Mike Charley, Director of Health and Human Services gave an update on COVID-19 , Respiratory
Syncytial Virus (RSV) and the Flu. Skokie HHS will continue to promote equitable access to vaccination,
testing and treatment by maintaining communications and messaging to Skokie residents, schools, day
cares and healthcare providers.

Rabbi Ruebner and Eric Inbody requested that the Village of Skokie pass the Ordinance
fairly quickly requiring 85% of the owners to agree instead of the current 75%.The
Corporation Counsel has requested the opinion of the General Counsel for the Illinois Senate,
Giovanni Randazzo concerning the Village’s home rule authority
Plan Commission.
A. Plan Commission Case 2022-33P – Special Use Permit: 8256 Skokie Boulevard.
Motion to concur with the Plan Commission that the petitioner’s request for a special use permit
for religious assembly at 8256 Skokie Boulevard be approved subject to all conditions.

Comments, political mailers, signs on parkways, anti-Semitism, open democracy , accountability,
religious stereotypes, and name calling.
Andrew Tinkler spoke in support of Rabbi Ruebner and Eric Inbody on the condo deconversion
and increasing the threshold at Optima-Maple Tower
Tisha Ashcroft spoke about the south entrances by Niles West High School with the heavy traffic.
She mentioned the possibility of having a policeman directing traffic.

commented on Skokie's history from 1957 in which a referendum passed regarding the Council-
Manager form of government.

The 2022 Business of the Year campaign sponsored by the Consumer Affairs Commission has
concluded. The Commission received over 100 ballots nominating 44 different Skokie
businesses. The nomination process and online ballot form were promoted in NewSkokSe,
SkokieNewy, and on Village social media platforms, and hard copies were available at Village
Hall and the Skokie Farmers' Market.
The winner is Culver's ofSkokie, located at 9455 Skokie Blvd. The four runner-up winners are

A. COVID-19 Status.
Mike Charley, Director of Health and Human Services will provide a status of
COVID-19 considering the availability of the bivalent booster and the upcoming flu
season.
* B. Emergency Sewer Repair - DeVinci Construction Inc., Oak Brook, Illinois -
$48,595.
The Village of Skokie Public Works Department discovered that a 12-inch sewer
line on the 5100 block of Greenwood Street was roughly 85% blocked by a large
root mass. The root mass was removed, however upon further inspection, it was
determined that a sewer line failure is imminent. In the interest of public safety
and general welfare, Village staff enacted the Emergency Purchases Provision
and obtained three proposals for this repair from contractors that the Village has
successfully worked with previously. The lowest proposal was from DeVinci
Construction. The repair will be funded through the Capital Improvement Program,
Professional Services/Sewer line item. Per Section 2-1018 of the Skokie Village
Code, the Village Board is advised of this emergency repair.
* C. North Shore Center for the Performina Arts in Skokie Roof Top Unit (RTU)
HVAC Equipment Replacement - Stanton Mechanical, Elk Grove Village,
Illinois-$104,263.
The current Roof Top Unit #1 (RTU) HVAC system is one of seven units for the
North Shore Center for Performing Arts in Skokie (NSCPAS) and is over 25 years
aid and obsolete. The Fiscal Year 2023 Capital Improvement Program (CIP)
contains funding for the replacement of mechanical equipment at the NSCPAS.
This new unit complies with the Department of Energy's new 2023 minimum
efficiency standard which ensures the unit is 30% more energy efficient than
models manufactured prior to 2018. This reduction directly relates to a reduction
in carbon footprint.
The Village anticipates receipt of a State of Illinois grant to fund the project
referenced herein and other capital improvements. Staff recommends that a
contract for provision and installation of a new RTU and associated controls be

awarded to Stanton Mechanical in the amount of $104,263. I concur with staff's
recommendation and respectfully request Mayor and Board approval.
D. BS&A ERP Software Maintenance Contract Renewal ~ BS&A Systems, Bath,
Michigan -$66,821.
In FY2017, the Village of Skokie contracted with BS&A Systems for the licensing
and use of their Enterprise Resource Planning (ERP) software system. The
Village utilizes this software across the organization. An integral component to the
successful operation of the BS&A software is the support and maintenance
agreement, which provides for support and help desk services, as well as free
upgrades and fixes of any of the modules owned by the Village. I concur with
staff's recommendation to renew the contract with BS&A Systems in the amount
of $66,821 to continue the support and maintenance of the ERP software. Mayor
and Board approval is respectfully requested.

SUBJECT: COVID-19 and Other Seasonal Respiratory Illnesses on the Rise
On October 28, 2022, the Illinois Department of Public Health (IDPH) reported an increase in COVID-19
cases and an increase in other respiratory illnesses such as the flu and Respiratory Syncytial Virus (RSV).
Skokie HHS continues to encourage residents to get their bivalent COVID-19 vaccine and to get the
seasonal flu vaccine. Skokie HHS offers all Moderna COVID-19 vaccines and the flu vaccine to Skokie
residents at their Village Hall HHS clinic location. This memorandum provides updates on COVID-19 and
the other respiratory illnesses.
COVID-19 Update
The CDC released data on October 28 showing that 38 counties in Illinois are at an elevated community
level for COVID-19, up from 26 counties the previous week. Five counties were rated a “High” level and
33 were at “Medium”. The current CDC COVID-19 Community Level 1 for Cook County, IL is “Low”,
however IDPH is concerned that COVID-19 rates are increasing across Illinois and Cook County, which
may result in Cook County’s risk level increasing to “Medium” in the coming weeks. Skokie’s COVID-19
resident data has plateaued since the middle of September, with the 7-day moving average for cases
currently at 13.9 cases/day and the community transmission rate at 143 new cases per 100,000
residents (community transmission >100 is considered a “high” community transmission rate).
Skokie HHS continues to urge Skokie residents to get their COVID-19 bivalent booster shot, and flu shot,
in order to achieve maximum protection ahead of the holidays and the winter respiratory virus season.
As of today, 18% of eligible Skokie residents have received their bivalent COVID-19 booster (For
reference, the City of Chicago reported less than 15% of eligible Chicago residents have received their
bivalent dose). The new bivalent 2 COVID-19 booster shots are safe and almost all individuals 5 years
and older are eligible for the bivalent booster. The bivalent boosters are designed to offer added
protection from the now-dominant strains of the Omicron variant. IDPH data indicates that the risk of
hospitalization and severe outcomes from COVID-19 is much higher for unvaccinated people than for
those who are up to date on their vaccinations. Additional information and COVID-19 data can be found

