Pass Ordinance 0-2026-08, An Ordinance Amending the Code of Ordinances of the City of Wheaton Chapter 70 (Traffic and Vehicles), Article IV (Stopping, Standing and Parking), and Motor Vehicie and Traffic Schedules VI and VIII Councilman Brown moved and Councilman Ciousing seconded that 0-2026—08, An Ordinance Amending the Code of Ordinances of the City of Wheaton Chapter 7O (Traffic and Vehicles), Article IV (Stopping, Standing and Parking), and MotorVehicle and Traffic Schedules Vi and VIII, be passed. City Manager Dzugan stated the Ordinance had a first reading on February 2, 2026, and aims to correct some errors, address certain exclusions, and modify signage for the City's Blue Dot parking restrictions. He added the Ordinance also adjusts the on—street parking limit from 4 hours to 2 hours in the area surrounding the Faywell construction site to mitigate excessive parking by construction workers. He noted that based on feedback, the applicable days have been changed from Monday through Saturday to Monday through Friday since the first reading. He advised that staff will monitor the situation and make adjustments if necessary. Pass Ordinance 0-2026-09, An Ordinance Granting a Rear Yard Setback Variation to Allow the Construction and Use of a New Deck, on a Certain Piece of Property Commonly Known as 87 Somerset Circle - Nowakowski Councilman Clousing moved and Councilman Weller seconded that O-2026—09, An Ordinance Granting a Rear Yard Setback Variation to Allow the Construction and Use of a New Deck, on a Certain Piece of Property Commonly Known as 87 Somerset Circle — Nowakowski, be passed. City Manager Dzugan reported at the City Council meeting on February 2, 2026, the City Council had instructed the City Attorney to draft an ordinance approving a rear yard setback variation for a new WHEATON CITY COUNCIL PROCEEDINGS Tuesday, February 17, 2026 deck. He noted the approved setback would be reduced from the required 25 feet to 23.1 feet at the south and 23.75 feet at the north. Receive Planning & Zoning Board Report Re: ZA #26-03/ Special Use Permit/ 510 Irving Avenue/ Wheaton College Councilwoman Brice moved and Councilman Brown seconded that Planning & Zoning Board Report Re: ZA #26-03/ Special Use Permit/ 510 lrving Avenue/ Wheaton College, be received. City Manager Dzugan stated the report from the Planning and Zoning Board unanimously recommended approval of a special use permit request from Wheaton College to allow the construction of a l-story addition on the north side and a 3-story addition on the south side of the existing college library. He confirmed the ordinance approves the special use permit and the demolition of a portion of the existing library. City Manager Dzugan reported that the Planning and Zoning Board recommended approval of an amendment to the Rice Lake Square PUD for a l-story, 900 square foot coffee stand with a special use permit for drive—thru sales. He detailed the recommendation consists of five conditions, such as no queuing on East Loop Road. He advised Staff concurs with the recommendation and requests a revised Drive Through Overflow Plan outlining specific actions tied to defined queuing thresholds. He clarified that either the Police Department or Public Works may enforce traffic rules and fine Seven Brew for violations. City Attorney Didier advised that the City may include language in the Ordinance allowing for the revocation ofthe Special Use Permit if violations continued. in response to Mayor Suess, Chris George, VP of Development for Who Brew LLC, a franchisee of Seven Brew, and Brendan May, Traffic Engineer for KLOA advised the traffic generated by traffic going into Seven Brew would not result in an impact to the queuing exiting Seven Brew. They advised the drive, in front of Studio Movie Grill, is underutilized compared to the southern one. City Manager Dzugan stated that the City wants to review the site plan again to ensure the tiered queuing approach does not cause traffic backups at the exit. In response to Councilman Clousing, Mr. George advised the property owner modified the boundaries of the site plan to expand for a larger queue, which Studio Movie Grill also signed off on, to permit the expansion of the lease premise area. Roosevelt Road/ Mister Car Wash WHEATON CITY COUNCIL PROCEEDINGS Tuesday, February 17, 2026 Councilwoman Bray~Parker moved and Councilman Clousing seconded that Planning & Zoning Board Report Re: 25-25/ Special Use Permit/ 2175 W. Roosevelt Road/ Mister Car Wash, be received. City Manager Dzugan stated the report from the Planning and Zoning Board recommends approval of an application for a special use permit to allow a car wash located on the former McDonald’s site on Roosevelt Road. He advised the Board’s recommendation contained 7 conditions. Roosevelt Road/ Mister Car Wash Councilman Brown moved and Councilwoman Robbins seconded a Motion to Direct the City Attorney to prepare an