The Chair called the meeting to order at 3:30 pm.
II. Roll Call
The Chair directed the Associate Clerk to call the roll, and the following members
answered to their names: Ms.Clark-Hubbard, Mr. Devoti, Ms. Cox Antwi, and Mr.

An Ordinance authorizing the honorary street name Kym Kimberli’s Way pursuant to Ordinance
Number 68937, which shall begin at the intersection of Deer Street and run North on Deer Street to
the intersection of Martin Luther King BLVD.
The Chair recognized Ms. Clark-Hubbard on Board Bill Number 97.
Ms. Clark-Hubbard provided information on why she wanted to authorize the
Honorary street naming of Kym Kimberli’s way. She spoke on how Ms. Kym was a
very important part of that community.

The Petitioner is Ranken Technical College.
The vacated portion of air space will be used to connect two buildings on campus.

3 City of St. Louis, Missouri, as hereinafter described, in accordance with Charter authority, and in
4 conformity with Section l4 of Article XXI of the Charter and imposing certain conditions on such

6 BE IT ORDAINED BY THE CITY OF ST. LOUIS AS FOLLOWS:
7 SECTION ONE: Subject to the terms and conditions hereinafter set forth the "air rights"
8 or "air space" above that portion of Finney Avenue, which is described as follows:

10 A tract of land between elevation 519.50 to elevation 550.00 (NAVD88 Datum),
11 being a portion of Finney Avenue, 70 feet wide, adjoining City Blocks 4558 and
12 4561, of the City of St. Louis, Missouri, said tract being more particularly described
13 as follows:
14 Commencing at the intersection of the southwestern right of way line
15 of Finney Avenue, 70 foot wide, and the northwestern right of way
16 line of Pendleton Avenue, 60 foot wide, also being the eastern corner
17 of City Block 4561; Thence along said southwestern right of way
18 line, north 60 degrees 52 minutes 57 seconds west, a distance of
19 274.95 feet to the point of beginning; Thence continuing along said
20 southwestern right of way line, north 60 degrees 52 minutes 57
21 seconds west, a distance of 70.00 feet to the northwestern line of the

7 described vacation; thence leaving said northeastern right of way
8 line, along said southeastern line, south 29 degrees 07 minutes 03
9 seconds west, a distance of 70.00 feet to the point of beginning.
10 The above described vacation containing 4,900 square feet is based
11 upon an actual boundary survey executed by Cole and Associates,
12 Inc.
13 are, upon the conditions hereinafter set out, vacated.
14 SECTION TWO: Petitioner is Ranken Technical College. Vacation will be used for
15 elevated, enclosed pedestrian walkway to connect two campus buildings.
16 SECTION THREE: An appropriate application shall be filed with the Building Division
17 and there shall be submitted detailed plans for the erection, construction and use of the buildings,
18 structures and related facilities which are to be constructed over the areas described in Section One.
19 SECTION FOUR: Notwithstanding any provisions of the Revised Code of St. Louis or
20 the Ordinances of the City of St. Louis to the contrary, the Board of Public Service and the Building
21 Division are hereby authorized and directed to issue building permits for the erection, construction

1 and use of buildings, structures and related facilities, as well as any future additions, alterations or
2 improvements thereto and renewals and rebuilding thereof, in the areas vacated pursuant to the
3 provisions of Section One hereof when the Building Division shall find that:
4 1. The proposed plans and specifications of such buildings, structures and related facilities
5 are such that said buildings, structures and related facilities will be located within the
6 boundaries of the areas vacated by Section One.
7 2. The proposed manner of construction pursuant to the proposed plans and specifications
8 of such buildings, structures and related facilities shall be such as to not unduly interfere
9 with traffic on the public right-of-way.
10 3. Materials proposed in the plans and specifications to be used in constructing the said
11 buildings, structures and other facilities shall be such as are customarily used in projects of
12 this type involving construction over highway rights-of-way.
13 SECTION FIVE: The present owners and any successors and assigns of the ownership of
14 the real property abutting the areas described in Section One shall be bound by the following terms
15 and conditions:
16 1. They shall indemnify and hold harmless the City of St. Louis against any liability, loss or
17 damage arising out of, or in connection with the construction, maintenance and occupancy
18 of the buildings, structures and related facilities above the public right-of-way.
19 2. All construction of an repair and maintenance to the exterior portions of the buildings,
20 structures and related facilities above the public right-of-way shall be performed only at
21 such times any by such methods as Board of Public Service shall permit, except in the case
22 of a emergency.
23 3. No advertising signs, displays or devices shall be placed above the public right-of-way

