
24 WHEREAS, several of the Trustees suggested amendments to the presented
25 conditions in the Plan Commission Report, dated February 7, 2022; including Carvana’s
26 cooperation in a bird strike mitigation study, a change in multi-vehicle haulers and turning off
27 the lights on the vending machine structure on all sides of the tower during spring and fall bird
28 migration seasons. Carvana agreed to the suggested amended conditions at the meeting.
29 After all comments were heard, the Mayor and Board of Trustees voted to concur in the
30 aforesaid recommendations and findings of fact of the Skokie Plan Commission, as amended.
31 NOW, THEREFORE, BE IT ORDAINED by the Mayor and Board of Trustees of the
32 Village of Skokie, Cook County, Illinois:
33 Section 1: That the site plan approval requested by Carvana Co. in conjunction with
34 the owner of the Subject Property, to construct and establish a car dealership at the property
35 legally described above and commonly known as 9801 Woods Drive (to be known as 9757
36 Woods Drive), Skokie in an OR Office Research district is hereby granted and approved
37 subject to each of the conditions set forth below:
38 1. Carvana shall develop the Subject Property in substantial conformance with the final
39 Village approved site plan dated December 17, 2021, and revised landscape plans
40 dated December 17, 2021 and floor plans dated September 14, 2021 and building
41 elevations dated July 13, 2021;

1 2. All light attributable to the Carvana building (internal and external) and site (signage),
2 including signage, shall not exceed 50% of that currently allowable under §42-35
3 (b)(17) (“Ordinance Standard”) from 11pm to 6am, as measured along lines defined
4 by the Ordinance Standard. In addition to achieving this standard, Carvana will
5 reduce the power output of the internal Vending Machine Tower lighting to 50% of
6 maximum output on the south, west and north elevations:
7 Ordinance Standard: 0.70 vertical fc, 0.30 horizontal fc,
8 Carvana 11 pm-6 am standard: 0.35 vertical fc, 0.15 horizontal fc;
9 3. During bird migration seasons, from March 15 to June 15 and August 15 to
10 November 15, building (internal and external) and sign lighting on the north, south
11 and west elevations shall be turned off between midnight and 7:00 am. Lighting on
12 the building (internal and external) on the east elevation shall also be turned off
13 during migration seasons between midnight and 7 am, but signage (channel letters
14 and logo signs) may remain illuminated. Any building or parking lot lighting required
15 for safety will remain illuminated;
16 4. Carvana shall install and maintain American Bird Conservancy-approved, 2” x 4”
17 patterned window markers to the exterior of all glass surfaces on the building up to
18 63’ 10” high, to reduce the potential for bird strikes;
19 5. Carvana shall participate in an independent research study, commissioned by the
20 Village of Skokie, for a period of at least one (1) year, which will include two
21 migratory seasons March 15 to June 15 and August 15 to November 15 and will
22 involve the monitoring and surveying of the number of bird strikes that take place on
23 the Carvana property and along the Harms Woods Forest Preserve. The purpose of
24 this study is to gain a further understanding of the dangers tall glass buildings
25 located near Harms Woods may pose to both native and migratory birds and to the
26 extent possible the study will also seek to measure the effectiveness of bird strike
27 mitigation strategies and provide information for future bird strike mitigation for the
28 Village of Skokie. Regardless of the findings, no further mitigation will be required
29 on the part of the petitioner beyond the measures set forth;
30 6. Multi-car hauler deliveries will only occur between the hours of 7:00 am and 10:00
31 pm Monday thru Friday and 8:00 am to 10:00 pm on Saturday. Truck engines will be
32 turned off during loading and unloading of vehicles;
33 7. The truck circulation route will utilize the northernmost driveway and drive aisle as
34 shown on site plan dated December 17, 2021. Two curb cuts will be made in the
35 raised pathway, at the north end of the site, to enable trucks to circulate behind the
36 vending machine structure for loading and unloading;
37 8. A Right-Turn-Only sign shall be posted at the exit requiring trucks to turn north onto
38 Woods Drive;
39 9. An outdoor intercom or speaker system is prohibited;
40 10. Carvana customer visits shall be primarily prearranged through appointments with
41 exceptions for customers dropping-off or returning vehicles;
42 11. Carvana hours of operation shall be restricted to 7:00 AM to 10:00 PM, Monday
43 through Saturday;
44 12. Prior to the release of building permits, Carvana shall provide a bond in the amount
45 of $200,000.00, to cover the cost of demolition and removal of materials for a period
46 of ten years, should demolition or removal be necessary if Carvana files for
47 Bankruptcy under Chapter 7 or 11 of the Bankruptcy Code and abandons the
48 building for two years. (The building shall not be considered abandoned so long as