Respiratory Syncytial Virus (RSV) & Flu
Illinois has seen a steady increase in emergency department visits and hospitalizations due to
respiratory infections (especially Respiratory Syncytial Virus (RSV)) in those under 18. The elevated visits
and hospitalizations are creating an acute shortage in pediatric intensive care unit (PICU) beds, directly
impacting the health system capacity heading into the fall/winter. RSV was discovered in 1956 and has
since been recognized as one of the most common causes of childhood illness. It causes annual

outbreaks of respiratory illnesses in all age groups. In most regions of the United States, RSV usually
circulates during fall, winter, and spring, but the timing and severity of RSV season in a given community
can vary from year to year. It most commonly causes a cold-like illness but can also cause lower
respiratory infections like bronchiolitis and pneumonia. One to two percent of children younger than 6
months of age with RSV infection may need to be hospitalized. Severe disease most commonly occurs in
very young infants. Currently there is no vaccine, however scientists are developing several vaccines,
monoclonal antibodies and antiviral therapies to help protect infants and young children, pregnant
women (to protect their unborn babies) and older adults from severe RSV infection.
The predominant flu variant is currently the H3N2 variant – which is covered by this year’s flu vaccine.
Season flu vaccine is currently available through the Skokie HHS Department by appointment. Skokie
residents can call 847-933-8252 to schedule an appointment. Skokie HHS’s annual community flu clinics
were an overwhelming success with over 1,000 individuals receiving their annual seasonal flu vaccine.
The Illinois Department of Public Health provides the following current recommendations to the public:
• Mask indoors in crowded areas, especially at large gatherings during the upcoming holiday
season, to prevent acquiring any infection, such as RSV, flu or COVID-19.
• Wear a mask if you develop any symptoms, such as a runny nose, cough, or fever.
• Cover your cough and sneezes and stay home until you are feeling better or fever free for at
least 24 hours without needing fever reducing medications.
• During holiday parties or communal dining, make sure to frequently wash one’s hands with soap
and water or use alcohol-based hand sanitizer and avoid touching utensils that are frequently
handled by others.
• Whenever possible, maximize indoor ventilation and air circulation.
• Get vaccinated for the flu and get up to date on the COVID-19 vaccine as soon as possible.
• If your child is 6 months or older they may qualify for Synagis, a medicine that helps babies get
virus fighting antibodies to prevent RSV.
Skokie HHS will continue to promote equitable access to vaccination, testing and treatment by
maintaining communications and messaging to Skokie residents, businesses, schools, day cares and
healthcare providers. Skokie HHS continues to recommend residents stay up-to-date with their COVID-
19, flu and other required vaccinations.
1 COVID-19 Community Levels help individuals and communities decide which prevention actions to take based on the latest
information. Each level helps convey how much COVID-19 is impacting your community using data on hospitalizations and
cases. Using these data, communities are classified as low, medium, or high. For each level, CDC recommends actions you can
take to help you protect yourself and others from severe impacts of COVID-19 such as staying up-to-date with COVID-19
vaccines, getting tested if you have symptoms, isolating if you test positive, wearing a face covering when out in public and if
you are at high-risk of getting very sick to consider avoiding non-essential indoor activities in public where you could be
exposed.
2 The CDC authorized two new bivalent booster vaccines on September 1 that include an mRNA component of the original
strain to provide an immune response that is broadly protective against COVID-19 and an added mRNA component in common
between the omicron variant BA.4 and BA.5 lineages to provide better protection against COVID-19 caused by the omicron
variant. Initially, the Moderna COVID-19 Vaccine, Bivalent, was authorized for use as a single booster dose in individuals 18
years of age and older and the Pfizer-BioNTech COVID-19 Vaccine, Bivalent, was authorized for use as a single booster dose in
individuals 12 years of age and older. On October 12, the CDC authorized the updated COVID-19 vaccines from Pfizer-BioNTech
for children ages 5 through 11 years, and from Moderna for children and adolescents ages 6 through 17 years.

SUBJECT: EMERGENCY SEWER REPAIR - (Agenda Item)
While perfoi'ming a routine televised inspection of the twelve inch main sewer line located on the 5100
block of Greenwood St., Public Works stajff discovered a large root mass blocking roughly 85% of the
line. The root mass was removed, and the line was re-televised. Upon further inspection it was
discovered that the integrity of the sewer line was severely compromised in two separate locations and
that sewer line failure was imminent. A failure of this sewer main would cause several upstream
properties to be at risk of basement flooding. The scope of the repair requires specialized equipment
that Public Works cannot provide. In the interest of public safety and general welfare, Village staff
enacted the Emergency Purchases Provision and obtained three proposals for this repair from
Contractors that the Village has successfully worked with previously. The lowest proposal was from
DeVinci Construction Inc., in the amount of $48,595. The work includes traffic control, pavement
removal, excavation, replacement of approximately sixty feet of pipe, reconnection of sewer pipes,
backfilling and pavement repair.
Per Skokie Village Code requirements, staff is hereby requesting that the Village Board is advised
of this emergency procurement. Repairs will commence on November 7 and will be funded
through the Capital Improvement Program, Professional Services/Sewer line item, 020-6000-
403.03-20-OR460S1.

Roof Top Unit (RTU) HVAC Equipment Replacement - (Agenda Item)
Background:
The FY23 Capital Improvement Program (CIP) contains funding for the replacement of
mechanical equipment at the NSCPA. The Village is anticipating the receipt of a State of
Illinois grant to fund the project referenced herein and other capital improvements.
The current RTU#1 is one of seven air handling units that provides heating and cooling to
multiple areas of the NSCPA. The unit is over 25 years old and is at the end of its useful
life. It can no longer be programmed as it only functions manually, and it can no longer
be repaired.
Proposals for the replacement ofRTU#l were publicly solicited, and as a result two
responses were received.
Tabulation:

Murphy & Miller Inc., Chicago, IL. $117,700.00
Recommendation:
It is recommended that a contract for provision and installation of a new RTU and
associated controls be awarded to Stanton Mechanical in the amount of $104,263. The
Village has worked successfully with Stanton Mechanical on numerous HVAC projects.
Comments:
Stanton Mechanical will remove the existing York RTU and replace it with a new Trane
25-ton capacity unit. Stanton will provide the crane for removal/installment, make the
roof modifications necessary to accommodate the new unit, provide all the necessary
hardware and connections and install a new programmable Pelican control system that
will control the new unit as well as the existing six units at the NSCPA facility.

