WHEATON CITY COUNCIL PROCEEDINGS MONDAY, MARCH 2, 2015 WHEATON CITY HALL, COUNCIL CHAMBERS, 303 W. WESLEY ST., WHEATON, IL 1. CALL TO ORDER AND ROLL CALL The regular Wheaton City Council Meeting was called to order at 7:00 p.m. by Mayor Michael J. Gresk. Upon roll call, the following were: Physically Present: Mayor Michael J. Rose, City Manager Michael G. Dzugan, Assistant City Manager James Knippen, City Attorney Paul G. Redman, Director of Engineering James P. Kozik, Director of Planning & Economic Dev. John M. Duguay, Director of Human Resources Sharon Barrett-Hagen, City Clerk 2. PRESENTATIONS None. 3. CITIZENS TO BE HEARD None. 4. CONSENT AGENDA Councilman Suess moved and Councilwoman Corry seconded that the following action be taken on the Consent Agenda items: 1. Approve the minutes of the February 17, 2015 regular Wheaton City Council Meeting, as submitted. 2. Pass Ordinance No. F-1851, An Ordinance Amending the Official Motor Vehicle and Traffic Schedules (Chapter 70) for the City of Wheaton – Parking Restrictions. 3. Approve Request and Authorize the Issuance of a Special Event Permit to the Downtown Wheaton Association – Celebrate Easter, Celebrate Spring. 4. Approve Request for Bond Waiver and Authorize the Issuance of Raffle License to Jefferson Early Childhood Center PTA. F-1852, AN ORDINANCE AMENDING THE TEXT OF THE WHEATON CITY CODE AND ZONING ORDINANCE – BUILDING HEIGHT/SIDE YARD SETBACK Councilman Scalzo moved and Councilman Rutledge seconded that Ordinance No. F-1852, An Ordinance Amending the Text of the Wheaton City Code and Zoning Ordinance – Building Height/Side Yard Setback, be passed. City Manager Rose stated a public hearing was held regarding maximum building heights and side yard setbacks on February 23, 2015. He stated the ordinance before the Council would implement the modifications discussed and he recommended approval of the ordinance as presented. Roll Call Vote: Ayes: Councilman Scalzo Councilman Suess Councilwoman Corry Councilman Prendiville Councilman Rutledge Mayor Gresk Councilman Saline Nays: None Absent: None Motion Carried Unanimously 6 APPROVE APPOINTMENTS TO CITY BOARDS/COMMISSIONS Mayor Gresk moved and Councilman Prendiville seconded that the appointment of Kevin Illia to the Board of Fire & Police Commissioners and Robert McNeily to the Community Relations Commission, for three year terms respectively, be approved. RECEIVE THE PROCUREMENT OFFICER’S RECOMMENDATION AND APPROVE BID AWARD TO ERA-VALDIVIA CONTRACTORS FOR WATER TOWER PAINTING – MANCHESTER ROAD IN THE AMOUNT OF $786,150 Councilwoman Corry moved and Councilman Scalzo seconded to receive the recommendation from the Procurement Officer and award the bid for the Water Tower Painting – Manchester Road to Era-Valdivia Contractors in the amount of $786,150. City Manager Rose stated Era-Valdivia Contractors submitted the low bid for the project which will come in approximately $14,000 under budget. He recommended awarding the bid for painting of the Manchester Road Water Tower to Era-Valdivia Contractors in the amount of $786,150. Councilman Scalzo asked if the addition of the word “Wheaton” to the west side of the water tower could be incorporated into the bid. City Manager Rose indicated staff would check into that. In response to Councilman Suess, City Manager Rose stated that while the City has not done any work with this particular contractor previously, staff did check their references. Councilwoman Corry questioned when the tower was last painted. City Manager Rose indicated it was approximately 10-15 years ago. RECEIVE PLANNING AND ZONING BOARD REPORT RE #15-02/LOT WIDTH VARIATION/913 NORTH WHEATON AVENUE/CAPSTONE CUSTOM HOMES, LLC AND REFER TO CITY ATTORNEY FOR ORDINANCE PREPARATION Councilman Rutledge moved and Councilman Scalzo seconded that the Planning and Zoning Board Report Re #15-02/Lot Width Variation/913 North Wheaton Avenue/Capstone Customs Homes, LLC be received and the item be referred to the City Attorney for ordinance preparation approving the request. City Manager Rose referenced the memorandum from Staff Planner Tracy Jones discussing the variation requested for the proposed new home. He indicated the lot width is 44 feet rather than the required 50 feet. City Manager Rose stated the Planning & Zoning Board reviewed the request and recommended approval and he recommended the report be received and the item be referred to the City Attorney for an ordinance approving the request. In response to Mayor Gresk, Director of Engineering Redman stated the depressional storage area in the rear yard occurs naturally. Councilman Suess questioned if that depressional area would prevent the construction of a detached garage. Director of Engineering Redman stated that would depend on where the garage was located. Council Proceedings March 2, 2015 / Page 4 Mr. Ernie Siefert, Jr., Capstone Custom Homes, 211 E. Illinois Street, stated they reviewed options for the garage placement but due to the high water level of 755.2 feet and the depressional storage area, they could not locate a garage in the rear yard. He indicated many of the lots on the entire block have a similar depressional storage area in the rear yard. COUNCIL COMMENT Councilman Suess stated that the governor has proposed reducing the municipalities’ share of the state income tax by 50%, resulting in a potential $2.6M shortfall for the City of Wheaton. He indicated the Council needs to ensure the community understands the magnitude and impact this proposed reduction in funds would have on the City. Councilman Rutledge thanked the two individuals appointed to City Boards and Commissions for volunteering their time. 10. APPROVAL OF WARRANT Councilman Suess moved and Councilman Saline seconded that Warrant No. 651 in the amount of $1,309,430.23 be approved.
