3. Presentation
Chief Brill presided over the swearing-in ceremonies of Lieutenant Anthony Tabb and Candidate Firefighter
Geno Lukowski. City Clerk Rosedale administered the oaths of Lieutenant Tabb and Candidate Fire Fighter
Lukowski followed by the pinning of badges by family members.
4. Citizens to be Heard
Michael Grafer, 4575 Morton Rd., Hanover Park, expressed concerns regarding the Fl0ck Safety renewal,
pertaining to the automatic renewal, and data security concerns.
Greg Hintz, ON409 Morse St., Wheaton, expressed concerns regarding the Flock Safety contract noting false
positives and encroachment on the public’s freedom to move through the country.
5. Consent Agenda
Councilwoman Robbins moved and Councilman Brown seconded that the following action be taken on the
Consent Agenda items:
1. Approve the Minutes ofthe Wheaton City Council Regular Meeting — March 16, 2026, as submitted.
2. Resolution R-2026—24, A Resolution Authorizing the Execution of an Amendment to Exhibit C to the
License Agreement with Wheaton Park District/Memorial Park (Wheaton Municipal Band), be
adopted.
3. Resolution R-2026-25, A Resolution Authorizing the Execution of an lntergovernmental Agreement
Between the County of DuPage and the City of Wheaton for Mowing along County Roads and
Rights—of—Way, be adopted.
4. Resolution R-2026-26, A Resolution Authorizing the Disposal of Certain Surplus Property (lT), be

6. Pass Ordinance 0-2026-18, An Ordinance Amending the Code of Ordinances of the City of Wheaton
Chapter 70 (Traffic and Vehicles), Article VI (Bicycles)
Councilman Weller moved and Councilwoman Brice seconded that 0-2026-18, An Ordinance Amending the
Code of Ordinances of the City of Wheaton Chapter 7O (Traffic and Vehicles), Article Vi (Bicycles), be passed.
City Manager Dzugan said the Council reviewed the ordinance on March 16, which focuses on problematic
out—of—ciass e—bike devices. He explained that staff will monitor H.B. 4840 in the state legislature and update
the ordinance if necessary to comply with future regulations.
Bob Van Valzah, Chair of the Bicyclist and Pedestrian Commission, voiced support for the ordinance and
thanked those involved in its development. He stated the Commission is ready to work with staff on safe
implementation and public awareness.

reappointments: Jennifer Laird to the Commission on Aging; Jeff Gissing, Nathan Swartz, Rita Nathanson, and
William Nieman to the Bicyclist and Pedestrian Commission; Brian Malone to the Environmental
improvement Commission (all for three~year terms ending April 6, 2029); and Nicole Aranas as Chair and
Benjamin Blume to the Planning and Zoning Board (five—year terms ending April 6, 2031).

City Manager Dzugan reported that the Planning and Zoning Board recommends approving an amendment
to a special use permit, rezoning, and a subdivision variation to allow the partial demolition of the church for
an addition and new parking lot. He detailed the approval also covers demolishing three homes on Pershing,
rezoning, and consolidating the properties into one parcel. He noted four conditions were included in the
Board's recommendation.

10. Receive Planning & Zoning Report ZA #26-09/ PUD Amendment/ 703 and 705 W. Liberty Drive/
DuPage PADS
Councilman Weller moved and Councilwoman Brice seconded that Planning & Zoning Report ZA #26—09/ PUD
Amendment/ 703 and 705 W. Liberty Drive/ DuPage PADS, be received.
City Manager Dzugan explained that the Planning and Zoning Board had recommended approving an
amendment to the existing Planned Unit Development, which would allow PADS Day Shelter on Liberty Drive
to operate 24 hours. He noted the recommendation included six conditions. He also mentioned that both the
Board and staff were concerned about people who are brought to the shelter but denied entry, as they may
be left without assistance.

President and CEO of DuPage PADS April Redzik, 601 W. Liberty Drive, responded to Councilwoman Robbins
and advised that DuPage PADS operates an access center that remained open during the winter to provide
overnight shelter for adults offering 15 seats for those in need. She advised the center serves as an alternative
to police lobbies, emergency rooms, or train stations to help people stay safe from the elements.
in response to Councilwoman Robbins, Ms. Rezik confirmed individuals are free to make their own choices
regardless of the services offered and may be released at their own will into the neighborhood and
downtown. Ms. Rezik advised that upon arrival, individuals are screened to determine if they qualify for
interim housing or if transportation should be provided to their area of origin. She noted medical assistance
is available to those with health concerns. She confirmed adults may leave the facility at any time and are
offered resources such as bus or train cards.
Councilwoman Robbins advised of resident and business concerns pertaining to individuals who choose to
refuse services and leave the center and how that may impact the surrounding neighborhood and businesses.
Councilwoman Robbins noted the increase in calls to the Wheaton Police and emergency services.
Councilwoman Robbins inquired how many individuals are repeat clients. Ms. Rezik noted that of 186
overnight cases, 180 were resolved successfully with services. She advised their staff works with the VA and
health department as well to find services.
Ms. Rezik advised a one-time grant from DuPage County was received. She confirmed expansion to a summer
cooling center is under consideration, pending future funding. She reported that the center prioritizes
operations during periods of extreme cold.
Ms. Rezik expressed gratitude to the City, Police Department and Fire Department for their support and
partnership over the past 4O years.