Background
In Fiscal Year 2017, the Village contracted with BS&A Systems for the licensing and use of their
ERP System. This system includes modules for General Ledger, Accounts Payable, Purchasing,
Miscellaneous Receivables, Cash Receipts, Fixed Assets, Building and Planning, Human
Resources, Time Sheets, Payroll, Utility Billing, Business Licensing, Animal Licensing, Citizen
Request, and Work Orders.
The software maintenance contract for these various modules ofBS&A's software is up for
renewal. In that regard, it is necessary to renew the contract to provide for uninterrupted support
of the BS&A software applications used by the Village.
Budget & Account: $88,200.00 020-6000-403.03-20-OR31003
Recommendation:
It is recommended that a contract be awarded to BS&A, Bath Michigan, for support and
maintenance ofBS&A ERP software, in the amount of $66,821.00.
Comments:
BS&A provides the Village with computer software used across the organization. An integral
component to the successful operation of the BS&A software is the support and maintenance
agreement, which provides for support and help desk services, as well as free upgrades and
"fixes" of any of the modules owned by the Village. Since all the software is provided and
maintained by BS&A, this contract is a sole source procurement.

built in two phases, that will contain 30,300 SF of commercial across the ground floor and
494 residential units on the upper 6 floors of the 7-story building. In Phase 1 a 5,100 SF
commercial space, which will be marketed for cannabis sales, will be constructed facing
Under Avenue. The required parking for the overall development is 898 parking spaces
(741 Residential + 157 commercial) and 980 parking spaces are proposed.
Additionally, this ordinance grants relief from the following sections of the Skokie Village
Code;

29 anticipate will be generated by the constant noise and displeasing view to the north; and

31 WHEREAS, the Skokie Plan Commission, after hearing all testimony went on to: (i) make
32 the appropriate findings of fact in the affirmative, as required under Section 11 8-6(g) of the Skokie
33 Village Code, and (ii) voted to recommend to the Mayor and Board of Trustees that (a) the
34 requested site plan approval be granted subject to the conditions contained in the Plan
35 Commission Report dated September 19, 2022, and (b) relief be granted from Chapter 118,

14 the county WMO requirements and Village's stormwater control provisions, and
15 redevelopment engineering plans to address all aspects of private and public utility
ie services. Any reconfigurations within state ROWwil! require an IDOT highway/utility
17 permit;

19 b. A temporary pedestrian, bicycle, and transit circulation plan for the public right-of-
20 way, including routing, signage, and barriers, to be in place prior to the
21 commencement of construction, subject to the approval of the Engineering Division.
22 If during construction any lane closures or sidewalk closures are intended in the
23 public right-of-way, the owner/contractor must apply for Public Way Obstruction or
24 Use permit with Engineering. The application may be obtained with engineering or
25 on Village website. Traffic control plan and fees will apply,
26
27 c. Evidence of issuance of permits for the construction and operation of the private
28 looped water main identified in the water supply/sewer capacity study conducted by
29 Crawford, Murphy & Tilly, Ince and dated August 1, 2022m and associated
30 equipment by the IIUnois Environmental Protection Agency (IEPA) or provide a
31 determination by IEPA that such permits are not required. Water mains that feed
32 multiple building structures and/or create a "looped" system that require an IEPA
33 permit will also require an easement and custodial agreement with the Village,
34 d. A plat of subdivision/dedication mylar,
35 e. To the Planning Division of the Community Development Department the name,
36 property address, email address, and telephone number of the company and contact
37 person responsible for site maintenance in compliance with this site plan approval;
38 3. Site plan and roadway modifications shall be made in compliance with the letter from
39 the Illinois Department of Transportation, dated August 29, 2022, providing
40 comments on the Traffic Impact Study and Preliminary Site Plan. Further
41 modifications shall be made to comply with the final permit comments from IDOT;

43 4. Prior to commencement of construction for Phase 2, a shared parking agreement
44 approved by the Village indicating 355 Phase 1 residential parking spaces and 379
45 Phase 2 residential parking spaces, for a total of 734 residential parking spaces;
46
47 5. Capacity increases or changes to the amounts cited in the water supply/sewer
48 capacity study, previously approved by the Village must be submitted for review and

1 approved by the Village. All design and installation costs for any on-site
2 infrastructure improvements are to be borne by the developer;
3 6. In the event that traffic delays increase at the Touhy/Linder Avenue intersection due
4 to the operation and traffic generated by the subject development, the Engineering
5 Division may require the developer to hire a traffic consultant to review the
6 intersection and make modifications;
7 7. The proposed development shall have a maximum commercial gross floor area of
8 30,300 SF and 494 residential units;
9 8. The developer shall submit to Pace Bus plans to review and approve the proposed
10 bus stop relocation. A concrete pad and other improvements, such as a bus shelter
n and other bus-related amenities, may be required for both eastbound and westbound
12 StOpS;
13 9. New parking lot and exterior lighting shall meet Illuminating Engineering Society of
14 North America (IES) standards, be full cut-off design, and be directed away from
15 adjacent properties, subject to the approval of the Engineering Division;
16 10. Any outdoor sound systems shal! at al! times maintain audio levels that are compliant
17 with the Skokie Village Code;
is 11. A!! existing damaged public sidewalks or public sidewalks damaged due to the
19 implementation of this plan shall be replaced;
20 12. No objects are allowed within a 15' sight distance triangle between 30" and 84" in
21 height from grade except traffic contra! devices listed in the Manual on Uniform
22 Traffic Control Devices;
23 13. Provide Stop bar and R-1 signs at the exits of the parking lots at Under;
24 14. Al! fencing, walls, sidewalks, driveways, curbs, wheel stops, parking areas, signage,
25 landscaping, structures, and any other facilities or infrastructure on the Subject
26 Property shall be maintained In a good state of repair, and when needed, be repaired
27 or replaced in a timely manner;
28 15. All private and public sidewalks shall be maintained free of snow, ice, sleet, or other
29 objects that may impede travel;
30 16. Trash shall only be allowed within a designated trash enclosure and shall be
31 screened from public view in an enclosure approved by the Appearance
32 Commission. All trash shall be contained in such a way as to remain out of sight at
33 all times, except for waste receptacles referenced in Condition Number 17 below;
34 17. Waste receptacles shall be placed on the Subject Property for the use of customers,
35 and the Health and Human Services Department shall determine the size, type, and
36 location of these units where food is sold;
37 18. All off-street parking spaces shall be legibly striped and maintained;
38 19. Any plan to modify parking lot striping must be approved by the Director of
39 Engineering;
40 20. The development shall have a minimum of 898 off-street vehicle parking spaces
41 including handicapped parking spaces at a rate of 2% of the total parking
42 requirement, and a minimum of 119 bicycle parking spaces;

