O'Connor (TJO) read her report. Complainant Michelle Bennett stated it's a long standing habit of irresponsible behavior of the owner. The dog behavior is becoming more and more aggressive as he charges. The dog would come out of no where. This is a eighty five (85) pound dog running at full gallop, with the teeth bared, barking and growling and coming much too close for comfort. It's frightening for her and there's literally nothing she can do with the situation. She asking the committee to limit the privileges to keep everyone safe. It's irresponsible for any one to have their dogs running free in that area. This is a conservation area, there are at least two (2) different kind of wild species, turtles, wild turkeys, deers and coyotes. Respondent Gary Forney stated the dogs belong to his daughter and admitted the dogs were off leash. Rebuttal Ms. Bennett said there are multiple incidences. Officer Renee Robichaud asked Mr. Forney if the dogs were licensed. Animal Control Page 6 Printed 10/7/2024 Regular Minutes August 15, 2024 Complainant Adrienne Cuffie stated she was not the one walking the dog when the attack happened. Glen Edwards stated he was walking his dog when Cuban came out of no where. then all of a sudden he grabbed his dog. Ms.Cuffie stated Zoey was like her child. Respondent Mya Gaskins stated her and Ms. Cuffie had talked. She recently installed a six foot wooden fence around her entire yard. She walked Cuban from the front to the back yard on a leash. Cuban has not been off her property since, she's trying every steps to rehabilitate, fix the incidences that was occurred. The incidences were a year a part. She has been making steps and efforts to fix the situation on their end and for herself, so she can keep her dog in her house and to move forward in the safest and best way possible. Rebuttal none. The dog must be kept in a secured enclosure as defined in Chapter 110, Section 10-B-5 of the Code of the City of Springfield Ordinance. 2. The dog must be leashed and muzzled when walked off the property in accordance with Chapter 110, Section 10-B-3 of the Code of the City of Springfield Ordinance. 3. That the owner or keeper of the dog provide proof of insurance in an amount not less than $100,000 insuring the owner or keeper against any claim, loss, damage or injury to persons, domestic animals or property resulting from the acts, whether intentional or unintentional, of the dog or proof that reasonable efforts were made to obtain such insurance if a policy has not been issued; Provided, however, that if a policy of insurance has been issued, the owner or keeper shall produce such policy upon request of the hearing authority or a justice of the district court; and provided further, that if a policy has not been issued the owner or keeper shall produce proof of efforts to obtain such Animal Control Page 7 Printed 10/7/2024 Regular Minutes August 15, 2024 insurance provided to Thomas J. O’Connor within twenty-one (21) days. 4. A dangerous dog license shall be acquired annually at a fee of one hundred dollars ($100). Complainant Joshua and Heath Hicks did not appear. Respondent Abdul Kabba said his dog is a friendly dog. When his dog gets out, they go to the open lot yard where he walks his dog. The incident that happened, the Police and Animal Control came. He was there and nothing happened to none of the human beings. The whole neighborhood knows they are friendly dogs. The new tenants are suing him and their dog barks at his dogs all the time. Board Member Landry asked Mr. Kabba how are the dogs getting out. Mr. Kabba said they are very athletic dogs, they scaled back and get over the six (6) foot fence. They are very smart dogs, they can hold the door knob, open and closed the door. The dogs came from Africa, they don't bother anyone, they are not aggressive and are very low temperament. Officer Robichaud asked Mr. Kabba if he owns the property. Mr. Kabba said he's the manage of the property. Animal Control Page 9 Printed 10/7/2024 Regular Minutes August 15, 2024 Officer Robichaud asked Mr. Kabba if the owner will allow him to put a secure enclosure on the property. Mr. Kabba said it's already done and he's building a platform for the kennel. He's going to build a gabion with rocks and cement, the whole yard will be fenced in. The landlord is not the owner of the dogs and the property owner said the tenant moved out. Complainant Paula Starnes asked when did the landlord say he evicted the tenant. Atty Shewchuk said the 17th of July. Ms. Starnes asked if there is a way to require the landlord to put in place, that their tenants have to act responsible or walked their dog on a leash. O'Connor read their report. Complainant Ashley Brennan stated the fence is falling down and all she wants is for the dog to stop going in her yard. The dog has defecated on her property. Respondent Amanda-Lee Camacho stated the entire fence line is broken. Ms. Brennan hit her dog with a shovel. Ms. Camacho presented video of the adjacent fence that was taken on July 17. Rebuttal Ms. Brennan said the picture that Ms. Camacho showed the board has nothing to do with her (Ms. Camacho) side of the fence, the picture showed is the other side of the fence. Ms. Camacho bought the fence two (2) weeks ago, and she would like to see the video of her hitting Ms. Camacho dog. Ms. Camacho said she don't know what else to say, but this could've all been avoided. Board Member Edwards made a motion to deem the dog a Nuisance the motion was seconded by Board Member Fleming. Dangerous Dog Hearing for Dog Named Dino at 46 Hampden St Owned by Ruvelson Perez COMMENTS - Current Meeting: Read and Officer Renee Robichaud from Thomas J. O'Connor (TJO), read her report. Complainant Robert Lauzon stated the dog was tethered on a suitable rope in the back yard. While the dog was supposed to be on confinement, the dog was out repeatedly. They located the owner of the apartment building. The owner was able to contact the owner of the dog. Mr. Perez never showed any remorse for what happened to the dog, never made any attempt to ask how their dog is doing, any restitution or the injuries to the dog. The dog is a danger to the neighborhood, and there is a signed petition by the neighbors; they all have concerns about that the dog continuing to be in the area. The owner of the dog has done nothing to change the behavior. Tan Nugyen says, he saw his dog in his back yard. Before they could move the dog attacked their larger male dog. The police arrived and called the ambulance for their dog, they had to drive to West Hartford, Connecticut to get emergency care for their dog. The dog was taken to the VCA Animal Hospital in West Hartford, CT, the dog stayed overnight. Respondent Ruvelson Perez stated the leash was not a leash or a rope, it was a lighting leash. Mr. Perez admitted his dog broke off the lighting leash and to the injuries to Mr. Lauzon dog. He has photo that his dog also sustained injuries. Rebuttal Mr. Lauzon asked if the dog was licensed. Officer Robichaud said no. Mr. Lauzon said the dog is tied behind house for hours at a time. Mr. Perez stated that his dog is on a leash in the back yard, and his dog has injuries as well if the board want to see it. The Advisory and Hearing Committee has imposed the following conditions on the animal: 1. That the dog be humanely restrained. 2. That whenever the dog is removed from the premises of the owner, the dog shall be securely and humanely muzzled and restrained with a leash having a minimum tensile strength of 300 pounds and not exceeding three feet in length. Hearing Committee recommended the dog owner speak with the property owner, in regards to installing a kennel at the property. As defined in section 110, section (B)-9 of the Code of the City of Springfield Ordinance.
