WHEATON CITY COUNCIL PROCEEDINGS MONDAY, DECEMBER 4, 2017 WHEATON CITY HALL, COUNCIL CHAMBERS, 303 W. WESLEY ST., WHEATON, IL 1. CALL TO ORDER AND ROLL CALL The regular Wheaton City Council Meeting was called to order at 7:00 p.m. by Mayor Michael J. Gresk. Upon roll call, the following were: Physically Present: Mayor Michael J. Gresk Councilman Michael Barbier Councilwoman Suzanne Fitch Councilman John Prendiville Councilman John Rutledge Councilman Todd Scalzo Absent: Councilman Phil Suess City Staff Present: Michael G. PRESENTATIONS Mayor Gresk announced that, for the 16th year, the City has received the Distinguished Budget Presentation Award. He congratulated Finance Director Lehnhardt and the Finance staff for their excellent work. 3. CITIZENS TO BE HEARD None. 4. CONSENT AGENDA Councilman Rutledge moved and Councilman Prendiville seconded that the following action be taken on the Consent Agenda items: 1. Approve the Minutes of the November 20, 2017 regular Wheaton City Council Meeting, as submitted. 2. Adopt Resolution R-119-17, A Resolution Authorizing the Release of Closed Session Minutes 3. Adopt Resolution R-120-17, A Resolution Authorizing the Destruction of Audio or Video Recording of Closed Session Minutes. 4. Adopt Resolution R-121-17, A Resolution Accepting the As-Construction Public Improvements for Courthouse Square Redevelopment Project (Mid-Rise Apartment Building). PASS ORDINANCE NO. F-2046, AN ORDINANCE AMENDING AN ORDINANCE AMENDING CHAPTER 2, “ADMINISTRATION,” ARTICLE VI, “PERSONNEL” OF THE WHEATON CITY CODE, TO ESTABLISH AN ADMINISTRATIVE PROCEDURE FOR ASSESSING AND DETERMINING CLAIMS UNDER THE PUBLIC SAFETY EMPLOYEE BENEFITS ACT Councilman Prendiville moved and Councilwoman Fitch seconded that Ordinance No. F-2046, An Ordinance Amending an Ordinance Amending Chapter 2, “Administration,” Article VI, “Personnel” of the Wheaton City Code, to Establish an Administrative Procedure for Assessing and Determining Claims Under the Public Safety Employee Benefits Act, be passed. City Manager Dzugan stated this ordinance was on the November 20, 2017 Council agenda for a first reading. He indicated the ordinance amends Chapter 2 of the City Code to create a procedure for assessing and determining claims under the Public Safety Employee Benefits Act. City Manager Dzugan advised that a modification was made to the ordinance following the November 20 meeting to address police or fire chiefs who may not fall under the City’s Police or Fire Pension Boards. PASS ORDINANCE NO. F-2047, AN ORDINANCE AMENDING THE ORIGINAL AND SUBSEQUENT AMENDED ORDINANCES REGARDING PHASE FIVE OF THE TOWNHOME PORTION OF THE COURTHOUSE SQUARE PROJECT – PATIO WALL AND LANDSCAPING Councilwoman Fitch moved and Councilman Rutledge seconded that Ordinance No. F-2047, An Ordinance Amending the Original and Subsequent Amended Ordinances Regarding Phase Five of the Townhome Portion of the Courthouse Square Project – Patio Wall and Landscaping, be passed. City Manager Dzugan stated the ordinance before the Council would amend the Courthouse Square PUD to allow an increase in the height of the privacy brick wall from 3.5 to 4.5 feet along Washington Street. ADOPT RESOLUTION R-122-17, A RESOLUTION AUTHORIZING THE EXECUTION OF AN AGREEMENT WITH e.NORMAN SECURITY SYSTEMS, INC. FOR SECURITY UPGRADE Councilman Scalzo moved and Councilman Barbier seconded that Resolution R-122-17, A Resolution Authorizing the Execution of an Agreement with e.Norman Security Systems, Inc. for Security Upgrade, be adopted. City Manager Dzugan stated the Procurement Officer has recommended a bid waiver and approval of a resolution authorizing an agreement with e.Norman Security Systems to provide system upgrades at the City’s three fire stations at a total cost of $49,608.55. He indicated the current budget includes $37,000 for this work and stated there are funds available to cover the difference in cost. FIRST READING OF AN ORDINANCE LEVYING TAXES FOR GENERAL AND SPECIAL CORPORATE PURPOSES FOR THE CURRENT FISCAL YEAR COMMENDING ON THE FIRST DAY OF MAY 2017 AND ENDING ON THE THIRTIETH DAY OF APRIL 2018 FOR THE CITY OF WHEATON, ILLINOIS City Manager Dzugan advised that the next eight items relate to the City’s property tax levy for general corporate and debt service purposes, as well as the City’s