1 unless approved by the Board of Public Service.
2 4. No hazardous or unreasonably objectionable smoke, fumes, vapor or odor shall be
3 permitted to descend to the grade line of the public right-of-way.
4 5. All buildings, structures and related facilities over the public right-of-way shall be
5 properly maintained so as to safeguard adequately said buildings, structures and related
6 facilities against fire and other hazards which would impair the use and safety of the public
7 right-of-way.
8 6. The City of St. Louis or its authorized agent shall have the reasonable right to enter into
9 and inspect all buildings, structures and related facilities maintained over the public right-
10 of-way.
11 7. All buildings, structures and related facilities located over the public right-of-way shall
12 comply with all regulations imposed by the City of St. Louis to protect against fire and other
13 hazards which would impair the use and safety of the public right-of-way.
14 8. In the use of the air space over the public right-of-way, all necessary and appropriate
15 safeguards to protect the public right-of-way shall be provided.
16 9. All construction in, and use of, the air space over the public right-of-way shall be in
17 compliance with the rules, regulations and requirements established by the Department of
18 Streets of the City of St. Louis.
19 10. Upon completion of the construction of the buildings, structures and related facilities
20 contemplated hereby, the present owners or its successors and assigns shall furnish the City
21 of St. Louis evidence of fire and extended coverage insurance and public liability insurance
22 during the time the air space over the public right-of-way shall be occupied by the
23 aforementioned buildings, structures or related facilities and such policies of insurance shall

1 contain a provision waiving subrogation against the City of St. Louis.
2 SECTION SIX: An affidavit stating that all conditions of this Ordinance have been
3 accepted must be submitted to the Board of Public Service for acceptance Three Hundred
4 Sixty Five (365) days from the date of the signing of this Ordinance. If this affidavit is not
5 submitted within the prescribed time the Ordinance will be null and void.

4 Neighborhood; the 3900-4200 blocks of Evans and the 800-1400 blocks of Pendleton in the
5 Vandeventer/Lewis Place Neighborhoods.
6 BE IT ORDAINED BY THE CITY OF ST. LOUIS, AS FOLLOWS:
7 SECTION ONE. Pursuant to Ordinance Number 70333 as amended by Ordinance Number
8 71394 the Director of Streets is hereby directed to install speed humps to calm the flow of traffic
9 at the following locations:
10 In the Penrose Neighborhood: three speed humps in the 4700 block of Farlin, two more speed
11 humps in the 4700 blocks of Margaretta and Kossuth and, four speed humps in the 4700 blocks
12 of San Francisco and Sacramento . All speed humps will be placed on the five listed streets in
13 the 4700 block between Marcus and Shreve.
14 In the Vandeventer/Lewis Place Neighborhoods: From the 3900 block through the 4200
15 block of Evans located between Vandeventer to the East and North Taylor to the west, place four
16 speed humps on each of the four blocks. From the 800 block of Pendleton through the 1400
17 block of Pendleton located Between Delmar to the South and Dr. Martin Luther King to the
18 north Place three or four speed humps on each of the seven blocks
19 SECTION TWO Emergency Clause. This being an ordinance for the preservation of public
20 peace, health, and safety, it is hereby declared to be an emergency measure within the meaning of
21 Sections 19 and 20 of Article IV of the Charter of the City of St. Louis and therefore shall
22 become effective immediately upon its passage and approval by the Mayor.

