MINUTES of a regular meeting of the Mayor and the Board of Trustees of the Village of
Skokie, Cook County, Illinois held in the Council Chambers at 5127 Oakton Street at 7:30
p.m. on Monday, March 4, 2024
Pledge of Allegiance led by Acting Village Clerk Sylvia Luke
Mayor Van Dusen called the meeting to order.
The Clerk called the Roll. Those present were Trustees Sutker, Robinson, Khoeun, Johnson,
Pure Slovin, Klein and Mayor Van Dusen.
Motion to approve the Consent Agenda.

Report of the Village Manager.
A. Proposed Regulations of Short-Term/Vacation Rentals.
Johanna Nyden, Community Development Director and Julian Prendi, Finance Director gave a brief
review of Short-Term Rentals.
Definition of Short-Term Rentals:
3 categories
1. Owner occupied-hosted.
2. Owner occupied-unhosted
3. Investor owned
Current STRs in Skokie, Challenges and Opportunities-STR Regulation and Staff recommendations.
Motion to concur with staff’s recommendation for the Village to pursue the regulation of STRs
with a three-fold purpose:
1. To regulate these uses in residential neighborhoods in order to mitigate a potential negative
cumulative effect.
2. To enforce life safety code compliance at these properties , and
3. To maintain the residential nature of neighborhoods.
Motion to concur with staff’s recommendations and request Mayor and Board authorize the
Corporation Counsel to draft the necessary ordinance.
The Trustees spoke about regulation of STRs, overbooking, inspections, licensing, complaints-
parking, violations, noise, hotel tax enforcement, % of rentals that get complaints, R1 a& R2
single family, multi family, distance requirement, phone number for investors and protecting
residents.
Johanna Nyden -Community Director and Angel Schnur-Building & Inspection Services
Division Manager answered questions and concerns from the Trustees.
These residents commented on the STRs in Skokie.
Matt Jarvis-spoke about regulation, owner occupied properties , 2 tier system, distance
requirement, complaints, and reliability.

Becky Goldberg a STR owner, spoke about incidents that people would need STRs-religious
communities, people renovating properties, moving, renovation crews, peoples between selling
and buying properties.
Lauren Grodnicki – spoke about the registration process, how often are residents rented out and
that STRs are a complex issue.
Emi Yamauchi-condo owner, questions on registration, insurance, distance limitation, security.
Joe Ferguson- condo owner spoke about how Door County regulates their STRs.
Report of the Corporation Counsel.
* A. Ordinance 24-3-Z-4682
Motion to adopt an ordinance approving modifications to the previously approved site plan for
the property located at 5555 Touhy Avenue, Skokie, Illinois, in a B4 Regional Shopping district
and repeal of Village ordinances 02-10-Z-3124 and 04-6-Z-3281. Item A is on the consent
agenda for second reading and adoption. The first reading was on January 16, 2024.

Unfinished Business.
Trustee Klein read a prepared statement;
We believe in the right of the public to share their views before the trustees of the Village of
Skokie, as first amendment speech is welcomed and encourage before us. But this is a meeting of
a public body conduct in public, not a meeting of the public to repeat the same views over and
over again. Such types of repetitive speech is not an exercise of free speech, rather, it leads to
chaos and makes for less than effective administration of the work of the public body. For this
reason, I call upon the Mayor and my colleagues to draft rules of order that would limit, upon
determination of a majority of the trustees, any member of the general public from repeatedly
making comment on the same subject matter. He asked the Legal department to draw up a
motion at the next meeting,
Public Comment.
Jan Beladi spoke about the Attorney General’s determination about the Hilton. She
questioned about Executive Sessions. Mayor explained that there are exceptions that the
Board can go into Executive Sessions. Mayor Van Dusen stated that he is working with
the Attorney General’s office on the exceptions. The Hilton property is under review and
there is active discussion by the participants. No public money has by given out.
Emi Yamauchi spoke about the Patch article about the Hotel loan. She asked if the money
could be re obligated to another project. There are legal issues that need to be worked thru.
Joe Ferguson condo owner spoke about serious problems in the Skokie’s governing body.
Trustee Johnson continued short presentations on Reforming Village of Skokie Legal
Department.