1 21. The handicapped parking spaces shall be installed and maintained in compliance
2 with State of illinois Accessibility Standards and the Skokie Village Code, including
3 required signage;
4 22. Vehicles shall not be allowed to be parked in or otherwise block common driveways,
5 sidewalks, aisles, or other points of access at any time, shall only be parked in
6 designated parking spaces, and shall not overlap the striped lines of designated
7 parking spaces;
8 23. The owner and tenants of the Subject Property, shaf! ensure that employees park on
9 the Subject Property;
io 24. All parking areas must be paved, drained, curbed, and landscaped to Village
n standards;
12 25. Upon the adoption of the ordinance by the Board of Trustees, the mylar of the
13 subdtvision/dedication must be submitted to the Village with all signatures other than
14 Village staff or officials;
15 26. The developer shall provide the area designated on the approved site plan for a
16 street-level courtyard for public use;
17 27. All cable providers shal! be given access to provide service. All cable and other
is fixtures necessary to provide service to the building shall be placed underground and
19 conduit shall be provided inside the building for wiring;
20 28. A water main loop, as identified in the water supply/sewer capacity study dated
21 August 1, 2022, shall be provided. !t will be private, and a custodial agreement and
22 an IEPA permit required for the water main construction must be entered into with
23 the Village governing the repair, maintenance, operation, etc. of the private water
24 main;
25 29. Ail overhead utilities on the Subject Property shall be placed or relocated
26 underground. The petitioner shall bear the full cost of any utility relocation and/or
27 conflicts;
28 30. The petitioner shall sign an "Agreement for Installation and Maintenance of
29 Landscaping" to assure that the Subject Property and parkway landscaping is
30 completed and maintained, including trimming, watering, and replacing of dead plant
31 materials in a timely manner in accordance with the final approved landscape plan.
32 A copy of said Agreement is attached hereto, marked Exhibit "A" and hereby made
33 part of this Ordinance. This "Agreement for Installation and Maintenance of
34 Landscaping" shall be recorded at the petitioner's expense;
35 31. All new construction, alterations, and remodeling shall meet current International
36 Building and NFPA Life Safety Codes as amended;
37 32. The petitioner shall obtain ail required permits and approvals for improvements to
38 County, State, or Federal rights-of-way from the governing jurisdiction;
39 33. The Subject Property must conform to the Village's storm water control requirements
40 as contained in the Skokie Village Code, including the disconnection of any
41 downspouts. Project needs a ful! WMP permitting process from MWRD. The Village
42 to endorse such application as the Permittee only after local requirements from
43 §118-64 are met;

1 34. All signage shall conform to the Skokie Village Code. Any sign on the Subject
2 Property that is in violation of that Code must be removed or modified to conform
3 with the Village Code prior to the issuance of an occupancy permit;
4 35. All modifications to building elevations, signage, and landscaping shall be subject to
5 the review and approval of the Skokie Appearance Commission;
6 36. The petitioner shall submit to the Planning Division electronic files of the site plan
7 and landscape plan in their approved and finalized form;
s 37. If work is to be performed on public property or if public property is utilized or
9 impacted during construction and/or development, the owner shall provide, or shall
10 cause the developer and/or contractor to provide, the Village of Skokie with a
n certificate of insurance naming the Village of Skokie as additionally insured for any
12 and ail claims related to any and all work. The owner shall ho!d, and shall cause the
13 developer and/or contractor to hold. the Village of Skokie harmless and indemnify the
14 Village for any and all claims for property damage or personal injury related to work
15 on or use of public property;
16 38. if any of the commercial and/or residential units become owner-occupied, a
17 Condominium Owners Association shall be established to govern the site that, at
18 minimum, regulates the maintenance of the land, sidewalks, driveways, guest
19 parking areas, trash/recycle/compost collection, landscaping, and the exteriors of the
20 buildings, including snow and ice removal, water and sewer maintenance (including
21 valve vaults, shut-off valves, and water service(s) connected to the water main),
22 sanitary and storm sewer maintenance (including the junction and connection(s) to
23 the public sewer to the property line and beyond), providing adequate space for
24 emergency response services to set up and operate equipment, and 74 exterior
25 parking spaces shall be reserved for residential guests and not be solely used for the
26 residents' personal parking needs;
27 39. A screened garbage corral with an impermeable surface shall be provided to contain
28 ail dumpsters;
29 40. No tables or eating counters shall be allowed at food establishments. The addition of
30 tables or eating counters shali constitute the addition of a food service use at that
31 location, and all additional regulations for that food service use shall apply;
32 41. At least once during every 4 hours of operation and before opening and closing of
33 the business, employees shall patrol the Subject Property and clear it of debris;
34 42. The sale of open alcoholic beverages at carryout restaurants is prohibited;
35 43. The owner of every occupied commercial premises used for the sale of packaged or
36 prepared food and the sale of automotive products shall supply at least one
37 approved covered container for litter at the main entrance to the premises for use by
38 customers. The owner of the premises shall be responsible for the removal of litter
39 every four hours;
40 44. Barriers, fencing, landscaping, and other features shall be utilized to define the
41 outdoor dining area;
42 45. Hours of operation for the outdoor dining shall be limited to between 8:00 AM and
43 10:00 PM, but not longer than the posted operational hours of the associated food
44 service faciUty, if the facility opens later and/or doses earlier than these hours;

1 Dates of operation for outdoor dining shall be limited to between April 1 and October
2 31 in a calendar year;
3 47. The outdoor dining area shall be exempt from the parking regulations if used or set
4 up iess than 7 months in a calendar year;
5 48. All food preparation must take place inside the associated food service
6 establishment;
7 49. Adequate refuse disposal shali exist as determined by the Health Department;
8 50. Advertising or promotional features shall be limited to umbrellas or canopies;
9 51. A!! applicable village and state health requirements shall be met;
10 52. Dining areas will be reviewed each year during the annual restaurant inspection. The
11 outdoor dining permit may be revoked by the Village Manager at any time on 14
12 days' notice for failure to comply with the regulations set forth in this subsection;
13 53. The outdoor dining area shall not be enclosed on more than two sides with walls if
14 roofed over;
15 54. The outdoor dining area must be located on a surface approved by the Village
16 Manager or designee;
17 55. The outdoor dining area shall not be located in a required parking space or block a
18 public sidewalk;
19 56. The outdoor dining shall be on the same lot or within a development that received
20 site plan approval as its associated food service establishment; and
21 63. An outdoor dining area shall not be located within a 15-foot sight distance triangle or
22 within 3' from any public alley.
23 57. The petitioner shall comply with all Federal and State statutes, laws, rules and
24 regulations and all Village codes, ordinances, rules, and regulations;
25 58. Failure to abide by any and all terms of this Ordinance shall be cause for the Village
26 to initiate hearings to determine whether the subject Ordinance, as well as any
27 applicable business licenses, should be revised or revoked. The petitioner shall pay
28 all costs related to any hearings conducted as a result of non-compliance with any of
29 the provisions of the enabling ordinance. The costs shall include but not be limited to
30 court reporter fees, attorney fees, and staff time required researching and conducting
31 said hearing;