1 real estate taxes and utilities are being paid, insurance is being carried, and periodic
2 inspections are being performed);
3 13. Prior to the issuance of building permits, the petitioner shall submit a temporary
4 pedestrian and bicycle circulation plan, including routing, signage, and barriers, to be
5 in place prior to the commencement of construction, subject to the approval of the
6 Engineering Division;
7 14. Prior to the issuance of building permits, the petitioner shall submit for approval a
8 lighting photometrics plan, fully developed civil engineering plans that comply with
9 the county WMO requirements and Village’s stormwater control provisions, and
10 redevelopment engineering plans to address all aspects of private and public utility
11 services. Any reconfigurations within state ROW will require an IDOT highway/utility
12 permit;
13 15. The petitioner agrees to participate in Condition #3 of Village Ordinance Number 15-
14 3-Z-4128, which requires the following: the dedication of right-of-way for a
15 northbound right turn lane and adjacent required sidewalks, as approved by the
16 Village, should there be any increase in building area or intensity of use, which
17 results in increased traffic generation beyond the current design capacity. Any such
18 increase shall be determined by the Village, pursuant to an appropriate traffic study;
19 16. All existing damaged public sidewalks or public sidewalks damaged due to the
20 implementation of this plan shall be replaced;
21 17. No objects are allowed within a 15’ sight distance triangle between 30” and 84” from
22 grade except traffic control devices listed in the Manual on Uniform Traffic Control
23 Devices;
24 18. All fencing, walls, sidewalks, driveways, curbs, wheel stops, parking areas, signage,
25 landscaping, structures, and any other facilities or infrastructure on the Subject
26 Property shall be maintained in a good state of repair, and when needed, be
27 repaired or replaced in a timely manner;
28 19. All private and public sidewalks shall be maintained free of snow, ice, sleet, or other
29 objects that may impede travel;
30 20. All off-street parking spaces shall be legibly striped and maintained;
31 21. Any plan to modify parking lot striping must be approved by the Director of
32 Engineering;
33 22. Vehicles shall not be allowed to be parked in or otherwise block common driveways,
34 sidewalks, aisles, or other points of access at any time, shall only be parked in
35 designated parking spaces, and shall not overlap the striped lines of designated
36 parking spaces;
37 23. All utilities on the Subject Property shall be placed or relocated underground. The
38 petitioner shall bear the full cost of any utility relocation and/or conflicts;
39 24. All new construction, alterations, and remodeling shall meet current International
40 Building and NFPA Life Safety Codes as amended;
41 25. The petitioner shall obtain all required permits and approvals for improvements to
42 County, State, or Federal rights-of-way from the governing jurisdiction;
43 26. The Subject Property must conform to the Village's storm water control requirements
44 as contained in the Skokie Village Code, including the disconnection of any
45 downspouts;
46 27. All signage shall conform to the Skokie Village Code, except as provided in this
47 ordinance. Any sign on the Subject Property that is in violation of that Code must be
48 removed or modified to conform with the Village Code prior to the issuance of an
49 occupancy permit;