Public Comment,
JJ Avaska and Gait Scbechter from Skokie Neighbors for Housing Justice spoke about shortage of
affordable housing, mixed developments, subsiding luxury developments and passing
inclusionary housing ordinance.
Lauren Grodnicki- power point presentation concerning Housing affordability and health
outcomes.
Rachel Vanhooes, thanked the Fine Arts Commission for the presentation. She spoke about
developing Oakton street-vacant stoi-e fronts and Main Street.
Emi Yamauchi spoke about the Skokie news and the Old Orchard development, blighted business
district and the sales tax increase.
James Johnson continued the history of the legal department and reforming the department.
Tmstee KJein spoke about "Point of Order procedure" , disruption and repetition of Trustee
Johnson.
Trustee Sutker spoke about the accomplishments of the Village Board and Trustee Johnson
comments are distracting.

Skokie on various platforms such as vacation rental by owner (VRBO). Given the
popularity of STR units, communities are working to manage and regulate these
uses.
After reviewing Skokie's experience, best practices, and the regulations of several
area communities, it is staff's recommendation for the Village to pursue the
regulation of STRs with a three-fold purpose: 1) to regulate these uses in
residential neighborhoods in order to mitigate a potential negative cumulative
effect, 2) to enforce life safety code compliance at these properties, and 3)
maintain the residential nature of neighborhoods. Staff recommends code updates
as presented in the attached memorandum.

In recent years, the Village has monitored an upwards of 80 short-term rentals (STRs), although
the number fluctuates depending on availability. There are currently 45 that are offered for rent
for a period of 30 days or less. The Village has experienced complaints with STRs and a Village
Trustee requested that the Village review the current conditions of this use in the Skokie
community. This memorandum provides a summary of the Village's current regulation of STRs
and has included additional recommendations to potentially regulate this use in the Village.
Summary/Background:
STRs are dwelling units or portions thereof that are offered a period up to 30 days. Presently, the
Village does not regulate this use, but in practice has treated each (when made aware of them) as
a rental property and requires units to be registered as a rental unit in the Village and for the
landlord/operator to attend the required landlord training. Following registration, the property is
placed on the regular Village inspection cycle.
In recent years, the popularity of STR units has grown in consumer preference. In early days of
Airbnb and VRBO, single rooms were offered or whole homes were offered sporadically; today
the industry has grown and investor groups buy entire homes and manage properties for
tourism/hospitality purposes. New sites such as Peerspace, offer homes for parties and special
events. Effectively residential properties are converted to commercial properties and bring
commercial activity to residential neighborhoods. Use of these properties often includes large
gatherings resulting in refuse more significant than a regular household, over-occupancy of the
property in conflict with life safety standards (e.g. sleeping rooms in spaces that are not allowed
by code) and use ofon-street parking in neighborhoods with already limited parking options.
Worldwide, communities are working to determine the best way to manage these uses. Each
community balances the range of impacting factors that can include neighborhood integrity, life
safety, parking, loss of housing units for local populations, noise generated by visitors on

vacation, and other issues. A matrix from the Northwest Municipal Conference is attached to
this memorandum and highlights how other area communities have addressed STRs.
The survey from the Northwest Municipal Conference indicates a range of responses and
regulations. Of the 19 communities that responded to the Northwest Municipal Conference
survey, nine have not enacted any legislation to regulate STRs. Approximately five responding
communities regulate through license or registration to various extents. Six of the responding
communities (inclusive of communities that have enacted regulating legislation and have not),
indicated that the STR use is in some way restricted or even a prohibited use under their
respective zoning codes in residential and some non-residential districts. In reviewing STR
offerings through AirBnb and VRBO while drafting this memorandum, nearly all communities
responding in the original survey showed available STRs in their community (whether the
municipality prohibited or permitted this use) during the month of March 2024.
The Village staff also recently participated in New York University's Housing Solutions Lab's
Peer Cities Network's review of STRs throughout the country. This review provided insight into
the growing national attention to this issue and the use of zoning, licensing, and other regulatory
measures to manage the increase in these uses.
New York City, in response to growing concerns that STR properties were being purchased and
rented to provide a steady stream of income for the owner, updated its STR regulations. STR
properties are required to not be rented less than 30 days unless the unit is occupied by the
owner. The owner may rent up to two rooms to tenants, for a less than 30-day term, providing
that the owner remains on site and every occupant has access to all areas of the home. Interior
doors may not be locked from the outside of the room with a key. Additionally, STR sites are
required to provide information on the listing that they have verified that the property is currently
registered with New York City.
Currently, the Village currently has approximately 45 STR units listed as available on Airbnb
and VRBO. Listings highlight amenities such as close to shopping, downtown Chicago, Wrigley
Field, and Northwestern University. The Village assesses the same 7.5% occupancy tax on these
stays as with fixed location hotels, however has not been collecting the tax due to the challenges
with working with the vendors such as Airbnb and VRBO (e.g. these agencies have not complied
with multiple Village requests to collect).
Recommendation:
There are a variety of ways communities across the globe have sought to regulate STRs to ensure
the character and integrity of neighborhoods are maintained and these properties remain safe and
attractive. This included limiting use to certain zoning districts, restricting the number of units an
owner is allowed to have within a community, owner-occupancy standards, and the number of
guests allowed per rental.
Based on best practices, staff recommends that the Village pursue the regulation of STRs with a
three-fold purpose: 1) to regulate these uses in residential neighborhoods in order to mitigate a
potential negative cumulative effect; 2) to enforce safety code compliance at these properties;
and 3) maintain the residential nature of neighborhoods.

