13768 MINUTES of a regular meeting of the Mayor and the Board of Trustees of the Village of Skokie, Cook County, Illinois held in the Council Chambers at 5127 Oakton Street at 7:30 p.m. on Monday, July 1, 2024 Pledge of Allegiance led by Village Clerk Minal Desai Mayor Van Dusen called the meeting to order. The Clerk called the Roll. Those present were Trustees Sutker, Robinson, Khoeun, Johnson, Pure Slovin, Klein and Mayor Van Dusen. Motion to approve the Consent Agenda. Moved: Trustee Klein Seconded: Trustee Johnson Ayes: Sutker, Robinson, Khoeun, Johnson, Pure Slovin, Klein and Mayor Van Dusen Nays: None. Absent: None. Proclamation “Decalogue Society of Lawyers 90th Anniversary” Trustee Pure Slovin read a Proclamation expressing congratulations to the Decalogue Society of Lawyers on its 90th anniversary on July 11, 2024 and further congratulate outgoing President Judge Megan Goldish, incoming President, attorney Joel B. Bruckman, and to all members of its Executive Committee and Board of Managers. Appointments, Reappointments and Resignations. *A. Appointments Public Safety Commission: Melissa Villegas as Chair and Paul Pitalis as Emeritus Omnibus vote. *B. Report of the Village Manager. A. Appropriations and Water Rate Ordinances for FY2025. Motion to concur with staff’s recommendation and request Mayor and Board of the Appropriations and water rate Ordinances for FY2025. The final Ordinance will be brought before the Board at the July 15 meeting for final consideration. Finance Director Julian Prendi answered questions from the Board. *B. Proprietary Purchase of Fire Safety Gear – W. S. Darley & Company, Itasca, Illinois - $102,000. Motion to award a contract to W.S. Darley & Company, Itasca, IL in the amount of $102,000 for proprietary purchase of Fire Safety Gear. Omnibus vote. Report of the Corporation Counsel. CONSENT *A. Ordinance 24-7-Z-4695 Motion to adopt an ordinance amending the zoning map with regard to the property located at 9239 Gross Point Road, Skokie, Illinois, from a B1 Service Commercial district to a B3 Business district. Item B is on the consent agenda for second reading and adoption. The first reading was on June 3, 2024. Omnibus vote. *C. Ordinance 24-7-Z-4697 Motion to adopt an ordinance granting site plan approval for the construction and establishment of a one lot planned development at 9208 Skokie Boulevard and 9239 Gross Point Road, Skokie, Illinois, for the expansion of existing car wash operations in a B3 Business district and relief from certain sections of Chapter 82 of the Skokie Village Code. Ordinance 24-7-Z-4698 Motion to adopt an ordinance granting a special use permit to establish and operate an automotive fuel station at 9208 Skokie Boulevard, Skokie, Illinois, in a B3 Business district. Resolution 24-R-7-1572 Motion to adopt a resolution regarding the approval, release of Executive Session minutes and verbatim recordings of Executive Sessions of the Mayor and Board of Trustees. Item F is on the agenda for first reading and adoption. Moved: Trustee Sutker Seconded: Trustee Khoeun Ayes: Sutker, Robinson, Khoeun, Johnson, Pure Slovin, Klein and Mayor Van Dusen Nays: None. Absent: None. MOTION CARRIED Unfinished Business. A. Report of Rank Choice Voting Referendum. Report of submission of the proposition at Referendum of whether the Village of Skokie shall approve Ranked Choice voting. The proposition would be submitted to the voters of the Village of Skokie at the general election to be held on Tuesday, November 5, 2024. Scott Uhler from Klein, Thorpe & Jenkins gave an overview of Ranked Choice Voting. In 2023 the Illinois General Assembly amended the Election Code to establish a Ranked-Choice and Voting Systems Task Force to assess ranked choice voting with any recommendations to adopt such systems to begin with the 2028 presidential primary election. The report from the Village includes timelines that can accommodate the implementation of a ranked choice voting system consistent with the implementation schedule established by Section 1-23 of the Election Code for the work of the Task force. Any recommendations of the Task Force are set for initial implementation for the 2028 presidential primary election. Mr. Uhler answered question from the Board. B. Report of Term Limits Referendum. Report of submission providing for and requiring the submission of a question concerning the establishment of Term Limits for the elected positions of Mayor, Village Trustee and Village Clerk of the Village of Skokie to appear on the ballot of the electors of the Village of Skokie at the General Election to be held on November 5, 2024. 620480 13770 Meeting of the Mayor and Board of Trustees Monday, July 1, 2024 Page Three C. Request Regarding Performance Reviews for Village Manager and Corporation Counsel. Trustee Johnson requested a public discussion of the Board’s procedures for conducting performance reviews of the Village Manager and Corporation Counsel. Mayor Van Dusen suspended the Board’s annual closed session performance reviews and submitted a hand-written survey instead. The Trustees discussed the request and gave feedback. Trustee Johnson made a motion that following completion of the written reviews that the Trustees enter a Closed Session performance review in the next two Village Board Meetings for Village Manager and Corporation Counsel. Motion Fails. Public Comment. James Bolden, 9442 Harding, spoke about “sanitation and property issues “concerning a rat problem” in his neighborhood. The Mayor will follow up on the issue. Trustee Klein walked out in protest before Trustee Johnson continued “Reforming the Village of Skokie Legal Department”. Public