1 28. All modifications to building elevations, signage, and landscaping shall be subject to
2 the review and approval of the Skokie Appearance Commission;
3 29. The petitioner shall submit to the Planning Division electronic files of the plat of
4 survey, site plan, and landscape plan in their approved and finalized form. The files
5 shall be scaled 2-dimensional drawing files on non-compressed, non-read only CD-
6 ROM *.dwg AutoCAD format.
7 30. Prior to the issuance of building permits, the petitioner shall submit to the Planning
8 Division of the Community Development Department the name, property address,
9 email address, and telephone number of the company and contact person
10 responsible for site maintenance in compliance with this site plan approval;
11 31. If work is to be performed on public property or if public property is utilized or
12 impacted during construction and/or development, the owner shall provide, or shall
13 cause the developer and/or contractor to provide, the Village of Skokie with a
14 certificate of insurance naming the Village of Skokie as additionally insured for any
15 and all claims related to any and all work. The owner shall hold and shall cause the
16 developer and/or contractor to hold, the Village of Skokie harmless and indemnify
17 the Village for any and all claims for property damage or personal injury related to
18 work on or use of public property;
19 32. Trash shall only be allowed within a designated trash enclosure and shall be
20 screened from public view in an enclosure. All trash shall be contained in such a way
21 as to remain out of sight at all times, except for waste receptacles referenced below;
22 33. Waste receptacles shall be placed on the Subject Property for the use of customers,
23 and that the Health Department shall determine the size, type, and location of these
24 units;
25 34. The petitioner shall comply with all Federal and State statutes, laws, rules and
26 regulations and all Village codes, ordinances, rules, and regulations; and
27 35. Failure to abide by any and all terms of this Ordinance shall be cause for the Village
28 to initiate hearings to determine whether the subject Ordinance, as well as any
29 applicable business licenses, should be revised or revoked. The petitioner shall pay
30 all costs related to any hearings conducted as a result of non-compliance with any of
31 the provisions of the enabling ordinance. The costs shall include but not be limited
32 to court reporter fees, attorney fees, and staff time required researching and
33 conducting said hearing.
34 Section 2: That relief is hereby granted from Chapter 82, Section 82-28(b)(1)(a) to
35 allow eight (8) wall signs on the building entrance.

37 Section 3: That continued relief is hereby granted from Chapter 118, Sections 118-
38 175(3)&(4) to continue to allow relief from rear and side yard requirements.

40 Section 4: That a notice of the approval of this Ordinance incorporating the
41 conditions contained herein shall be executed by the owner of the property in writing and
42 duly recorded with the Cook County Clerk’s Office at the owner’s expense.

PLAN COMMISSION ANALYSIS
During its February 3, 2022 meeting, the Plan Commission heard a request for site plan
amendment for a 4,447 square foot limited service restaurant with a drive-through and
outdoor seating. The restaurant is proposed on an outlot of the Touhy-Hamlin
development, which includes Buona Beef and Lurie Children’s Primary Care. The
original plan for the development included a 10,500 square foot retail building.
The proposed restaurant is required to have 45 parking spaces. The applicant proposes
32 spaces on-site with the remaining provided within an existing shared parking area
between the subject site and Buona Beef.
Discussion from the Commission included questions about drive-through stacking,
parking, and waste receptacles.
Relief for curb setbacks and wall signs was provided through the original approval for
the development are being carried forward through this amendment.
INTERESTED PARTIES
Legal notice was advertised, posted, and delivered to property owners in the area as
prescribed by the Zoning chapter of the Village Code. No interested parties provided
testimony at the hearing.
APPEARANCE COMMISSION
The proposed building elevations and landscape plan were reviewed and approved at
the December 8, 2022, Appearance Commission meeting.