Ordinance to Deny ZA #25-25/ Special Use Permit/ 2175 W. Roosevelt Road/ Mister Car Wash. Peter Galzki, Development Managerfrom Mister Car Wash, addressed the Council regarding the proposed car wash development. He stated the applicant has worked with City staff to revise the site plan, including efforts to accommodate a potential future right—of—way acquisition by the lllinois Department of Transportation (IDOT). He noted IDOT is in Phase ii engineering but has not established a timeline for the right-of—way acquisition due to ongoing issues. He noted that the current proposal complies with all existing City bulk and setback regulations and meets six ofthe seven Special Use Permit (SUP) conditions, with disagreement remaining regarding landscaping requirements. Mayor Suess expressed the City anticipates the road widening project and advised the development should account for the future setback. He indicated that the Council had anticipated a plan conforming to the anticipated right~of-way. Chris Campbell, Director of Development for Mister Car Wash, stated that the City is attempting to hold the project to an unenforceable future standard without a defined right-of-way line. He emphasized that the proposal complies with all current ordinances and argued it would be improper to require compliance with speculative future setbacks. He further noted that if a future right-of-way acquisition rendered the site nonconforming, it would become a legally nonconforming use at that time. Councilman Brown stated he would vote against the proposal regardless of compliance, citing concerns about market saturation of car washes in the community and stated as an elected official he represents the voice of his constituents with a preference for a different use on that site. WHEATON CITY COUNCIL PROCEEDINGS Tuesday, February 17, 2026 Councilwoman Brice raised concerns about the risk of approving the project without certainty regarding the extent of IDOT’s potentiai taking and questioned how a significant right-of—way acquisition would affect the site’s viability. George Weems, Attorney for Mister Car Wash, responded that if IDOT’s acquisition eliminated the property’s economic use, IDOT could pursue a full taking through eminent domain. Councilwoman Bray-Parker and City Manager Dzugan discussed the motion and Staff’s request. City Manager Dzugan clarified that the motion before Council was to prepare an ordinance denying the request. He noted that if denied, the applicant could submit a revised proposal in the future once IDOT finalizes right-of—way plans. Adopt Resolution R-2026-10, A Resolution Authorizing the Execution of Change Order #1 to Agreement No. 455 with Thomas Engineering Group, LLC for Phase 3 Construction Engineering Services for the Gary Avenue Reconstruction Project for a Total Amount Not to Exceed $124,742 and a Total Award of $649,707 Councilman Clousing moved and Councilwoman Brice seconded that R-2026—10, A Resolution Authorizing the Execution of Change Order #1 to Agreement No. 455 with Thomas Engineering Group, LLC for Phase 3 Construction Engineering Services for the Gary Avenue Reconstruction Project for a Total Amount Not to Exceed $124,742 and a Total Award of $649,707, be adopted. City Manager Dzugan stated a Change Order was submitted by Thomas Engineering due to the delays encountered in the Gary Avenue reconstruction project. He confirmed 70% ofthe $124,742 would be paid for by federal funds administered by the DuPage Mayors and Managers Conference. He confirmed the greatest delay was due to AT&T. in response to Councilwoman Bray—Parker, Director Tebrugge advised the project is currently in winter shutdown with the State, as it is a State contract. He noted the contractor is expected to be back up and running within the next week, weather permitting. DirectorTebrugge advised the lights are delayed due to ComEd and are scheduled to be energized within the next two weeks. Adopt Resolution R-2026-11, A Resolution Authorizing the Purchase of One (1) 2026 Dodge Ram Pickup Truck from Bob Ridings, Inc. for a Total Amount Not to Exceed $40,493 Councilwoman Robbins moved and Councilwoman Brice seconded that R—2026—11, A Resolution Authorizing the Purchase of One (1) 2026 Dodge Ram Pickup Truck from Bob Ridings, inc. for a Total Amount Not to Exceed $40,493, be adopted. City Manager Dzugan reported that staff found a cheaper price for the vehicle by buying directly from Bob Ridings, inc. He noted that since formal bidding was not used, the Council must waive competitive bidding requirements, requiring five votes. in response to Councilman Weller, Superintendent Webb stated the switch from a minivan to a pickup truck is to better suit the needs of the Police Department. He advised the pickup truck is also less expensive than a minivan as well. City Manager Dzugan noted the city received eight proposals from engineering firms to design the 2026 Fall Sidewalk Program.