The following is recommended to establish a STR registration/license program in the Village
Code:
• Registration fees would be established based on type of occupancy (owner-occupied versus
no-owner occupancy) Owners that are not on-site (or do not have this address as their
primary residence)1, would be required to have an identified manager located within 15
miles of the property.
• STRs located in Rl and R2 districts must be owner-occupied hosted (meaning the owner is
present during the STR guests stay in the property).
• At least one off-street parking space must be available at the property for guests (in addition
to what is available for residents of the home that may be on property during the stay).
• No property shall be rented for a period less than two consecutive (2) nights/48 hours.
• No more than two (2) STR properties may be on the same block or block face as other short-
term rentals. Properties must be more than 1,000 feet from one another.
• Prior to initial registration/license and/or annual renewal, notice to property owners within
500 feet of the property must be sent that communicates information about the STR, the
contact information for the property owner (primary address, email and phone information)
local manager (24-hour contact with phone and email) and the Village of Skokie registration
number.
• Upon initial registration/license an inspection is to be conducted by the Building &
Inspection Services Division and Fire Department. And the Village has the right to conduct
inspections as needed following the initial inspection.
• All gatherings/parties/socializing with individuals in excess of the allowed sleeping
occupancy of the property must cease by 12:00 midnight on Friday and Saturday and 10:00
pm Sunday through Thursday. No gatherings may take place outside of the property after
12:00 midnight on Friday and Saturday and 10:00 pm Sunday through Thursday.
• Property owners are required to indicate their registration number with the Village in the
text of their advertisement.
• Establish a fee schedule for offenses if found in violation of the STR registration program.
• If property owners are found in violation of these standards, the Village reserves the right to
revoke the license/registration.
• Requirement of posting certain information on-site at the property for guests to review
(include but not limited to allowed occupancy, an exit plan to be posted in the interior of the
unit and bedrooms, and a statement of whether the STR is ADA accessible, information
about parking, directions for refuse disposal and other prescribed property maintenance
issues guests should be aware of).
If the Village Board would like to proceed, an ordinance will be drafted by the Corporation
Counsel's Office.

Item A is on the consent agenda for second reading and adoption. The first reading
was on January 16, 2024.
This ordinance wil! modify the existing site plan for the Village Crossing Shopping
Center. It will allow Village Crossing to demolish the existing 667 space parking structure
at the south end of the shopping center and replace it with 446 at-grade parking spaces.
The approved modification will give the Skokie portion of Village Crossing a total of 2,557
parking spaces, leaving a surplus of 763 spaces. This will also put in place a revised
landscape plan. Many of the site plan approval conditions in the existing site plan,
approved in 1989, specified items such as the construction of buildings and infrastructure,
or contemplated specific retail businesses or uses that were never constructed. Removing
these non relevant conditions serves to simplify the ordinance and match current
conditions. Additionally, Village Ordinances 02-10-Z-3124 and 04-6-Z-3281 granting special
uses for outdoor dining in a B4 Regional Shopping district are no longer required as this is
now a permitted use. As such, for the sake of legislative economy, those ordinances will be
repealed.