RECOMMENDED SITE PLAN AMENDMENT CONDITIONS
1. The petitioner shall develop the Subject Property in substantial conformance with the final

including relief for curb setback and signage approved through Ordinance 19-5-Z-4459;
2. The petitioner acknowledges that shortages in parking caused by choices in the mix of tenants
on the site are a self-imposed hardship and shall not constitute justification for future parking
relief or variation;

16. The owner of the Subject Property and its tenants shall ensure that employees park on the
Subject Property;
17. No required parking space on the site may be for the exclusive use of any tenant;
18. Prior to issuance of building permits, the petitioner shall submit evidence of issuance of
permits for the construction and operation of the water main and associated equipment by
the Illinois Environmental Protection Agency (IEPA) or provide a determination by IEPA that
such permits are not required. Water mains that feed multiple building structures and/or
create a "looped" system that require an IEPA permit will also require an easement and
custodial agreement with the Village;
19. All overhead utilities on the Subject Property or in adjacent right-of-way shall be placed or
relocated underground. The petitioner shall bear the full cost of any utility relocation and/or
conflicts;
20. The petitioner shall sign an "Agreement for Installation and Maintenance of Landscaping" to
assure that the Subject Property and parkway landscaping is completed and maintained,
including trimming, watering, and replacing of dead plant materials in a timely manner in
accordance with the final approved landscape plan. A copy of said Agreement is attached
hereto, marked Exhibit “A” and hereby made part of this Ordinance. This “Agreement for
Installation and Maintenance of Landscaping" shall be recorded at the petitioner’s expense;
21. All new construction, alterations, and remodeling shall meet current International Building
and NFPA Life Safety Codes as amended;
22. The petitioner shall obtain all required permits and approvals for improvements to County,
State, or Federal rights-of-way from the governing jurisdiction;
23. The Subject Property must conform to the Village's storm water control requirements as
contained in the Skokie Village Code, including the disconnection of any downspouts;
24. All signage shall conform to the Skokie Village Code, except as provided in this ordinance.

The Skokie Plan Commission meeting was held electronically for the health and safety of all
participants. The chairman took roll call to confirm a quorum.
A motion to approve the minutes of the January 6, 2022 Plan Commission meeting was made
by Commissioner Franklin and seconded by Commissioner Gevaryahu. Approved by all with a

As these cases are related, they were discussed together but voted on separately.
Discussion and Interested Parties
Legal notice was advertised, posted, and delivered to all property owners within the area as
prescribed by the Zoning Chapter. Corporation Counsel determined that notice was proper and
correct.
Tim Hague of Skokie Development, LLC and Joe Vavrina of HR Green on behalf of Chick-Fil-A
presented the cases.
In 2019, Skokie Development, LLC received approval for a 4-lot planned development at Touhy
& Hamlin Avenues. Lot 1 became a Buona Restaurant with a drive-through, Lot 2 was reserved
for common parking and underground stormwater detention, Lot 3, the north building, is the
Lurie’s medical facility with parking and cross access to the Walmart site, and Lot 4 was a place-
holder for a multi-tenant building. They have entered into a contract to turn the vacant portion
of the site, Lot 4, into a Chick-Fil-A restaurant with a dual lane drive-through with parking at the
front.
Mr. Vavrina stated that with dining rooms closed due to COVID, restaurants looked to their
drive-through facilities as a necessary component to remain open for business. They have
initiated a new concept for the outer lane to serve their patrons. They can use it as a by-pass

lane, or for 3rd party pick-ups, or as an additional lane during peak lunch & dinner times to
avoid stacking problems. They will also use 4-6 team members outside to take orders and to
bring orders out to waiting vehicles.
Landscaping is the 1st thing people see, and it is important to promote a very inviting look. The
site will be well-landscaped with trees, shrubs, perennials and ornamental grasses.
A commissioner asked the size of the lot and ratio for parking spaces. Mr. Hague answered that
Lot 4, at approximately 4,500 sf, will have 32 parking spaces with the understanding that they
can utilize 8 of the 70 spaces in the shared lot. Since the development opened, the lots are
rarely full – there are in excess of 20 parking spaces.
The chairman inquired about hours of operation. The restaurant as well as drive-through will be
open from 6:30 am to 10 pm. The restaurant is closed on Sundays.
Another commissioner asked about the outdoor seating layout. The patio area is in front, west
and east of the front entry. There will be 20 seats; (5) 4-seat tables.
Staff requested that the reports be accepted into the record as written. The submitted site plan
was compared to the original from 2019 and shows no additional impact. Circulation and
stacking are adequate. The existing ordinance will be amended, and original items of relief
carried over to the new one.
A commissioner, addressing staff, wanting clarification that the conditions for trash receptacles
and the policing of the site for debris will encompass the common shared parking area as well.
Mr. Hague stated that Buona owns Lot 2 (the shared parking area) and therefore, has the
responsibility to maintain it. If the Village thinks that trash receptacles are needed, they can be
added.
There were no comments or concerns from the public.
Recommendations and Voting
There is one vacancy on the Commission.

