COMMENTS - Current Meeting:
Read and Atty Shewchuk stated he sent the property owner a letter. The landlord is not the
owner of the dogs and the property owner said the tenant moved out.
Complainant
Paula Starnes asked when did the landlord say he evicted the tenant.
Atty Shewchuk said the 17th of July.
Ms. Starnes asked if there is a way to require the landlord to put in place, that their tenants
have to act responsible or walked their dog on a leash.
Atty Shewchuk said there are law that's already put in place.
Ms. Starnes states there are lot of children.

2. Dangerous Dog Hearig for Dog Named Emmy at 1859 Roosevelt Ave Owned by

Read and Officer Renee Robichaud from Thomas J. O'Connor read their report.
Complainant
Ashley Brennan stated the fence is falling down and all she wants is for the dog to stop
going in her yard. The dog has defecated on her property.
Respondent
Amanda-Lee Camacho stated the entire fence line is broken. Ms. Brennan hit her dog with a
shovel. Ms. Camacho presented video of the adjacent fence that was taken on July 17.
Rebuttal
Ms. Brennan said the picture that Ms. Camacho showed the board has nothing to do with
her (Ms. Camacho) side of the fence, the picture showed is the other side of the fence. Ms.
Camacho bought the fence two (2) weeks ago, and she would like to see the video of her
hitting Ms. Camacho dog.
Ms. Camacho said she don't know what else to say, but this could've all been avoided.

2. Thomas J. O’Connor (TJO) to visit with in two (2) weeks. As defined in Chapter 110,
Section 9 of the Code of the City of Springfield Ordinance.

3. Dangerous Dog Hearing for Dog Named Dino at 46 Hampden St Owned by

COMMENTS - Current Meeting:
Read and Officer Renee Robichaud from Thomas J. O'Connor (TJO), read her report.
Complainant
Robert Lauzon stated the dog was tethered on a suitable rope in the back yard. While the
dog was supposed to be on confinement, the dog was out repeatedly. They located the
owner of the apartment building. The owner was able to contact the owner of the dog. Mr.
Perez never showed any remorse for what happened to the dog, never made any attempt to
ask how their dog is doing, any restitution or the injuries to the dog. The dog is a danger to
the neighborhood, and there is a signed petition by the neighbors; they all have concerns
about that the dog continuing to be in the area. The owner of the dog has done nothing to
change the behavior.
Tan Nugyen says, he saw his dog in his back yard. Before they could move the dog attacked
their larger male dog. The police arrived and called the ambulance for their dog, they had to
drive to West Hartford, Connecticut to get emergency care for their dog. The dog was taken
to the VCA Animal Hospital in West Hartford, CT, the dog stayed overnight.

Ruvelson Perez stated the leash was not a leash or a rope, it was a lighting leash. Mr. Perez
admitted his dog broke off the lighting leash and to the injuries to Mr. Lauzon dog. He takes

full responsibility for his dog attacking the other dog. He has photo that his dog also
sustained injuries.
Rebuttal
Mr. Lauzon asked if the dog was licensed.
Officer Robichaud said no.
Mr. Lauzon said the dog is tied behind house for hours at a time.
Mr. Perez stated that his dog is on a leash in the back yard, and his dog has injuries as well
if the board want to see it.

The Advisory and Hearing Committee has imposed the following conditions on the
animal:
1. That the dog be humanely restrained.
2. That whenever the dog is removed from the premises of the owner, the dog shall be
securely and humanely muzzled and restrained with a leash having a minimum tensile
strength of 300 pounds and not exceeding three feet in length.
Hearing Committee recommended the dog owner speak with the property owner, in regards to
installing a kennel at the property. As defined in section 110, section (B)-9 of the Code of the
City of Springfield Ordinance.

Jolene Alexander stated the dog got on top of the pit bull. It's healed, other than the vet bill
she has, and her concerns for the safety of individuals. There's a dog that is know to bite
not just animals, but humans that is roaming the neighborhood. That is concerning.

