Monday, June 1, 2020 1. Call to Order and Roll Call The regular Wheaton City Council Meeting was called to order at 7:00 p.m. by Mayor Philip J. Suess. Upon roll call, the following were: Electronically Present: Mayor Suess Councilman Barbier Councilwoman Bray-Parker Councilwoman Fitch Councilwoman Robbins Councilman Rutledge Councilman Zaruba Absent: None City Staff Electronically Present: Michael G. Dzugan, City Manager John M. Duguay, Assistant City Manager James Knippen, City Attorney James P. Kozik, Director of Planning & Economic Development Joseph Tebrugge, Director of Engineering William Murphy, Police Chief William Schultz, Fire Chief/Director of Building & Code Enforcement Susan Bishel, Public Information Officer Sharon Barrett-Hagen, City Clerk 2. Report of the City Manager City Manager Dzugan announced City facilities will be opening based on Phase 3 guidelines around the middle of June after all safety measures are in place. He asked Police Chief Murphy to update the Council regarding demonstrations taking place over the past few days. Police Chief Murphy stated over the past 24 hours, due to the events in Minnesota, groups have been protesting in neighboring communities, prompting greater response from the Wheaton Police Department with more officers on the street. He stated certain stores such as Target and cell phone stores have been targeted, and those stores in Wheaton closed voluntarily. Chief Murphy stated protests had taken place in Aurora, Naperville, Glendale Heights and Carol Stream, with one taking place in Wheaton that was peaceful. He stated more marches are planned in Wheaton. In response to Councilwoman Bray-Parker, Chief Murphy stated he is working with the Public Information Officer on the best way to notify businesses and residents. He feels it would be best to post notifications when there is something relevant to say. In response to Councilman Rutledge, Chief Murphy indicated several Wheaton police officers are members of the Multi Jurisdiction Task Force which has been activated and which has been in communication with the Wheaton Police Department. WHEATON CITY COUNCIL PROCEEDINGS June 1, 2020 Mayor Suess stated updates were posted on the City’s website today and additional information will be posted as it becomes available. Public Information Officer Bishel advised the initial posting was seen by just under 50,000 people. 3. Citizens to Be Heard None. 4. Consent Agenda Councilman Barbier moved and Councilwoman Robbins seconded that the following action be taken on the Consent Agenda items: 1. Approve the minutes of the May 18, 2020 regular Wheaton City Council meeting as submitted. 2. Adopt Resolution R-2020-46, A Resolution Authorizing the Disposal of Certain Surplus Property (PD). 3. Adopt Resolution R-2020-47, A Resolution Approving the Plat of 610 Crest Street Consolidation. 4. Adopt Resolution R-2020-48, A Resolution Authorizing the Execution of a Certain Construction, Use, and Indemnification Agreement (55 Somerset Circle) Roll Call Vote on Consent Agenda: Ayes: Councilman Barbier Councilwoman Bray-Parker Councilwoman Fitch Mayor Suess Councilwoman Robbins Councilman Rutledge Councilman Zaruba Nays: None Absent: None Motion Carried Unanimously 5. Pass Ordinance No. O-2020-22, An Ordinance Repealing and Amending Certain Sections of Chapter 10, “Special Events, Amusements and Entertainments,” and Appendix B, “Fee Schedule” of the Wheaton City Code Councilman Rutledge moved and Councilman Zaruba seconded that Ordinance No. O-2020-22, An Ordinance Repealing and Amending Certain Sections of Chapter 10, “Special Events, Amusements and Entertainments,” and Appendix B, “Fee Schedule” of the Wheaton City Code, be passed. City Manager Dzugan advised a first reading was held for this ordinance at the Council’s May 18 meeting. He stated staff has recommended certain amendments after working with the new regulations for about a year and after consultation with the School District and Park District. Pass Ordinance O-2020-23, An Ordinance Approving the Extension of the Emergency Order of the Mayor of the City of Wheaton Suspending Enforcement of Portions of the City’s Zoning Ordinance and Liquor Control Ordinance Based Upon the Economic Impacts of the COVID-19 Pandemic Councilwoman Fitch moved and Councilwoman Bray-Parker seconded that Ordinance O-2020-23, An Ordinance Approving the Extension of the Emergency Order of the Mayor of the City of Wheaton Suspending Enforcement of Portions of the City’s Zoning Ordinance and Liquor Control Ordinance Based Upon the Economic Impacts of the COVID-19 Pandemic, be passed. City Manager Dzugan stated the Mayor issued a declaration of emergency and signed an executive order last week suspending certain provisions of the City’s Zoning Ordinance and Liquor Code to permit outdoor dining on Hale Street and other locations. He stated the proposed ordinance would not extend the emergency declaration but would only extend the executive order. Councilman Rutledge questioned the term of the executive order. City Attorney Knippen responded that the executive order would remain in effect until Governor Pritzker removes restrictions on business operations or upon repeal of the ordinance by the City Council. Councilwoman Fitch and Councilman Barbier both indicated they feel the ordinance provides the City with flexibility. Council Comment Mayor Suess expressed his appreciation to the City and the DWA for their efforts in the roll out of the Governor’s Phase 3 plan. He said he heard a lot of compliments about the availability of outdoor dining and feels the community appreciated an opportunity to get out. 3 WHEATON CITY COUNCIL PROCEEDINGS June 1, 2020 8. Approval of Warrant Councilman Rutledge moved and Councilwoman Fitch seconded that Warrant No. 777 in the amount of $1,169,972.82, be approved. Adjournment Councilwoman Fitch moved and Councilwoman Robbins seconded that the regular Wheaton City Council Meeting be adjourned at 7:16 p.m. The meeting was adjourned by unanimous voice vote.