Occupancy Permit, Business License, Site Plan Approval or Special Use Permit

and maintain landscaping in accordance with the plan dated
or as it may be subsequentty revised with the approval of the Viffage Manager, or
designee, and the Corporation Counsel.
3. The parties to this Agreement recognize that the installation and maintenance of
landscaping is an integral part of the PROPERTY OWNER'S pian for devetopmenf
and/or use of th& property an<I is necessary to carry out the purpose and intent of the
VILLAGE'S land use objectives, and that the pennit would not have been approved

by the VILLAGE without the assurance that this Agreement would be executed by
the PROPERTY OWNER.
4. The purpose of this Agreement is to assure;
(a) installation of the iandscaping in accordance with the landscaping plan
approved by tfte VILLAGE, antil
(b) continued maintenance and care of the landscaping, ineluding any
landscaping indicated in the parkway area.
5. The property, which is the suDject matter of this Agreement, is legally described
above. The portions of the Subject Property which are to be landscaped and
maintained pursuant to the terms and conditions of this Agreement are indicated on
the landscape Plan attached hereto, marked Exhort "1" and are hereby made a part
of this Agreement.
6. PROPERTY OWNER agrees that the installation and maintenance of the
landscaping which is required in accordance with the permit issued by the VILLAGE
and this Agreement v/iil materially benefit the Subject Property. Such landscaping is
necessary in order for the PROPERTY OWNER to compty with the conditions of the
permit issued or granted by the VILLAGE for the PROPERTY OWNER'S requested
development or use of the property.
7. PROPERTY OWNER shall diligently maintain and care for the landscaping which is
installed and required by the permit and this Agreement, using generally accepted
methods of cultivation and v/atering The PROPERTY OWNER shall maintain a
standard of care necessary to prevent the landscaping from deteriorating to the
extent that its value as landscaping is destroyed. If Exhibit *1t", attached hereto or
permit specifies maintenance standards or procedures, such procedures are hereby
adopted as part of this Agreement; and by such adoption, become enforcement
conditions of this Agreement.
S, Failure to maintain the iandscapmg as required by this Agreement shall be a
nuisance. In the event the PROPERTY OWNER fails to meet the standard of
maintenance necessary to keep the landscaping in a healthy condition as required
by this Agreement, the VILLAGE shall give written notice of the deficiency to the
PROPERTY OWNER who shall have 20 days to make the necessary correctkm or
replacement. If such correction or replacement is not made within the aforesaid 20-
cEay period, the VILLAGE may elect to abate the nuisance and take necessary action
to assure that ttie landscaping is replaced and/or matntained. In the event, ttie
VttLAGE so elects; the VILLAGE shall serve notice of its InSent to enter the
premises for this purpose. The VILLAGE shall either personally serve the notice
upon the PROPERTY OWNER or mait a copy of It by certified mail to the
PROPERTY OWNER'S fast known address. or as shown on the tax rolls, at least 15
days in advance of the date when the VILLAGE or its agent intends to enter 8ie
premises.
9. For this purpose, the VILLAGE or its agent may enter upon the property and pefform
such work as H considers reasonably necessary and proper to restore, maintain, or
replace the landscaping required by this Agreement. The VltLAGE may act either
through its own employees or throush an independent contractor.

10. The VILLAGE shall be entitled to reimbursement for abating the nuisance in
restoring, maintaining or replacing the landscaping, provided ihat the VILLAGE
follows the procedures set forth in this Agreement. Costs shall inciude but shaft not
be iimiled to actual costs incurred by the VILLAGE and adminisfrative costs. The
VILLAGE shall make demand upon the PROPERTY OWNER for payment If the
PROPERTY OWNER fails to pay the costs within 30 days of the date on which
demand is made, the VILLAGE may cause a lien to be placed on the Subject
Property, The VILLAGE may record a notice wfth the Recorder of Deeds for Cook
County stating that it has incurred expenses under the terms this Landscape
Agreement. The VILLAGE shall be entitled to collect interest at the statutory rate on
the amount ov/ed.
11. tn addition to havwig a lien placed on the Subset Property, (he VILLAGE may
institute a legal action to coSect the amouRi owed. The PROPERTY OWNER agrees
to pay the VILLAGE a reasonable sum for attorney's fees and court costs.
12. If either party upon the execution of this Agreement or during the course of
performance consKters that H is Recessary to have the PROPERTY OWNER post
additional security to guarantee the performance of his obligations hereunder, the
VILLAGE may require the PROPERTY OWNER to post additional security. The
VILLAGE may require either a cash deposit or a surety bond guaranteeing
performance in a form signed by sureties satisfactory to the VILLAGE. The
condition o? the security shall be that if the PROPERTY OWNER fails to perform any
obligation under this Agreement, the VILLAGE may, act on behatf of the
PROPERTY OWNER and use the proceeds of the cash bond, or in the case of a
surety isond, require the securities to perform the obiigations of this Agreemeftt.
13. The PROPERTY OWNER hereby agrees to indemnify and hold harmless the
VILLAGE, its trustees, officials, employees and agents for any costs, claims, actions
or causes of action for personal injury, property damage or otherwise, includtn®
reasonable attorney's fees, which may anse from the VILLAGE exercising any of its
rights or obtigations and performance under this Agreement.
14. AH notices required or to be given pursuant hereto shall be in writing and either
delivered personally or by a nationaBy recognized "over-night" courier service or
mailed by United States certifred or registered maif, postage prepaid, addressed to