STAFF REVIEW
All pertinent departments and divisions were offered an opportunity to comment on this
case. The following is a summary of principal aspects of the proposed development:
Comprehensive Plan
The Comprehensive Plan identifies this area as Manufacturing/Service Employment
which includes wide range of uses including food and beverage services. The proposed
limited service restaurant adheres to the Comprehensive Plan.
Land Use
The proposed land use is a limited service restaurant, which is a permitted use in the
B2 Commercial zoning district although the drive-through and outdoor dining require
special use permits.
Zoning Requirements
The proposed building and improvements adhere to minimum B2 Commercial zoning
district requirements. Bulk requirements include the following:
The proposed building height is 20 ft. 4 ½ in. The maximum building height for
buildings in the B2 district is 30 ft.
The minimum side yard setback is 6 ft, which are met. There are no other
setback requirements applicable to this request.
Relief for the 6 ft. parking setback was granted through the original ordinance
and will be carried forward through the amendment.
Building & Site Elements
The proposed building is single-story 4,447 square foot restaurant building with 32
parking spaces on-site. The building will be built on a vacant site of the Touhy-Hamlin
development along Touhy Avenue between two existing access drives.
Building Design
The Appearance Commission approved the building design at its December 8th
meeting.

Parking, Access, & Circulation
The parking required for the restaurant is 10 spaces for every 1,000 sf of floor area.
The total number of spaces required is 45 spaces. The applicant has 32 spaces on-site
and provide 13 spaces on the adjoining lot as part of the overall Touhy-Hamlin
development.
Complete Streets
The following table provides information regarding walkability and transit opportunities:
• A public sidewalk/multi-use path is available along Touhy Avenue. ADA ramps with
contrasting color tactile warning indicators are located at the nearest intersections to the
subject site.
• Bicycle accommodations include a multi-use path along Touhy, the Northshore Channel path
along McCormick Boulevard to the east, and a bike route along East Prairie Road to the
northwest.
• The subject site is served by Pace Bus Route 290, which stops just south of the subject site
and at the adjacent Graham’s on Touhy Avenue.
• Subject site is within walking distance of services, shopping, and Lincolnwood residential
neighborhoods.
• Emergency and business delivery access is available through the Touhy Marketplace
development from Touhy and Chase Avenues.
Stormwater Management
The applicant will be required to store surface runoff onsite as part of the Village’s and
the Metropolitan Water Reclamation District (MWRD) requirements for the site permit.
Water Conservation
The building is required to adhere to the Illinois Plumbing code. This includes the
incorporation of lower flow fixtures – faucets and toilets. This item will be reviewed at
the time of permit.
Electrical Conservation
The building is required to adhere to the Energy Conservation Code. This includes
meeting minimum standards for R-values for windows and insulation. The code
requires a minimum requirement for materials and wall thickness (in relation to
insulation) that meets energy efficiency standards. In addition, the HVAC systems are
required to meet minimum efficiency standards, and systems are required to be affixed
with UL tags. The applicant will be required to submit a “com check” at the time of
permit application to show adherence to the energy conservation code.