1. Dangerous Dog Hearing for Dog Named Malikai at 58 Daviston St Owned by
Richard Pittman
COMMENTS - Current Meeting:
Read and Officer Rene Robichaud from Thomas J. O'Connor (TJO), gave a report stated, in
December a dog resided at 58 Daviston St on the first floor, owned by Richard Pitman
escaped the yard and attacked a small Chihuhua, named Theodore. The attacked was fatal
to the dog Theodore.
Complainant
Robert Brandon Mitchell, stated he was walking his dog around the block on Daviston St
toward East on Summer Ave. As he turned the corner onto Daviston St, about 100 ft, his
dog was attacked. The pit bull dog came out and grab hold of his dog. He had to put the
dog in a chokehold to get hold of his dog (Theodore), the pit bull final let go of his dog
(Theodore) and he tried to revived his dog. He called the Police and they responded. He
called his mother, the pit bull was not on a leash.
Norma Bate- Mitchell stated, her son called her and told her their dog (Theodore) was
attacked and killed, she told her son to stand with her in front of their house, which is next
door to 58 Daviston St. They waited about 15 minutes for the police, the first patrol car
arrives, the home owner did not answer, the second patrol car arrives and all four (4) Police
Officer knocked on the door and the owner answered the door. The officer spoke to the
owner, then to her. The officer told her there was nothing they could do because it a first

Richard Pittman stated that he usually chained up his dog in the front of the yard, but from
past incidences he has being noticing that he has to keep going outside and he would have
to yelled, pull your dog along or get your dog. He started to chained his dog in the back
yard. He dose not think the spring went up to where the chain is put on, it did not locked all
the way and can say his dog Malikai, got loosed. He did not know what had happened until
the Police Officer knocked oh his door and told him that his dog just killed a dog.
Ashaneek Steves, witness for the respondent stated the dog does barked and chained.
They have told Norma husband several times to come and get their dog Theodore, their dog
Theodore has been loosed several times and ran in their yard. She is not making any
excuses for their dog Malikai, but their dog Malikai was agitated with Norma dog Theodore
on several occasions. She does agreed with Norma as for as keeping the dog vaccinated and
chained, and they are sorry.

Rebuttal
Norma Bartee- Mitchell stated that on the December 22 2023 the dog was loosed. The dog
at times is tided up in the front yard with a chain and a rope in the ground. The dog is
viciously barking at her and her granddaughter. She will not allowed her granddaughter in
the driveway, she left them off in the front of the house because she don't know what the
dog is going to do or if the chain is going to break.
After the 22nd of December, 2023 the dogs are rarely seen in the front, she has sent three
(3) videos of the three (3) dogs loosed, they are not on a leash and running around in the
yard and this is after her dog (Theodore) was killed.
She is asking the city to recognized that the dog killed her dog (Theodore), the city to fully
inspect the dogs at that residence to make sure they are licensed, vaccinated, and that they
have all the required paper works and are contained in an area.
Also that the pet owner be mandated to obtained an one hundred thousand liability
insurance to ensure, if it get loose again the community, pet owners can take appropriate
actions appropriately.
Norma stated she did not get an apology or recognition that her dog was killed, it was not
until today.
Richard Pittman stated the other dog Norma stated was loosed is not the same dog, he
does not let that dog (Malikai) loose. The only thing the dog(Malikai) does is used the
bathroom and go back inside the house, since that accident.
Board Johns asked if the dog was up to date with it shots and neutered.
Officer Robichaud say there is no record of the dog registered in the city.