1 WHEREAS, DDRTC Village Crossing, LLC, the property owner of 5555 Touhy
2 Avenue, Skokie, Illinois (hereinafter "Petitioner"), in a B4 Regional Shopping district, requested
3 an amendment to its approved site plan for the property located at 5555 Touhy Avenue,
4 through the modified review procedure. The site plan was approved in 1989 and allowed for
5 the development of a multiple tenant shopping center at the site (hereinafter "Village
6 Crossing"); and

15 plan approva!. It was determined that the special use permit for the Subject Property could be
16 amended utilizing the modified review procedure pursuant to Chapter 118, Section 118-34, of
17 the Skokie Village Code.
is WHEREAS, the Chairman of the Plan Commission recommended to the Mayor and
19 Board of Trustees that the requested modifications be granted, subject to the modified conditions
20 contained in the Skokie Plan Commission Chairman's memorandum dated January 16,2024;
21 and
22 WHEREAS, the Chairman of the Plan Commission further recommended to the Mayor
23 and Board of Trustees that Village Ordinances 02-10-Z-3124 and 04-6-Z-3281 be repealed, as
24 they are no longer relevant; and
25 WHEREAS, at a public meeting duly held on January 16, 2024, the Mayor and Board of
26 Trustees concurred in the aforesaid recommendations and findings of fact of the Corporation
27 Counsel, P!an Commission Chairman and Community Development Director;
28 NOW, THEREFORE, BE /T ORDAINED by the Mayor and Board of Trustees of the
29 Village of Skokie, Cook County, Illinois:
30 Section 1: That Village Ordinance Number 89-6-Z-2042 be modified by deleting the
31 existing conditions in Section 1 and replace with the following conditions highlighted in bold:
32 1. The petitioner shall develop the Subject Property In substantial conformance
33 with the final Village approved site plan dated March 17, 1989 as amended by
34 both the Village approved site plan dated May 20, 1999 and the parking site plan
35 dated January 8, 2024; and the landscape plan dated February 16, 2024
36 2. The Petitioner shall maintain and accept all responsibility for the sidewalks
37 along Touhy Avenue and Carpenter Road, including those portions of the
38 sidewalk in the public right-of-way.
39 3. Truck parking shall be prohibited along the south and east lines of the subject
40 site,
41 4. The area located between the wall running along the south side of the shopping
42 centers parking lot and the south property line shall be patrolled regularly to
43 ensure that it is kept free of weeds and debris,

1 5. Al! trash enclosures shall have screening of masonry material to match the
2 building, preventing the observance of trash and trash containers.
3 6. No more than three coin operated amusement devices are allowed at any
4 establishment.
5 7. At least once during every 4 hours of operation and before opening and closing
6 of the businesses, employees shall patrol the Subject Property and clear it of
7 debris.
8 8. No recreational vehicles, trailers, or boats shall be stored on the subject site.
9 9. Trucks and trailers in excess of 8,000 pounds or a license plate greater than an
io Illinois "B" license classification shall not be allowed upon the Subject Property
n at any time except for trucks making deliveries to the site which are parked in
12 designated loading zones.
13 10. New parking lot and exterior lighting shall meet Illuminating Engineering
14 Society of North America (IES) standards, be full cut-off design, and be directed
15 away from adjacent properties, subject to the approval of the Engineering
16 Division.
17 11.Any outdoor sound systems shall at all times maintain audio levels that are
is compliant with the Skokie Village Code.
19 12.AII existing damaged public sidewalks or public sidewalks damaged due to the
20 implementation of this plan shall be replaced.
21 13. No objects are allowed within a 10' sight distance triangle In R1, R2, R3, and R4
22 districts, or within a 15' sight distance triangle in all other districts, between 30"
23 and 84" in height from grade except traffic control devices listed In the Manual
24 on Uniform Traffic Control Devices.
25 14. All fencing, walls, sidewalks, driveways, curbs, wheel stops, parking areas,
26 signage, landscaping, structures, and any other facilities or infrastructure on
27 the Subject Property shall be maintained in a good state of repair, and when
28 needed, be repaired or replaced In a timely manner.
29 15. All private and public sidewalks shall be maintained free of snow, ice, sleet, or
30 other objects that may impede travel.
31 16. Waste receptacles shall be placed on the Subject Property for the use of
32 customers, and that the Health and Human Services Department shall determine
33 the size, type, and location of these units.
34 17. All off-street parking spaces shall be legibly striped and maintained.
35 18. Any plan to modify parking lot striping must be approved by the Director of
36 Engineering.
37 19. The proposed development shall have a minimum of 2557 off-street vehicle
38 parking spaces, as indicated on the site plan dated March 17,1989 as amended
39 by both the Village approved site plan dated May 20,1999 and the parking site
40 plan dated January 8, 2024.
41 20. The accessible parking spaces shall be installed and maintained in compliance
42 with State of Illinois Accessibility Standards and the Skokie Village Code,
43 including required signage.