Tree Preservation & Landscaping
There are no existing trees onsite. The applicant is proposing to install 6 trees along
the site’s frontage and 9 evergreen trees to screen the dumpster enclosure. The
landscape plan also features planting areas along the front of the building and within
the parking lot.
STAFF RECOMMENDATIONS
Staff recommends that the petitioner’s request for site plan approval be APPROVED
based upon the Proposed Findings of Fact and subject to the recommended site plan
approval conditions listed below.
RECOMMENDED SITE PLAN APPROVAL CONDITIONS
1. The petitioner shall develop the Subject Property in substantial conformance with the final
Village approved amended site plans dated <date>, landscape plans dated <date>, ground
sign dated <date>, sign criteria dated <date>, and building elevations dated <date>
including relief for curb setback and signage approved through Ordinance 19-5-Z-4459;
2. The petitioner acknowledges that shortages in parking caused by choices in the mix of tenants
on the site are a self-imposed hardship and shall not constitute justification for future parking
relief or variation;
3. Prior to the issuance of building permits, the petitioner shall submit for approval a lighting
photometrics plan, fully developed civil engineering plans that comply with the county WMO
requirements and Village’s stormwater control provisions, and redevelopment engineering
plans to address all aspects of private and public utility services. Any reconfigurations within
state ROW will require an IDOT highway/utility permit;
4. New parking lot and exterior lighting shall meet Illuminating Engineering Society of North
America (IES) standards, be full cut-off design, and be directed away from adjacent
properties, subject to the approval of the Engineering Division;
5. All existing damaged public sidewalks or public sidewalks damaged due to the implementation
of this plan shall be replaced;
6. No objects are allowed within a 10' sight distance triangle in R1, R2, R3, and R4 districts, or
within a 15' sight distance triangle in all other districts, between 30" and 84" in height from
grade except traffic control devices listed in the Manual on Uniform Traffic Control Devices;
7. Prior to the issuance of building permits, the petitioner shall submit a temporary pedestrian,
bicycle, and transit circulation plan, including routing, signage, and barriers, to be in place
prior to the commencement of construction, subject to the approval of the Engineering
Division;
8. All fencing, walls, sidewalks, driveways, curbs, wheel stops, parking areas, signage,
landscaping, structures, and any other facilities or infrastructure on the Subject Property shall
be maintained in a good state of repair, and when needed, be repaired or replaced in a timely
manner;
9. All private and public sidewalks shall be maintained free of snow, ice, sleet, or other objects
that may impede travel;

10. Trash shall only be allowed within a designated trash enclosure and shall be screened from
public view in an enclosure approved by the Appearance Commission. All trash shall be
contained in such a way as to remain out of sight at all times, except for waste receptacles
referenced in Condition Number 11 below;
11. Waste receptacles shall be placed on the Subject Property for the use of customers, and that
the Health Department shall determine the size, type, and location of these units;
12. All off-street parking spaces shall be legibly striped and maintained;
13. Any plan to modify parking lot striping must be approved by the Director of Engineering;
14. The handicapped parking spaces shall be installed and maintained in compliance with State of
Illinois Accessibility Standards and the Skokie Village Code, including required signage;)

PLAN COMMISSION ANALYSIS
During its February 3, 2022, meeting, the Plan Commission heard a request for a special
use permit for a limited-service restaurant with a drive-through facility in a B2 Commercial
district at 3720 Touhy Avenue.
The proposal involves the construction of a 4,447 square foot Chick-Fil-A restaurant on an
outlot of the Touhy-Hamlin development, which includes Buona Beef and Lurie Children’s
Primary Care.
Discussion from the Commission included questions about drive-through stacking, parking,
and waste receptacles.
INTERESTED PARTIES
Legal notice was advertised, posted, and delivered to property owners in the area as
prescribed by the Zoning chapter of the Village Code. No interested parties provided
testimony at the hearing.
APPEARANCE COMMISSION
The proposed building elevations and landscape plan were reviewed and approved at the
December 8, 2022, Appearance Commission meeting.