Board Johns stated they have the dog over five years and never registered the dog.
Board Johns asked Officer Robichaud, from TJO what are her recommendation(s).
Officer Robichaud says she recommend the dog to be deemed dangerous and whatever
the board determines. If the yard is not fully fenced, they can’t risked him( Malikai) getting
loose.
Board Edwards says there is lot more to deeming a dog dangerous and at the proper time
he will make a motion to deem the dog (Malikai) as dangerous.
Board Nelson Campbell asked Board Fleming if he had any thought(s) or commend(s)

Board Flemings says he just want to know if the dog was loose when the attacked happen
Board Nelson Campbell asked Board Landry if he had any thoughts or commend(s)
Board Landry says she agreed the dog should be deem dangerous. She don't believe
euthanasia at this point, but strongly suggested muzzling, tethering.
Board Johns stated that the dog need to be euthanize, the dog killed another animal and
at one point that was the go to, if there was a animal that was killed, that roped the law as
for as the dog needs to be euthanize. That would be her recommendation

2. Nuisance Dog Hearing for Two Pitbulls Mixed at 40 Champlain St Owned by Grace

COMMENTS - Current Meeting:
Read and Officer Rene Robichaurd read the report of the complainant, said report it is
attached to the agenda. Officer Robichaurd stated TJO had one complaint for this affect on
January 6th, 2024, the officer explained the nuisance dog hearing process to the caller and
advise small claims court for the damage to the fence. The officer made contact with Randy
to let him know that was going on. The dogs are barking but in every video the dogs remain
in their yard.
Attorney Shewchuk asked if he can define the nuisance ordinance, and read the ordinance
and says any of those can be consider as nuisance dog.

Danielle Watts stated they have been having the issues on and off for about a year. It has
progressed to where the dog trying to dig under the fence and ripping the bottom board off

the fence, to the point they can get their whole head under the fence. They have brought it
to the owners attention. The owner offered to pay for half of the fence, but after seeing how
the damage the fence was and the damages their new fence. They have decided to have
they pay for or put the dogs in a kennel. Its no fair for the dog to damage their property.
Kyle Rodriguez stated the holes are now large enough for their dog to pass through on to
their(Grace & Mike Perez) side. He had to patched the fence to prevent their dog from
getting on to their side. Grace & Mike have not made any attempt to repair the fence. He
fearful of his dogs and family well being.

Read and Officer Rene Robichaurd stated TJO requested this hearing and the owners are
well aware of the issues of the dogs. The dogs keep on getting loosed,

to stop the dogs from getting out. They bought an electric fence to see if it will stop them
from getting out, they are very good at getting out.
Peter says their dogs gets out a lot, their yard are fully fenced in. The dogs chewed off the
lead and they diggged under the fence.

neighbor. It's very sad what goes on next door. His dog was popping on the deck and he
yelled Glory no poop and the neighbor called TJO. He takes all three (3) dogs to his work.
Mr Lawrence showed pictures to the board members and state that his dogs are not a
nuisance and they don't bark, if he says no barking they don't bark. His dogs are well
trained.

Read and Attorney Robert Shewchuk read the City of Springfield Ordinance for nuisance
dog.
Officer Renee Robichaud from Thomas J. O'Connor (TJO), stated certified mail and regular
mail was sent out. On March 1st, 2024, Springfield Police Department called for assistance
with an aggressive dog trying to attack Ms. Greer. No bites occurred. Ms. Ramos said the
dog belong to her son, who lives in New York. The dog will be returning to New York to live
with her son. A citation was sent to Ms. Ramos for the dog being loosed, unvaccinated and
unlicensed in the city.
Complainant
Ruth Greer stated she is the neighbor of Michelle Ramos. Ms. Greer said, on March 1st
2024, she was taking out her trash with her daughter. She looked over and noticed that Ms.
Ramos open her screen door, her main door and let her dog run towards her and her
daughter. Ms. Greer said she got between the dog and her daughter. Ms. Greer said she
started kicking the dog. Ms. Ramos came down the stairs and said don't kick her dog.
The other incident is when she was walking her daughter to school. Again the dog was let
out to poop, and began to chase her daughter. Ms. Greer said Ms. Ramos left the dog alone
to go on vacation without any food.

Read and Attorney Shewchuk read the City of Springfield Ordinance for dangerous dog.
Officer Renee Robichaud from Thomas J. O'Connor (TJO), stated on March 25th 2024, they
received a called from the Springfield Police Department regarding a dog attack, dog verses
dog. Mr. Diaz was taking his dog, Luna and his trash out. Spencer, owned by Mrs. Butal and
Mr. Harb, got loose and attacked Ivan's dog Luna, biting Luna multiply times and physically
shaking the dog. Ultimately the dog (Luna) was euthanized at the emergency hospital that
evening.

