I. CALL TO ORDER AND ROLL CALL VOTE
Mr. Kozik called the October 11, 2018 meeting of the Local Liquor Control Commission meeting to order
at 7:00 P.M. in the City Council Chambers of the Wheaton City Hall, 303 West Wesley Street.
Upon roll call, the following were present: Commissioner Brown, Commissioner Pearse, Commissioner
Sender, Commissioner Wolgemuth. Absent: Chair Taylor. City Staff Present: James P. Kozik, Director of
Planning and Economic Development.
Mr. Kozik asked for a motion to appoint a Chair pro tem. Commissioner Pearse moved and
Commissioner Wolgemuth seconded a motion to appoint Commissioner Sender as Chair pro tem. On a
voice vote, all voted aye.
II. PUBLIC COMMENT
There was no public comment.
III. APPROVAL OF MINUTES – September 13, 2018
Commissioner Pearse moved and Commissioner Brown seconded a motion to approve the minutes of
the September 13, 2018 Local Liquor Control Commission meeting as submitted. On a voice vote, all
voted aye.
IV. NEW BUSINESS
Class A and I Liquor License Amendment - Spirits
Mr. Kozik stated that staff is proposing an amendment to the regulations of the Class A and I liquor
license classifications which would permit package sales of spirits that a licensee uses as ingredients in
specialty cocktails that it sells in their restaurant.
Mr. Kozik stated that currently, a Class A or I licensee can only sell a bottle of wine that they serve by the
glass or bottle to a customer at retail (known as “package sales”).
Matt Marquez, owner of The Moveable Feast, stated that restaurants such as his are now creating
specialty cocktails with ingredients from small, craft distillers whose products are not available at mass-
market retailers. As with wines from small vintners, Mr. Marquez stated that restaurants would like to
be able to sell spirits that they use as ingredients in specialty cocktails so customers may enjoy them at
home.

Mr. Kozik stated that the proposed amendment below would allow for limited package sales of spirits in
addition to bottles of wine for Class A and I licensees.
Commissioner Wolgemuth and Pearse suggested some minor language change to reference that
package sales would only apply to specialty products that are not available at mass market retailers.
Hearing no further questions or comments, Commissioner Pearse then moved and Commissioner
Wolgemuth seconded a motion to recommend approval of the proposed amendment as revised by the
Commission. On a roll call vote; all voted aye.
V. MISCELLANEOUS BUSINESS
There was no Miscellaneous business.
VI. ADJOURNMENT
The meeting was adjourned at 7:25 P.M.