6 all vehicles, day and night with the exception of emergency vehicles in the performance of their
7 assigned duties, along Kingshighway Memorial Boulevard, between Dr. Martin Luther King
8 Drive and Bircher Boulevard south of Interstate 70, shall be twenty –five (25) miles per hour.
9 The Director of Streets shall post appropriate signs along Kingshighway Memorial Boulevard
10 between Dr. Martin Luther King Drive and Bircher Blvd south of Interstate 70, to indicate this
11 maximum traffic speed limit.
12 SECTION TWO Emergency clause. This being an ordinance for the preservation of public

11 the foregoing conditionally vacated portion of the street, are reserved to the City of St. Louis for the
12 public including present and future uses of utilities, governmental service entities and franchise
13 holders, except such rights as are specifically abandoned or released herein.
14 SECTION FOUR. The owners of the land may, at their election and expense remove the
15 surface pavement of said so vacated portion of the street provided however, all utilities within the
16 rights-of-way shall not be disturbed or impaired and such work shall be accomplished upon proper
17 City permits.
18 SECTION FIVE. The City, utilities, governmental service entities and franchise holders
19 shall have the right and access to go upon the land and occupation hereof within the rights-of-way
20 for purposes associated with the maintenance, construction or planning of existing or future
21 facilities, being careful not to disrupt or disturb the owners interests more than is reasonably
22 required.

1 SECTION SIX. The owner(s) shall not place any improvement upon, over or in the area(s)
2 vacated without:
3 1. Lawful permit from the Building Division or Authorized City agency as governed
4 by the Board of Public Service.
5 2. Obtaining written consent of the utilities, governmental service entities and franchise
6 holders, present or future. The written consent with the terms and conditions thereof
7 shall be filed in writing with the Board of Public Service by each of the above
8 agencies as needed and approved by such Board prior to construction.
9 SECTION SEVEN. The owners may secure the removal of all or any part of the facilities
10 of a utility, governmental service entity or franchise holder by agreement in writing with such
11 utilities, governmental entity or franchise holder, filed with the Board of Public Service prior to the
12 undertaking of such removal.
13 SECTION EIGHT. In the event that granite curbing or cobblestones are removed within
14 the vacated area, the Department of Streets of the City of St. Louis must be notified. Owner(s) must
15 have curbing cobblestones returned to the Department of Streets in good condition.
16 SECTION NINE. This ordinance shall be ineffective unless within three hundred sixty
17 (360) days after its approval, or such longer time as is fixed by the Board of Public Service not to
18 exceed three (3) days prior to the affidavit submittal date as specified in the last section of this
19 ordinance, the owner(s) of the area to be vacated must fulfill the following monetary requirements,
20 if applicable, as specified by the City of St. Louis Agencies listed below. All monies received will
21 be deposited by these agencies with the Comptroller of the City of St. Louis.

1 1. CITY WATER DIVISION so as to cover the full expenses of removal and/or relocation of
2 Water facilities, if any.
3 2. CITY TRAFFIC AND TRANSPORTATION DIVISION so as to cover the full expenses of
4 removal, relocation and/or purchase of all lighting facilities, if any. All street signs must be
5 returned.
6 3. CITY STREET DEPARTMENT so as to cover the full expenses required for the
7 adjustments of the City's alley(s), sidewalk(s) and street(s) as affected by the vacated area(s)
8 as specified in Sections Two and Eight of the Ordinance.
9 SECTION TEN. An affidavit stating that all of the conditions be submitted to the Director
10 of Streets for review of compliance with conditions 365 days (1 year) from the date of the signing
11 and approval of this ordinance. Once the Director of Streets has verified compliance, the affidavit
12 will be forwarded to the Board of Public Service for acceptance. If this affidavit is not submitted
13 within the prescribed time the ordinance will be null and void.