Complainant
Ivan Diaz stated he was doing his routine, he was bringing out his trash barrel with his dog.
He was putting down the trash barrel, when two(2) dogs came rushing. By the time he let
the trash barrel go and looked. The dogs grabbed, yanked and throwing up his dog Luna.
Luna had holes every where from the attack. Mr. Diaz was escorted to West Springfield by
the police to try to save his dog. The doctor said there was nothing they can do. His dog
passed away. Luna was another family member.
Atty Shewchuk asked how can he identify the dog owner.
Mr. Diaz said this is the first time he saw them.
Atty Shewchuk thanked Mr. Diaz, and said he just want it to be on the record that we are
talking about the right dog.

Nadia Butal & Nasser Harb said she is sorry for what happened. She said her Spencer is not
dangerous. Spencer is sweet and she raised Spencer from a baby. She knows Spencer, this
is the first time in two years Spencer skipped the gate. She didn't know what had
happened. If she knew Mr. Diaz's address, she would have reached out to him. She doesn't
know what happened. She knows her Spencer. Spencer cannot damage anything. Spencer
plays with the kids and small dogs. What happened, she don't know. Spencer is vaccinated.
Registered and micro chipped.
Mr. Harb said he is really sorry for what happened to Mr. Diaz's dog. If it was him, he would
be angry too. Losing a pet is like losing a part of the family. Their dogs are a part of their
family. He wanted to reach out and give their condolence. But, he didn't know if it was ok or
not. He didn't want to go to Mr. Diaz's house and make him feel uncomfortable in any way.
Spencer plays with other dogs, small and big. None of this has ever happened before. He
dosen't know what happened. Why Spencer attacked Luna? Spencer is a gentle giant.
There is nothing they can say to bring Luna back.

Mr. Diaz said they can say they know their dog, just like he knew his dog, Luna. But, on
that day something happened. It's a hard situation for him and his family. It's not fair.
Mr. Harb said he knows it's not fair, but his dog is a part of their family as well. He wished
there was something he can do.

COMMENTS - Current Meeting:
Read and Officer Renee Robichaud from Thomas J. O'Connor (TJO), stated on March 22nd,
2024, officer received a called regarding a dog bite incident from the Springfield Police
Department. Ms. Graziano was walking down the street, when Thomas was playing fetch
with his dog, Harley off leash. Harley chased after Ms. Graziano, while she attempted to
walk by Harley bit her on left buttock.
Complainant
Marisa Graziano said she was going on her morning walks. Mr. Perez was out on the street
with his dog Harley. The dog was not on a leash. She was hesitant to walk, then the dog
lunged at her and bit her aggressively. She stumbled into the woods on the right, then the
dog was trying to attack her again. Mr. Perez watched his dog bite her. Mr. Perez didn't say
sorry. She has two (2) puncture wounds that's not healing the way it should be, it hurts to
run and sit. She missed one week of work, she has the doctor's note. She went to Urgent
Care, and got a tetanus shot and was put on antibiotics.
Atty Shewchuk said this sounds like a civil complaint for damages. This complaint is about
the dog and its dangerousness.
Ms. Graziano said that's what she wants.

Thomas Perez said normally when he gets out of work the first thing he does is let his dog
out of his kennel and play catch with him. It's a small private way, it says danger, private
way. He saw Ms. Graziano walking up the hill as he's playing fetch with his dog, she looked
to be afraid. Harley started to approach Ms. Graziano. Harley is a friendly dog. Mr. Perez ran
over to his dog and said Harley come back, come back. As Harley approached Ms.
Graziano, she turned very quickly and Harley jumped on her back. Harley did not bite Ms.
Graziano, it was Harley's claws that hit her feet. He grabbed Harley, said he was sorry to
Ms. Graziano and put Harley in his kennel. He sat there and waited for the Police and Animal
Control to come his house, he invited them in, spoke with them and showed them the
records for Harley.
Rebuttal
Ms. Graziano said she had the puncture wounds as the proof. Mr. Perez watched his dog
bite and attack her.
Mr. Perez said when Harley made contact with Ms. Graziano, he grabbed Harley and put him