11. Adopt Resolution R-2026-28, A Resolution Authorizing the Extension of the Lease with Flock Safety
to Provide Automated License Plate Recognition Cameras in an Amount Not to Exceed $122,000
Councilman Brown moved and Councilman Clousing seconded that R-2026-28, A Resolution Authorizing the
Extension of the Lease with Flock Safety to Provide Automated License Plate Recognition Cameras in an
Amount Not to Exceed $122,000, be adopted.
City Manager Dzugan reported that the Chief of Police recommended a 12-month extension of the City’s
lease with Flock Safety for 44 ALPR cameras, funded by a $122,000 grant from the Illinois Attorney General’s
Organized Retail Crime Task Force. He stated if future grant funding ends, the number of cameras will be
reconsidered. He highlighted the Chief’s memo outlines program successes and strict data security policies.
Chief Youker highlighted the Flock program’s success. He advises data security is important noting Flock is
compliant with Criminal Justice Information System (CJIS) standards and includes strong encryption and
internal controls to prevent misuse, with disciplinary measures in place for violations.
He advised the automatic renewal procedures do not impact the ability to terminate the agreement,
especially if funding changes or alternative technologies are considered. He noted the grant requires annual
application and is designated for specific usage and advised reductions in funding would necessitate
negotiation to scale back services, such as reducing the number of cameras. He advised of a termination
clause that allows ending the service if desired.
Sam Wilson, 1000 Manchester Rd., Wheaton, urged the Council to reject the Flock contract citing several
concerns pertaining to the inaccuracy ofALPR Systems, cybersecurity vulnerabilities, system abuse, searching
and tracking of individuals without sufficient oversite, infringement of constitutional rights by the collection
of data of thousands of people without warrants.
Chief Youker advised that the Wheaton Police Department adheres to the TRUST Act, which revokes access
to certain agencies.
City Attorney Didier advised the system doesn’t search the records of individuals when a plate is read.
in response to Councilwoman Bray-Parker, Chief Youker confirmed that law enforcement officers go through
a confirmation process before taking enforcement action.
in response to Councilwoman Brice, Chief Youker advised a record is not created until a law enforcement
officer does an inquiry on a specific plate. He advised ofthe FOIA exemption that prohibits the release of any
data or information gathered by Flock.

12. Adopt Resolution R-2026-29, A Resolution Authorizing the Execution of Agreement No. 606 with
Engineering Resource Associates, Inc. for Professional Engineering Services for the Turf, Countryside, and
Ranch Flood Improvement Project
Councilman Weller moved and Councilwoman Robbins seconded that R-2026—29, A Resolution Authorizing
the Execution of Agreement No. 606 with Engineering Resource Associates, Inc. for Professional Engineering
Services for the Turf, Countryside, and Ranch Flood Improvement Project, be adopted.
City Manager Dzugan reported two engineering proposals were received forthe Turf, Countryside, and Ranch
Flood Improvement Project, estimated at $2.5MM. He stated the City has secured a $250,000 grant from
Congresswoman Ramirez and awaits a federal grant covering 75% of the cost. He advised if the grant is
received the City wil| need to move quickly noting staff’s recommendation to move forward with engineering
work.

D’Land Construction LLC for Construction Services for the Alley D-D Storm Sewer Replacement and
Pavement Reconstruction Project for a Total Amount Not to Exceed $406,740.70 and a 10% Contingency
Councilwoman Robbins moved and Councilman Brown seconded that R-2026-30, A Resolution Authorizing
the Execution of Agreement No. 605 with D’Land Construction LLC for Construction Services for the Alley D-
D Storm Sewer Replacement and Pavement Reconstruction Project for a Total Amount Not to Exceed
$406,740.70 and a 10% Contingency, be adopted.
City Manager Dzugan reported that nine bids had been received for the reconstruction and full replacement
of the storm sewer on Alley D-D, which runs between Willow and Illinois just east of Naperville Road. He
mentioned that the 2026 budget allocated $500,000 for this project.

14. First Reading of An Ordinance Amending the Code of Ordinances of the City of Wheaton Chapter 42
”Offenses and Miscellaneous Provisions”, Article Il ”Cannabis, Controlled Substances, Paraphernalia" by
Adding Provisions Relating to Tetrahydrocannabinol (THC) Products and Other Psychoactive Substances
City Manager Dzugan explained the ordinance would amend Chapter 42, Article ii to regulate THC products.
He noted that due to increased complaints and a lack of current regulation or enforcement, staff developed
this measure, following other municipalities. He reported the federal government has closed a loophole for
hemp-derived THC, noting concerns pertaining to enforcement. He confirmed staffwill review the ordinance
in November to see if adjustments are needed.
15. Adopt Resolution R-2026-31, A Resolution Authorizing the Purchase of Four (4) Power Cots and
Power Loading Systems for Fire Department Ambulances from Ferno-Washington, Inc. through the Sawik
Purchasing Cooperative for a Total Amount Not to Exceed $202,213
Councilman Brown moved and Councilman Clousing seconded that R—2026-31, A Resolution Authorizing the
Purchase of Four (4) Power Cots and Power Loading Systems for Fire Department Ambulances from Ferno-
Washington, Inc. through the Savvik Purchasing Cooperative for a Total Amount Not to Exceed $202,213, be
adopted.
City Manager Dzugan explained that the Fire Chief and EMS Manager recommend buying four power cots
and load systems for the City’s ambulances. He noted the 2026 budget planned for two, however, staff now
advises purchasing two more for standardization and pricing benefits. He advised the Fleet Services Fund has
enough reserves to cover the extra expenses.

be made to ensure everyone's safety and weii—being.
Mayor Pro Tem Bray—Parker hoped everyone had a wonderful Easter, Passover, and Ramadan, and hopes
that the peace and joy of those celebrations carry everyone through the upcoming spring.
17. Approval of Warrant