1 WHEREAS, included in the subdivision is the dedication of a strip of property, mostly 10
2 feet in width and 612.16 feet in length, and approximately 7,021 sq ft which abuts Under
3 Avenue to the west and Touhy Avenue to the South in order widen the public right of way.
4 There shall be no compensation shall be paid from the Village for this dedication; and
5 WHEREAS, the Skokie Plan Commission, after public hearing duly held August 4,
6 2022 made appropriate findings of fact, as required under Section 118-6 of the Skokie
7 Village Code. and recommended to the Mayor and Board of Trustees that the requested
s subdivision with a dedication of land be granted subject to various conditions; and
9 WHEREAS, the Mayor and Board of Trustees, at a public meeting duly held on
10 September 19, 2022 concurred in the aforesaid recommendation of the Skokie P!an
n Commission:
12 NOW, THEREFORE, BE IT ORDAINED by the Mayor and Board of Trustees of the
13 Village of Skokie, Cook County, Illinois:
14 Section 1: That the above stated Recitals are restated and incorporated as if
15 stated in full.
16 Section 2: That the subdivision with a dedication of land of the Subject Property,
17 legally described above and commonly known as 5404-5440 Touhy Avenue and 7235
is Under Avenue, Skokie, Illinois, in a B4 Regional Mixed-Use Shopping district as depicted
19 on the "Touhy-Linder Subdivision" Plat dated September 14, 2022, be approved subject to
20 the following conditions:
21 I. The property must be subdivided pursuant to the "Touhy-Linder Subdivision"
22 Plat dated September 14, 2022 and subsequently revised October 18,2022,
23 and as may be further revised with the approval of the Village Manager/ or'
24 designee/ and Corporation Counsel. Minor modifications will need to be made
25 to the plat prior the adoption of the ordinance to allow its recording.
26 2. The petitioner must submit to the Planning Division electronic files of the plat
27 of subdivision/consolidation/dedication in approved and finalized form. The
28 files must be scaled drawing files and be formatted to SPCS/ NAD83, HARN
29 2007/ with SPCS north being straight up, and the primary units in U.S. Survey
30 Feet. Alt elements must be contained within a single file/ no XREF or PDF
31 attachment files shall be used.
32 3. Prior to the hearing of this case before the Board of Trustees/ copies of alt
33 existing/ revised/ and new easements/ covenants/ conditions/ and restrictions
34 that are associated with this subdivision plat shal! be provided to the Village
35 Manager or designee. The documents shall retain the language for ingress
36 and egress of all lots and any restrictions to shared parking as provided in the
37 Skokie Village Code.
38 4. Upon the passage of the ordinance by the Board of Trustees, the Mylar of the
39 Subdivision must be submitted to the Village with all signatures other than
40 Village staff or elected officials.

Subject: Update: Optima Condominium hflaple Tower Deconversion
At the Skokie Village Board Meeting of September 19, 2022, there was discussion
concerning the specific real estate transactions and anticipated Condominium Board
actions at the Optima Condominium Maple Tower, which would result in the deconversion
and forced sale from individual condominium ownership to a single owner rental building
(hereinafter "Contemplated Maple Deconversion"). During the following Board Meetings
in October, the Board heard from three groups of interested parties who will be impacted
by the Contemplated Maple Deconversion. This included a few condominium owners from
the Maple Tower who object to any deconversion of the Maple Tower, a few condominium
owners from the Maple Tower who are interested in the Contemplated Maple
Deconversion and the representative of the Maple Tower Condo Board Association.
Since the September Village Board meeting when it was requested that the Village
Manager and the Corporation Counsel examine the issue and recommend possible action
for the Board, we have:
1. Met with other municipal legal departments where home rule deconversion
legislation was considered;
2. Undertaken legal research of Illinois Court decisions concerning deconversion;
3. Canvassed other states and municipalities throughout the country to catalogue
deconversion standards; and
4. Sent a letter to the Illinois Attorney General's office for an opinion whether home
rule authority could be used to augment 765 ILCS 605/15.
As a follow-up, the Corporation Counsel asked the Village's State legislators to contact
the Attorney General's office to expedite a response. Ashley Wright Hokenson, Chief of
Legal Affairs for the Attorney General's Office responded to our office that the Attorney
General's Office would not render an opinion letter as a matter of policy. Ms Wright
recommended that the Village of Skokie contact the Cook County State's Attorney's
Office for the opinion we sought. We contacted the State's Attorney's Office through our
County Commissioner and learned that it would not provide an opinion concerning a
question of home rule legislative authority on a State of Illinois statute. Finally, the

Corporation Counsel has requested the opinion of the General Counsel for the Illinois
Senate, Giovanni Randazzo concerning the Village's home rule authority. We are waiting
for this response. We will contact the General Counsel's office if we do not hear back in
the coming weeks.
In the meantime, working with the Village Manager's Office, the following pertinent
information is available:
• 23 States have a deconversion statute requiring 80% of the owners to agree.
• 2 States (induding Illinois) have a deconversion statute requiring 75% of the
owners to agree.
• 9 States have a deconversion statute requiring 100% of the owners to agree.
• The only municipality in the entire country that can be found to have its own
deconversion law is Chicago.
Our State Senators and our State Representative have informed us through staff, that
individuals have contacted them concerning the Contemplated Maple Deconversion.
They have directed the individuals to the appropriate State committee which would
consider new deconversion legislation and provided contact information for the committee
chairs. Of course, such legislative action could not be taken up until the spring legislative
session. In this regard, it is notable that the Illinois General Assembly enacted revisions
to the Condominium Property Act in 2018 which were in response to disputes between
condominium owners and their condominium associations concerning the imposition of
unfair sales in some cases. At that time, the State Legislature could have increased the
required percentage of owners necessary to approve a deconversion and it did not take
such action. It is unclear from the record if such a change was part of the legislative
debate.
As a summary of the underlying concern, Illinois case law holds that a home rule
ordinance can stand in direct and immediate conflict with State statute, except when a
state statute specifically restricts home rule authority. However, there are cases which
present nuanced legal limitations. Such circumstances would include when a state
statute is written to postulate a requirement or in those few cases where vital state
interests would be sacrificed by permitting the local legislation to prevail or prevail until
the next session of the General Assembly. City of Chicago v. Roman, 184 III 2d 504
(1998) and Palm v. 2800 Lake Shore Drive Condo Ass'n, 370 III Dec. 299 (2013). The
General Assembly may limit or restrict a home rule unit's power by allowing local
ordinances, but only within limits consistent with the statutory scheme.