he own it.
Board Member Edwards explained the meaning of private way. He stated that a private way
does not mean you own the street, it simply means the street is not paved. The contractor
didn't spend the money to pave the street when they finished building the houses.
Officer Robichaud asked Mr. Perez how tall is the kennel.
Mr. Perez said it six (6) feet.
Officer Robichaud asked if the kennel is cement based.
Mr. Perez said he is in the process of getting it done.

COMMENTS - Current Meeting:
Read and Officer Renee Robichaud from Thomas J. O'Connor (TJO), stated on March 30th,
2024 TJO received a call from Ms. Reid regarding multiple dogs attacking her as she was

entering her home with her small son. Two (2) dogs jumped on her causing scratches and
abrasions, Ms. Reid went to the Hospital for medical treatments. Ms. Reid call the Police
Department after returning from the Hospital. TJO Officers contacted the owner and it turns
out there are at least five (5) dogs at the resident which is over the limit for the city. All five
(5) dogs were placed on quarantine. It appears that none of the dogs are spayed or
neutered. The city has a limit for intact animals of three (3) or if they are spayed or
neutered the limit would be four (4), otherwise a kennel license would need to be acquired.
This property would not meet the requirements for a kennel license within the city.
Complainant
Shadel Reid said it was little after eleven in the morning (11:00 A.M) her and two children
returned home. She walked up the stairs as she was heading to the inside door when
Kimberly dog came running from the back yard. The biggest dog jumped on her, she tried
to shield her four (4) year old. Her and her son was pushed up against the screen door, she
hovered over her son the dogs were behind her scratching her. Shadel contacted her
grandma, who then contacted the Police Department and TJO. Shadel's major concerns is
when she reached out to Kimberly there was no remorse, empathy or nothing. The only way

she was able to get the dog off of her is when her fourteen (14) year old son pushed
through the screen door, once the door opened she swung her four (4) year old inside the
house and still being scratched and clawed. There is no dog sign up, she saw Kimberly on
her camera saying to their neighbor sorry I know I am supposed to put up the dog sign, but
I didn't put it up. Shadel said Kimberly blamed her autistic son for letting out all five (5)
dogs. Shadel said from her understanding, kimberly was told the big dog has to leave, two
(2) of the five (5) dogs has to leave and the dogs could not be off a leash if they are
outside. On April 1st, her camera caught all five (5) of her dogs outside off leash with her
husband. Shadel said her son is petrified of going outside because of to the dogs, he is
scared. Shadel said Kimberly son threaten to kill her, and said he will crash out for his dog.

Kimberly Toote said she was at work when Shadel texted her. She has the text message
Shadel sent her, stating she was attacked by the dog and that she was going to the
hospital. She didn't know what to say. Kimberly husband, John Serru says the reason why
they have five (5) dogs is because when they bought the house, at the closing it says the
property would be fully empty. Mr. Serru says their son was supposed to go downstairs with
his two (2) dogs. Kimberly says they already got rid of one dog. Mr Serru says the reason
why they didn't have the records was because they were in a bad move and was living in a
a hotel for a month and a half. Kimberly says Polie and Silver are going to get their shots
and get neuter. She spoke to TJO and she's in compliance with them. Mr. Serru said the
reason why the dogs was out is because he goes to work at 4:00 in the morning and he let
the dogs out before he goes to work every morning, it's routine for the dogs.
Rebuttal
Shadel Reid said she understand the dog is in a routine, but the dogs were outside off leash.
Kimberly was not abiding by what TJO said. It was King that attacked her and she had open
abrasions.
Kimberly said Meeko and King are vaccinated. Her dogs jumped on people when they get
excited. Kimberly said she did sign up for King and Polie to get fixed.