1. The petitioner shall develop the Subject Property in substantial conformance with the
final Village approved site plan dated <insert date of final approved plan>, landscape

and that the Health Department shall determine the size, type, and location of these
units, including 1 waste receptacle near the drive-through exit and 1 waste receptacle
at the restaurant entrance.
7. At least once during every 4 hours of operation and before opening and closing of the
business, employees shall patrol the Subject Property and clear it of debris. (Standard)
8. All signage shall conform to the Skokie Village Code, except as provided in this
ordinance. Any sign on the Subject Property that is in violation of that Code must be
removed or modified to conform with the Village Code prior to the issuance of an

9. The petitioner shall implement any necessary operational improvements to ensure that
stacking of vehicles within the drive-through lane will be contained on-site and not

Draft Plan Commission Meeting Minutes
Date: February 3, 2022
The Skokie Plan Commission meeting was held electronically for the health and safety of all
participants. The chairman took roll call to confirm a quorum.
A motion to approve the minutes of the January 6, 2022 Plan Commission meeting was made
by Commissioner Franklin and seconded by Commissioner Gevaryahu. Approved by all with a
voice vote.

As these cases are related, they were discussed together but voted on separately.
Discussion and Interested Parties
Legal notice was advertised, posted, and delivered to all property owners within the area as
prescribed by the Zoning Chapter. Corporation Counsel determined that notice was proper and
correct.
Tim Hague of Skokie Development, LLC and Joe Vavrina of HR Green on behalf of Chick-Fil-A
presented the cases.
In 2019, Skokie Development, LLC received approval for a 4-lot planned development at Touhy
& Hamlin Avenues. Lot 1 became a Buona Restaurant with a drive-through, Lot 2 was reserved
for common parking and underground stormwater detention, Lot 3, the north building, is the
Lurie’s medical facility with parking and cross access to the Walmart site, and Lot 4 was a place-
holder for a multi-tenant building. They have entered into a contract to turn the vacant portion
of the site, Lot 4, into a Chick-Fil-A restaurant with a dual lane drive-through with parking at the
front.
Mr. Vavrina stated that with dining rooms closed due to COVID, restaurants looked to their
drive-through facilities as a necessary component to remain open for business. They have
initiated a new concept for the outer lane to serve their patrons. They can use it as a by-pass

lane, or for 3rd party pick-ups, or as an additional lane during peak lunch & dinner times to
avoid stacking problems. They will also use 4-6 team members outside to take orders and to
bring orders out to waiting vehicles.
Landscaping is the 1st thing people see, and it is important to promote a very inviting look. The
site will be well-landscaped with trees, shrubs, perennials and ornamental grasses.
A commissioner asked the size of the lot and ratio for parking spaces. Mr. Hague answered that
Lot 4, at approximately 4,500 sf, will have 32 parking spaces with the understanding that they
can utilize 8 of the 70 spaces in the shared lot. Since the development opened, the lots are
rarely full – there are in excess of 20 parking spaces.
The chairman inquired about hours of operation. The restaurant as well as drive-through will be
open from 6:30 am to 10 pm. The restaurant is closed on Sundays.
Another commissioner asked about the outdoor seating layout. The patio area is in front, west
and east of the front entry. There will be 20 seats; (5) 4-seat tables.
Staff requested that the reports be accepted into the record as written. The submitted site plan
was compared to the original from 2019 and shows no additional impact. Circulation and
stacking are adequate. The existing ordinance will be amended, and original items of relief
carried over to the new one.
A commissioner, addressing staff, wanting clarification that the conditions for trash receptacles
and the policing of the site for debris will encompass the common shared parking area as well.
Mr. Hague stated that Buona owns Lot 2 (the shared parking area) and therefore, has the
responsibility to maintain it. If the Village thinks that trash receptacles are needed, they can be
added.
There were no comments or concerns from the public.
Recommendations and Voting
There is one vacancy on the Commission.

A motion was made to approve the request to amend and further modify the existing site plan
approval ordinance for a Chick-Fil-A restaurant at 3720 Touhy Avenue to include trash
receptacles and debris monitoring in the shared parking lot (Lot 2).

