The regular Wheaton City Council Meeting was called to order at 7:00 p.m. by Mayor Philip J. Suess. Upon
roll call, the following were:

2. Citizensto be Heard
Chuck Smith, ON236 Woodland Dr., Chairman of Milton Township Seniors & Law Enforcement Together
expressed tax and safety concerns for senior citizen residents related to the proposed Cosley Zoo parking
lot and expansion.
Liz Westergaard, 742 Ralph Ct., expressed communication concerns related to the Wheaton Park District
board, administration and Cosley Foundation. She provided the Council a copy of her statement along
with copies of letters to the Wheaton Park District board, administration and Cosley Foundation.
John Patterson, 1849 N. Cherry St., expressed concerns regarding the Cosley Zoo expansion related to
park district taxes, park district communication, and conflict of interest. He asked Council to have an open
dialogue with residents to keep Cosley a neighborhood Zoo.

3. Consent Agenda

Councilman Barbier moved and Councilwoman Robbins seconded that the following action be taken on
the Consent Agenda items:
1. Approve the minutes of Wheaton City Council Public Hearings - November 27, 2023 and
December 11, 2023 and Regular Meeting - November 20, 2023, as submitted.
2. Pass Ordinance 0-2023-50, An Ordinance Amending the Official Motor Vehicle and Traffic
Schedules (Chapter 70) for the City of Wheaton - Cherry Street.
3. Adopt Resolution R-2023-106, A Resolution Approving a Plat of Easement Grant St Francis High
School.

4. Pass Ordinance 0-2023-51, An Ordinance Adopting the City of Wheaton Calendar Year 2024
Budget
Councilwoman Robbins moved and Councilman Clousing seconded that 0-2023-51, An Ordinance
Adopting the City of Wheaton Calendar Year 2024 Budget, be passed.
City Manager Dzugan stated the Council held a public hearing December 11, 2023. He expressed gratitude
to City staff for their involvement in the preparation and presentation of the draft budget to the Council.

5. Pass Ordinance 0-2023-52, An Ordinance Levying Taxes for General and Special Corporate
Purposes for the Fiscal Year Beginning January 1, 2024 and Ending December 31, 2024 for the City of
Wheaton, lllinois
Councilman Weller moved and Councilman Brown seconded that 0-2023-52, An Ordinance Levying Taxes
for General and Special Corporate Purposes for the Fiscal Year Beginning January 1, 2024 and Ending
December 31, 2024 for the City of Wheaton, lllinois, be passed.
City Manager Dzugan stated truth in taxation public hearings were held on November 27, 2023 for the
general purpose and SSA 8 levies. He detailed the next three ordinances had first readings at the
December4, 2023 Council meeting.
In response to resident John Patterson, 1849 N. Cherry St., City Manager Dzugan confirmed the City of
Wheaton has not had a levy increase for the 5 year in a row.
Councilwoman Robbins expressed appreciation for the level of detail provided by staff.
Mayor Suess credited the Council and City of Wheaton staff for accomplishing more projects than ever
before on a $120 million budget with approximately 25% towards capital improvement projects.

Councilwoman Bray-Parker moved and Councilman Barbier seconded that R-2023-107, A Resolution
Authorizing the Execution of Agreement No. 429 with Viking Brothers, Inc. for Aggregate Materials to be
Purchased on an As Needed Basis at the Price PerTon Set Forth in Viking Brothers, Inc.'s Cost Proposal,
be adopted.
City Manager Dzugan stated the City received five bids for several types of aggregate materials used for a
variety of repairs performed by the City. He detailed based upon history, the quantities listed in the memo
would likely be needed for next year.

10. Adopt Resolution R-2023-108, A Resolution Authorizing the Execution of a Side Letter Agreement
Between the City of Wheaton and the Wheaton Place Condominium Association Relating to
Maintenance Responsibilities for the Wheaton Place Garage
Councilman Brown moved and Councilman Clousing seconded that R-2023-108, A Resolution Authorizing
the Execution of a Side Letter Agreement Between the City of Wheaton and the Wheaton Place
Condominium Association Relating to Maintenance Responsibilities for the Wheaton Place Garage, be
adopted.
City Manager Dzugan stated due to conflicting language within various agreements, staffworked with the
Association to prepare a side letter agreement to clarify the Association's responsibility towards funding
the cost of repairs and maintenance. He detailed the Association owns 14.5% of the garage providing
private parking for individual condo units.
In response to Councilman Barbier, City Attorney Didier confirmed the existing agreements remain in
effect and the side letter clarifies the content ofthose agreements.

11. Pass Ordinance 0-2023-55, An Ordinance Approving a Water Purchase and Sale Contract Between
the DuPage Water Commission and Contract Customers
Councilwoman Robbins moved and Councilman Brown seconded that 0-2023-55, An Ordinance
Approving a Water Purchase and Sale Contract Between the DuPage Water Commission and Contract
Customers, be passed.
City Manager Dzugan stated the next two items relate to the February 2024 expiration of agreements
between the City and DuPage Water Commission. He detailed the language in the documents has been
agreed upon by all Commission municipalities which approves the water purchase and sale contract. hle
further added the resolution approves the extension of the water supply contract between the
Commission and city of Chicago, He stated staff is finalizing the wheeling agreement with American Water
and the Commission, which allows the City to supply water to unincorporated Arrowhead Subdivision.

12. Adopt Resolution R-2023-109, A Resolution Approving an Extension of the Water Supply Contract
Between the DuPage Water Commission and the City of Chicago
Councilman Barbier moved and Councilwoman Bray-Parker seconded that R-2023-109, A Resolution
Approving an Extension of the Water Supply Contract Between the DuPage Water Commission and the
City of Chicago, be adopted.
In response to Robert Stozek, 1130 Champion Forest, Mayor Suess confirmed the agreement does not
include water rates which are determined by the City of Chicago. hle detailed the City of Wheaton is
charged the same rate as a resident of Chicago in addition to the cost to transport the water. He stated
the contract with the City of Chicago allows for an increased rate of inflation or up to 5%.

13. Council Comment
Councilwoman Bray-Parker wished residents happy holidays.
Mayor Suess expressed gratitude to his colleagues on the Council, City Staff, and the Boards and
Commission members for their work in serving the residents of Wheaton. hle wished everyone a Merry
Christmas and Happy New Year.
14. Approval ofWarrant
Councilman Barbier moved and Councilwoman Bray-Parker seconded that Warrant No. 862 in the amount
of $6,889,546.59 be approved.