three special service areas. He indicated this ordinance is on the agenda for a first reading and will return for formal action at the December 18, 2017 meeting. City Manager Dzugan stated that at the November 27, 2017 Planning Session, the Council discussed the 2017 levy and considered four options and focused on two of the options; option one would capture growth and option four would increase the levy by $297,454, a 1.5% increase which would also include revenue for pensions, an increase in the library budget, as well as capture growth. This proposed ordinance is based on option one, which would increase the levy by $117,672, which only captures growth and results in no increase in property taxes paid by property owners. Mr. Joe Mahaty, 1133 Wheaton Oaks Court, stated that the previous levy increased taxes 9.1% or over $1.8MM based on the City’s financial reports. He feels that the City should do more to decrease spending rather than increase the levy. 9. FIRST READING OF AN ORDINANCE AMENDING THE 2017 TAX LEVY CONTAINED IN ORDINANCE NO. F – City Manager Dzugan stated this ordinance is on the agenda for first readings and will be considered for formal action at the December 18, 2017 meeting. 10. FIRST READING OF AN ORDINANCE FOR THE LEVY AND ASSESSMENT OF TAXES FOR THE FISCAL YEAR BEGINNING MAY 1, 2017 AND ENDING APRIL 30, 2018 IN AND FOR THE CITY OF WHEATON SPECIAL SERVICE AREA NUMBER TWO City Manager Dzugan stated Special Service Area Number Two covers central business district parking enforcement and the levy is proposed to be $39,000. He indicated this ordinance is on the agenda for first readings and will be considered for formal action at the December 18, 2017 meeting. Council Proceedings December 4, 2017/ Page 4 11. FIRST READING OF AN ORDINANCE MAKING APPROPRIATIONS FOR THE CITY OF WHEATON SPECIAL SERVICE AREA NUMBER TWO FOR THE FISCAL YEAR BEGINNING MAY 1, 2017 AND ENDING APRIL 30, 2018. City Manager Dzugan stated this ordinance is on the agenda for first readings and will be considered for formal action at the December 18, 2017 meeting. 12. FIRST READING OF AN ORDINANCE FOR THE LEVY AND ASSESSMENT OF TAXES FOR THE FISCAL YEAR BEGINNING MAY 1, 2017 AND ENDING APRIL 30, 2018 IN AND FOR THE CITY OF WHEATON SPECIAL SERVICE AREA NUMBER THREE City Manager Dzugan stated Special Service Area Number Three maintains The Streams subdivision with a proposed levy of $12,000. He stated this ordinance is on the agenda for first readings and will be considered for formal action at the December 18, 2017 meeting. 13. FIRST READING OF AN ORDINANCE MAKING APPROPRIATIONS FOR THE CITY OF WHEATON SPECIAL SERVICE AREA NUMBER THREE FOR THE FISCAL YEAR BEGINNING MAY 1, 2017 AND ENDING APRIL 30, 2018. City Manager Dzugan stated this ordinance is on the agenda for first readings and will be considered for formal action at the December 18, 2017 meeting. 14. FIRST READING OF AN ORDINANCE FOR THE LEVY AND ASSESSMENT OF TAXES FOR THE FISCAL YEAR BEGINNING MAY 1, 2017 AND ENDING APRIL 30, 2018 IN AND FOR THE CITY OF WHEATON SPECIAL SERVICE AREA NUMBER SEVEN City Manager Dzugan stated Special Service Area Number Seven covers central business district promotional and management services with a proposed levy of $109,256.71. He advised this ordinance is on the agenda for first readings and will be considered for formal action at the December 18, 2017 meeting. 15. FIRST READING OF AN ORDINANCE MAKING APPROPRIATIONS FOR THE CITY OF WHEATON SPECIAL SERVICE AREA NUMBER SEVEN FOR THE FISCAL YEAR BEGINNING MAY 1, 2017 AND ENDING APRIL 30, 2018. City Manager Dzugan stated this ordinance is on the agenda for first readings and will be considered for formal action at the December 18, 2017 meeting. 16. COUNCIL COMMENT None. 17. APPROVAL OF WARRANT Councilman Scalzo moved and Councilman Prendiville seconded that Warrant No. 717 in the amount of $5,851,787.61 be approved. CLOSED SESSION Councilman Rutledge moved and Councilman Prendiville seconded that the Wheaton City Council adjourn to closed session at 7:17 p.m. for the purpose of discussion Pending Litigation 5 ILCS 120/2(c)(11). Council Proceedings December 4, 2017/ Page 5 Mayor Gresk indicated that no action would be taken after the Closed Session and announced that this would conclude the broadcast portion of the meeting.