As these cases are related, they were discussed together but voted on separately.
Discussion and Interested Parties
Legal notice was advertised, posted, and delivered to all property owners within the area as
prescribed by the Zoning Chapter. Corporation Counsel determined that notice was proper and
correct.
Tim Hague of Skokie Development, LLC and Joe Vavrina of HR Green on behalf of Chick-Fil-A
presented the cases.
In 2019, Skokie Development, LLC received approval for a 4-lot planned development at Touhy
& Hamlin Avenues. Lot 1 became a Buona Restaurant with a drive-through, Lot 2 was reserved
for common parking and underground stormwater detention, Lot 3, the north building, is the
Lurie’s medical facility with parking and cross access to the Walmart site, and Lot 4 was a place-
holder for a multi-tenant building. They have entered into a contract to turn the vacant portion
of the site, Lot 4, into a Chick-Fil-A restaurant with a dual lane drive-through with parking at the
front.
Mr. Vavrina stated that with dining rooms closed due to COVID, restaurants looked to their
drive-through facilities as a necessary component to remain open for business. They have
initiated a new concept for the outer lane to serve their patrons. They can use it as a by-pass

lane, or for 3rd party pick-ups, or as an additional lane during peak lunch & dinner times to
avoid stacking problems. They will also use 4-6 team members outside to take orders and to
bring orders out to waiting vehicles.
Landscaping is the 1st thing people see, and it is important to promote a very inviting look. The
site will be well-landscaped with trees, shrubs, perennials and ornamental grasses.
A commissioner asked the size of the lot and ratio for parking spaces. Mr. Hague answered that
Lot 4, at approximately 4,500 sf, will have 32 parking spaces with the understanding that they
can utilize 8 of the 70 spaces in the shared lot. Since the development opened, the lots are
rarely full – there are in excess of 20 parking spaces.
The chairman inquired about hours of operation. The restaurant as well as drive-through will be
open from 6:30 am to 10 pm. The restaurant is closed on Sundays.
Another commissioner asked about the outdoor seating layout. The patio area is in front, west
and east of the front entry. There will be 20 seats; (5) 4-seat tables.
Staff requested that the reports be accepted into the record as written. The submitted site plan
was compared to the original from 2019 and shows no additional impact. Circulation and
stacking are adequate. The existing ordinance will be amended, and original items of relief
carried over to the new one.
A commissioner, addressing staff, wanting clarification that the conditions for trash receptacles
and the policing of the site for debris will encompass the common shared parking area as well.
Mr. Hague stated that Buona owns Lot 2 (the shared parking area) and therefore, has the
responsibility to maintain it. If the Village thinks that trash receptacles are needed, they can be
added.
There were no comments or concerns from the public.

There is one vacancy on the Commission.

approval ordinance for a Chick-Fil-A restaurant at 3720 Touhy Avenue to include trash
receptacles and debris monitoring in the shared parking lot (Lot 2).

outdoor dining at 3720 Touhy Avenue in a B2 Commercial zoning. The proposal
includes 20 outdoor dining seats at the back of the building.

STAFF RECOMMENDATIONS
Staff recommends that the petitioner’s request for a special use permit for a limited-
service restaurant with outdoor dining at 3720 Touhy Avenue in a B2 Commercial
district be APPROVED, based upon the Proposed Positive Findings of Fact and subject
to the recommended conditions below.
RECOMMENDED SPECIAL USE PERMIT CONDITIONS
1. The petitioner shall operate and maintain the Subject Property in substantial
conformance with the outdoor dining plan in this report. (Standard)
2. The petitioner shall comply with all applicable conditions in the special use permit
and site plan approval ordinances for this site.
3. Any outdoor sound systems shall at all times maintain audio levels that are
compliant with the Skokie Village Code. (Standard)
4. Waste receptacles shall be placed on the Subject Property for the use of customers,
and that the Health and Human Services Department shall determine the size, type,
and location of these units, including 1 waste receptacle in the outdoor dining area
and 1 waste receptacle at the restaurant entrance. (Standard)
5. The use will comply with all standard conditions in Section 118-93(e) of the Skokie
Village Code for outdoor dining.
6. At least once during every 4 hours of operation and before opening and closing of
the business, employees shall patrol the Subject Property and clear it of debris.