PLAN COMMISSION ANALYSIS
During its September 15, 2022, meeting, the Plan Commission heard a request for a
special use permit for a church at 8256 Skokie Boulevard in a CX Core Mixed-Use
district. The Blessed Word Christian Church proposes to rent an office area for
religious assembly. A “special use” approval is required. The property is on the west
side of Skokie Boulevard and is surrounded by retail/office uses. The church will
occupy an approximately 4,300 SF vacant office space in a building in which Gerber
Collision and Glass is the primary occupant. The church will have seating capacity of
135 seats although the current membership is 40 persons with 30 active members.
The church space will also have room for an office and other activities. Peak use of
the site will be on Sundays between 11:00 AM and 12:30 PM when church services are
held, and Gerber is closed. There will be 13 spaces along Skokie Boulevard, in front of
Gerber, and 20 spaces north of the building available to the church.
A Parking Demand Evaluation dated August 31, 2022 was prepared by KLOA, Inc.
Transportation and Parking Planning Consultants (KLOA) for the church use. Based on
the information that was provided to KLOA it was determined that the parking at the site
would be adequate for the average peak demand of the church. The 33 parking spaces
made available to use the would be used primarily on Sundays. Weekday uses of the
church should occur primarily after 5:00 PM so it will not conflict with the Gerber
operation. The Plan Commission concurred with this parking determination and
recommended approval of the special use permit request subject to conditions.
The Commission discussed a comment by the Police Chief that, “there isn’t capacity for
the needed parking on site or off.” Staff stated that there is a general concern over
religious assembly uses, as they often have attendance that exceeds the parking
requirement. In the subject case, the proposed congregation is new and the parking
analysis indicates that there will be adequate parking.
INTERESTED PARTIES
Legal notice was advertised, posted, and delivered to property owners in the area as
prescribed by the Zoning Chapter. It was determined by Corporation Counsel that
notice was proper and correct. There were no interested parties who spoke regarding
this case.

PLAN COMMISSION RECOMMENDATIONS AND VOTING
The Plan Commission recommended, by a vote of 6 ayes, 0 nays, and 3 absent, that
the petitioner’s request for a special use permit for religious assembly in a CX Transit
Mixed-Use district at 8256 Skokie Boulevard be APPROVED, based upon the Proposed
Positive Findings of Fact and subject to the recommended and standard special use
permit conditions. The Plan Commission further recommends that relief be granted
from §118-212(c)(1)b.3., to allow the two-way north driveway to be narrower than 24
feet, but wider than existing conditions.

STANDARD SPECIAL USE PERMIT CONDITIONS
Site and Use
1. The petitioner shall develop the Subject Property in substantial conformance with
the final Village approved site plan dated <insert date of final approved plan>, office
floor plan dated May 30, 2012, and landscape plan dated <insert date of final
approved plan> (Standard)
2. Parking lot and exterior lighting shall meet Illuminating Engineering Society of North
America (IES) standards, be full cut-off design, and be directed away from adjacent
properties, subject to the approval of the Engineering Division. (Standard)
3. All objects and landscaping within a 15-foot sight distance triangle shall not exceed
30 inches in height, except traffic control devices listed in the Manual on Uniform
Traffic Control Devices. (Standard)
Maintenance
4. All fencing, walls, sidewalks, driveways, curbs, wheel stops, parking areas, signage,
landscaping, structures, and any other facilities or infrastructure on the Subject
Property shall be maintained in a good state of repair, and when needed, be

15. All new construction, alterations, and remodeling shall meet current International
Building and NFPA Life Safety Codes as amended and Fire Department

16. The petitioner shall obtain all required permits and approvals for improvements to
County, State, or Federal rights-of-way from the governing jurisdiction. (Standard)
17. All signage shall conform to the Skokie Village Code. Any sign on the Subject
Property that is in violation of that Code must be removed or modified to conform
with the Village Code prior to the issuance of an occupancy permit. (Standard)
18. All modifications to building elevations, signage, and landscaping shall be subject to
the review and approval of the Skokie Appearance Commission. (Standard)
19. The petitioner shall submit to the Planning Division electronic files of the plat of
survey, site plan, and landscape plan in their approved and finalized form. The files

20. Prior to the issuance of building permits, the petitioner shall submit to the Planning
Division of the Community Development Department the name, address, and
telephone number of the company and contact person responsible for site
maintenance in compliance with the special use permit. (Standard)
21. If work is to be performed on public property or if public property is utilized or
impacted during construction and/or development, the owner shall provide, or shall
cause the developer and/or contractor to provide, the Village of Skokie with a

23. Failure to abide by any and all terms of this Ordinance shall be cause for the Village

applicable business licenses, should be revised or revoked. The petitioner shall pay

A motion to approve the minutes of the September 1, 2022 Plan Commission meeting was
made by Commissioner Burman, seconded by Commissioner Ousley, and approved by all with a
voice vote.

2022-33P – Special Use Permit: 8256 Skokie Boulevard

Construction Group, is requesting a special use permit to allow a religious assembly use in a
Core-Mixed-Use district, and any items of relief that may be discovered during the review of this
case.
2022-34P – Parking Determination: 8256 Skokie Boulevard
SCG Skokie PD LLC, SCG Skokie MP LLC, and SCG Skokie JM LLC, on behalf of Synergy
Construction Group, is requesting a parking determination for a religious assembly use at 8256
Skokie Boulevard.

The chairman reminded all that the Plan Commission is the final hearing body for the parking
determination case and disposition will be decided at this meeting.
Discussion and Interested Parties
Legal notice was advertised, posted, and delivered to all property owners within the area as
prescribed by the Zoning Chapter. Corporation Counsel determined that notice was proper and
correct.
Phil Domenico, property owner, presented the cases. The leader of the Blessed Word Christian
Church, Joyce, also provided testimony. They are proposing to locate in vacant office space for
religious services in a building in which Gerber Collision and Glass is the primary occupant. A
previous tenant, Cavalry Redemption Church, occupied the same space before expanding and
moving to another larger building. The seating capacity for the space is 135 seats but the
congregation only has a membership of 40 with 30 active participants. As Gerber Glass operates
Monday through Saturday 8 AM to 5PM and the church will have services and other activities on
Sundays, evenings, and holidays, there is no operational conflict. Thirteen on-street parking
spaces on Skokie Boulevard in front of Gerber are available as well as 20 spaces north of the
building where Gerber assesses vehicles.
Staff requested the reports to be accepted into the record as written. They reviewed the
parking evaluation and determined that adequate parking is available for the church. However,
parking lot revisions are in order to bring the parking more into compliance with code
requirements. Relief is needed to allow the 2-way north driveway to be less than 24 feet but
wider than the existing condition. The Engineering Division noted that the plat of survey and
the site plan do not match. A new, revised site plan is required.