Comments by email. Proprietary Purchase of Fire Safety Gear^ - W, S,_D_arle_y & Company, Itasca, Illinois-$102,000. Fire safety gear is an integral and necessary component of persona! protective equipment worn by all sworn members of the Fire Department. Based upon industry standards, manufacturer's recommendations and due to the routine exposure to heat, smoke, and wear and tear, fire safety gear only has a useful life of five years. The FY2025 Capita! Improvement Program (CIP) Budget provides funding for the replacement of 34 complete sets of firefighter safety gear. A portion is being funded through Foreign Fire Insurance. It is recommended that a contract for the purchase of 34 complete sets of fire safety gear in the amount of $102,000 be awarded to W. S. Darley & Company, Itasca, Illinois, an authorized dealer of Innotex gear to meet the needs of the Skokie Fire Department. If such correction or replacement is not made within the aforesaid 20-day period, the VILLAGE may elect to abate the nuisance and take necessary action to assure that the landscaping is replaced and/or maintained. RE: Referenda Resolution Ranked Choice Voting June 25, 2024 At your request, we have drafted the attached resolution for consideration by the Skokie Village Board of Trustees regarding the submission of a public question to the voters of the Village of Skokie for the adoption of a ranked choice voting system for the election of the Village officials. In summary, a ranked choice voting system involves an election where more than two candidates are on the ballot, with voters allowed to rank candidates by order of preference. When one candidate receives a majority of votes as the voters' "first choice", they are the winning candidate. Under the system, when no candidate receives a majority of the "first choice" votes, the vote count continues based on ranked choice votes cast. The system provides that the candidate with the fewest "first choice" votes is eliminated and that candidate s votes are reallocated, with their voters second choice receiving their votes. The process is repeated until one candidate reaches the majority threshold. This type of voting system has begun to draw more attention in Illinois. The City of Evanston recently adopted a ranked choice voting system by referendum and several other municipalities have expressed possible interest. Another area municipality, the Village of Oak Park drafted a referendum question for the submission of a ranked choice voting question to its voters, but the Village Board ultimately determined to wait for the current Illinois Task Force studying the potential of ranked choice voting and its implementation in Illinois to complete its work and make its recommendations regarding ranked choice voting systems in Illinois. In 2023 the Illinois General Assembly amended the Election Code to establish a Ranked-Choice and Voting Systems Task Force to assess ranked choice voting, with any recommendations to adopt such systems to begin with the 2028 presidential primary election. The purpose of the Task Force is to reviewvoting systems and the methods of voting, including ranked-choice voting, that couldbe authorizedby law. The 20 memberTask Force is comprised election officials, interested entities and public members. Its work is to include the following: 2012426 1 Return to Memo • Review standards used to certify or approve the use of a voting system, including the standards adopted by the U.S. Election Assistance Commission and the State Board of Elections. • Advise whether the voting system used by Illinois election authorities would be able to accommodate alternative methods of voting, including, but not limited to, ranked-choice voting. • Make recommendations or suggestions for changes to the Elections Code or administrative rules for certification of voting systems in Illinois to accommodate alternative methods of voting, including ranked-choice voting. See 10 ILCS 5/1-23 The last meeting of the Task Force was May 28Eh and the report of the Task Force is due to be issued by July 1st. The report of the Task Force is to set forth its findings and recommendations, to include: • The process used in Illinois to certify voting systems, including which systems can conduct ranked-choice voting; and • Information about the voting system used byelection authorities, including which election authorities rely on legacy hardware and software (equipment that has exceeded its usable life span) for voting and which counties and election authorities rely on equipment for voting that has not exceeded its usable life span but require a software upgrade to accommodate ranked-choice voting. See 10 ILCS 5/1-23 The resolution we prepared includes timelines that can accommodate the implementation of a ranked choice voting system consistent with the implementation schedule established by Section 1-23 of the Election Code for the work of the Task Force. It has been 17 months since the Board's !ast closed session performance review of Corporation Counsel Large on January 17, 2023, and it has been 18 months since the Board's last closed session performance review of Village Manager Lockerby on December 19, 2022, On May 31, 2024, without any public Board discussion or direction, Mayor Van Dusen informed the Trustees that he would be suspending the Board's annual dosed session performance reviews, and substituting a hand-written survey instead. In light of these changes, I request a pubiic discussion of the Board's procedures for conducting our performance reviews of the Village Manager and Corporation Counsel, and I advocate that the Board resume closed session performance reviews in July.