1 21. Vehicles shall not be allowed to be parked in or otherwise block common
2 driveways, sidewalks, aisles, or other points of access at any time, shall only be
3 parked in designated parking spaces, and shall not overlap the striped lines of
4 designated parking spaces.
5 22. The owner of the Subject Property [and its tenants] shall ensure that employees
e park on the Subject Property.
7 23. No required parking space on the site may be for the exclusive use of any
8 tenant.
9 24. All parking areas must be paved, drained, curbed, and landscaped to Village
10 standards.
n 25. The Petitioner shall sign an "Agreement for Installation and Maintenance of
12 Landscaping" to assure that the Subject Property and parkway landscaping is
13 completed and maintained, including trimming, watering, and replacing of dead
14 plant materials in a timely manner in accordance with the final approved
15 landscape plan. A copy of said Agreement is attached hereto, marked Exhibit
16 "A" and hereby made part of this Ordinance. This "Agreement for Installation
17 and Maintenance of Landscaping" shall be recorded at the petitioner's
is expense.
19 26. All new construction, alterations, and remodeling shall meet current
20 International Building and NFPA Life Safety Codes as amended.
21 27. The petitioner shall obtain all required permits and approvals for improvements
22 to County, State, or Federal rights-of-way from the governing jurisdiction.
23 28. All signage shall conform to the Skokie Village Code. Any sign on the Subject
24 Property that is In violation of that Code must be removed or modified to
25 conform with the Village Code prior to the issuance of an occupancy permit.
26 29. All modifications to building elevations, signage, and landscaping shall be
27 subject to the review and approval of the Skokie Appearance Commission.
28 30, Prior to the issuance of building permits, the petitioner shall submit to the
29 Planning Division of the Community Development Department the name,
30 property address, email address, and telephone number of the company and
31 contact person responsible for site maintenance in compliance with this site
32 plan approval.
33 31. If work is to be performed on public property or if public property Is utilized or
34 impacted during construction and/or development, the owner shall provide, or
35 shall cause the developer and/or contractor to provide, the Village of Skokie
36 with a certificate of insurance naming the Village of Skokie as additionally
37 insured for any and all claims related to any and all work. The owner shall hold,
38 and shall cause the developer and/or contractor to hold, the Village of Skokie
39 harmless and indemnify the Village for any and all claims for property damage
40 or personal injury related to work on or use of public property.
41 32. The petitioner shall comply with all Federal and State statutes, laws, rules and
42 regulations and all Village codes, ordinances, rules, and regulations.

1 33. Failure to abide by any and all terms of this Ordinance shall be cause for the
2 Village to initiate hearings to determine whether the subject Ordinance, as well
3 as any applicable business licenses, should be revised or revoked. The
4 petitioner shall pay all costs related to any hearings conducted as a result of
5 non-compliance with any of the provisions of the enabling ordinance. The costs
6 shall include but not be limited to court reporter fees, attorney fees, and staff
7 time required researching and conducting said hearing.
8 Section 2: That Village Ordinance Numbers 02-10-Z-3124 and 04-6-Z-3281 are
9 hereby repealed.
10 Section 3: That a notice of the approval of this Ordinance incorporating the
11 conditions contained herein shall be executed by the owner of the property in writing and duly
12 recorded with the Cook County Clerk's Office at the owner's expense.
13 Section 4: That this Ordinance shall be in full force and effect from and after its
14 passage, approval and recordation as provided by law.