A commissioner was confused by the comment made by the Police Chief, that “there isn’t
capacity for the needed parking on site and off the street”. He was comparing this church
group to another located on Main Street which generates many street parking complaints. Staff
stated that each church operates differently. There is no street parking allowed on Main Street
near that church.
As the church will be required to operate only when Gerber is closed, a commissioner asked
how the Village would monitor the church’s hours. Staff stated that if the operation of other
businesses is interrupted by the events at the church or if complaints are called into the Village,
then action would be initiated.
Another commissioner asked if the adjacent self-storage facility was open and where do their
patrons park. Staff responded that the facility is open, and vehicles enter via key-cards into the
building. There is no parking area for their use.

• The other/ primary land use on this property is auto repair.
• In 2013, a special use permit was granted to allow religious assembly at the
subject site. The previous church occupied the same area of the building that is
being requested by the petitioner. Reiief was granted to allow a driveway to be
narrower than the required 24 feet/ but wider than existing conditions at the
time. This speda! use permit was repealed after the church vacated the building.
PETITIONER'S SUBMITTAL
The Blessed Word Christian Church proposes to rent an office area for religious
assembly. A "special use" approval is required. The property is on the west side of
Skokie Boulevard and is surrounded by retail/offlce uses. The church will occupy an
approximately 4,300 SF vacant office space in a building in which Gerber Collision
and Glass is the primary occupant. The church will have seating capacity of 135
seats although the current membership is 40 persons with 30 active members. The
church space will also have room for an office and other activities. Peak use of the
site wii! be on Sundays between 11:00 AM and 12:30 PM when church services are
held/ and Gerber is closed. There will be 13 spaces along Skokle Boulevard/ in front
of Gerber/ and 20 spaces north of the building available to the church.
SPECIAL USE PERMIXT: CASE 2022-33P
Comments
Staff Comment and Review sheets were sent to all pertinent departments. Staff
comments on the subject case were received from the Engineering Division/ Village
Forester/ and Police Chief. All other departments returned the sheets with no
comments specific to this case.
Engineering Division
The Engineering Division completed its review and submitted the attached comments
dated September 2/ 2022. In summary/ a revised current site/parking plan was
requested showing the current parking lot layout. The survey and site plan do not
match in terms of parking lot layout and number of spaces. The existing drive aisle to
the north of the site/ that is used to access the property's main parking area/ is less
than 24 feet in width. Relief will be required for this substandard width. Traffic noted its
concern about the use of this driveway for pedestrians; however, it is an existing
condition. The existing parking spaces and striped walkway area need to be painted
and a Stop Bar and R-l sign must be provided at the exit to the parking lot.
Planning Division
The Planning Division recommends approval of the special use permit for a religious
assembly at 8256 Skokie Boulevard. Although this use is not a permitted "retail street"
use/ this designation was temporarily suspended along Skokie Boulevard and other

streets not considered in the core Downtown Skokie area. The staff recommendation is
subject to the following:
1. Addressing all Engineering Division comments/ Including making the necessary
parking lot revisions to bring the parking more Into compliance with code
requirements and current site layout.
2. Providing proper ADA access to/ from, and within the building and the site.
3. Providing landscaping in the southeast parking lot between the sidewalk and
parking spaces, per §118-263(c)(l). The Village Forester requested a more
detailed landscape plan.
In addition/ the western row of parking spaces is located on ComEd property and a
portion of the northern drive aisle is located on the Turning Point property; therefore/
the petitioner must adhere to the terms of any lease or access agreements. Relief from
§118-212(c)(l)b.3./ to allow the two-way north driveway to be narrower than 24 feet,
but wider than existing conditions/ will be necessary.
PARKING DETERMINATION CASE 2022-34P
A Parking Demand Evaluation dated August 31, 2022 was prepared by KLOA, inc.
Transportation and Parking Planning Consultants (KLOA) for the church use. Based on
the information that was provided to KLOA it was determined that the parking at the site
would be adequate for the average peak demand of the church. The 33 parking spaces
made available to use would be used primarily on Sundays. Weekday uses of the
church should occur primarily after 5:00 PM so it will not conflict with the Gerber
operation. The report indicated that the Sunday parking requirement is 0.22 spaces per
seat (1 space/4.5 seats) or 30 spaces based on Institute of Transportation Engineers
(ITE) Parking Generation Manual, 5th Edition.
The Engineering division stated that based on the ITE Parking Generation rates, parking
demand can be accommodated based on the total number of parking spaces at the site.
However, Blessed Word Christian Church shall only operate during the hours in which
Gerber Collision & Glass is not open for any services. Also, all parking spaces should be
available to the Church in order to accommodate any additional parking demand. With
these restrictions, the parking requirement is met.
The Police Chief stated his concern that there isn't capacity for the needed parking on
site and off the street. It is similar to the religious assembly location near Main and
Laramie that we have constant complaints about parking on the streets. There are two
future developments across the street that will also impact street parking.
APPEARANCE COMMISSION
No exterior alterations are proposed. Any minor alteration/ such as an address number
sign or landscaping along Skokie Boulevard/ may be reviewed administratively and
approved by the Director of Community Development or be reviewed by the
Appearance Commission at a future meeting date.

STAFF RECOMMENDATIONS
Staff recommends that the petitioner's request for a special use permit for religious
assembly in a CX Transit Mixed-Use district at 8256 Skokie Boulevard be APPROVED/
based upon the Proposed Positive Findings of Fact and subject to the recommended
and standard special use permit conditions. Staff further recommends that relief be
granted from §118-212(c)(l)b.3./ to allow the two-way north driveway to be narrower
than 24 feet/ but wider than existing conditions.
Staff also recommends that the parking analysis be APPROVED in case 2022-34P.
RECOMMENDED SPECIAL USE CONDITIONS CASE 2022-33P
Prior to the review of this case by the Village Board/ the following items must be
addressed:
1. Submit a revised dimensioned Site Plan/ addressing the Engineering Division and
Fire Department comments, showing the correct number of parking spaces, with a
currently revised date.
a. All 90 degrees parking spaces shall be 9 feet wide and 18 feet deep.
b. Drive aisle width must be 24 feet wide.
c. A stop bar and R"l Sign shal! be located at the exit to the parking lot.
d. A minimum of 5 bicycle parking spaces must be provided and shown.
e. A minimum of 4 handicapped accessible parking spaces.
f. A landscape strip along the Skokie Boulevard frontage of the parking lot by
the Gerber business entrance.
2. Blessed Word Christian Church shall only operate during the hours in which Gerber
Collision & Glass is not open for any services.
3. Submit a revised landscape plan with more detail indicating plant type/ size and
quantity.
