November 12, 2019 WHEATON PLANNING AND ZONING BOARD I. CALL TO ORDER AND ROLL CALL VOTE Chair Weller called the November 12, 2019 Wheaton Planning and Zoning Board meeting to order at 7:00 p.m. in the Council Chambers of the Wheaton City Hall, 303 W. Wesley Street. Upon roll call, the following were: Roll Call Vote Present: Nicole Aranas Christopher Dabovich Bob Gudmundson Dan Wanzung Scott Weller Absent: Cecilia Horejs Mark Plunkett City Staff Present: Tracy Jones, Staff Planner II. APPROVAL OF MINUTES - OCTOBER 22, 2019 The minutes were approved as presented. III. PUBLIC COMMENT Chair Weller welcomed a group of five gentleman from the government class at Wheaton North High School. IV. NEW BUSINESS ZA #19-19/ SPECIAL USE PERMIT/ 211 W. ROOSEVELT ROAD/ AJG PROPERTIES, LLC Pursuant to notice duly published on October 26, 2019 and letters mailed to neighboring property owners on October 24, 2019, Chair Weller called to order the November 12, 2019 public hearing requesting a special use permit to allow the construction and use of a ten stall parking lot on the vacant property located at 211 W. Roosevelt Road to serve the existing business and professional office located at 225 W. Roosevelt Road. Jonathan Grant, 70 Landon Circle, Wheaton was sworn in. Mr. Grant stated that he owns the property at 225 W. Roosevelt Road and 211 W. Roosevelt Road. The two properties are divided by a public alley that runs north-south with the existing business and professional office on the west side of the alley and the proposed ten stall parking lot on east side of the alley. In addition to providing access to 225 W. Roosevelt Road, the public alley also provides access to five single-family homes to the north. The business and professional office at 225 W. Roosevelt Road is looking to finish their existing basement to add additional office space, but the property does not currently have enough on-site parking to accommodate the additional square footage and does not have enough space on-site to add additional parking. Since the properties cannot be consolidated due to the public alley with the shared access between them, the property owner has submitted the special use permit request for the ten stall parking lot. Mr. Grant stated that the property at 211 W. Roosevelt Road is zoned O-R Office Research District and the proposed parking lot is located on a separate zoning lot but within 300 feet of the building or use served. Wheaton Planning and Zoning Board November 12, 2019 Page 2 of 4 Mr. Grant addressed the special use standards as required by the Zoning Ordinance. He stated that the proposed special use would not be detrimental to the public health, safety, morals, comfort, convenience or general welfare of the neighboring property owners. Chair Weller stated that the Wheaton Eye Clinic and Egg Harbor have submitted similar special use permit requests in the past for off-site parking. Mr. Wanzung suggested that the landscape plan be enhanced to add additional plantings. William Billingham, 616 S. Hale Street, Wheaton was sworn in. Mr. Billingham stated that he was the adjacent residential property to the north. He was concerned about drainage and parking lot lighting. Staff Planner Jones stated that while the project area is not large enough to trigger detention, the applicant still needs to submit a site development permit that would be reviewed by engineering staff. Mr. Grant stated that he has no plans to light the parking lot. The Board discussed the application and decided to include a condition that the landscape plan be enhanced through additional plantings and a condition that if parking lot lighting is desired in the future, an amendment to the special use permit would be required. Mr. Dabovich moved and then Mr. Gudmundson seconded the motion to close the public hearing. On a voice vote, all voted aye. The Board decided to vote this evening. Mr. Wanzung moved and then Mr. Gudmundson seconded the motion to approve ZA #19-19 requesting a special use permit to allow the construction and use of a ten stall parking lot on the vacant property located at 211 W. Roosevelt Road to serve the existing business and professional office located at 225 W. Roosevelt Road, subject to the following conditions: 1. The applicant shall work with staff to enhance the landscape plan for the subject property by incorporating additional plantings; and 2. If parking lot lighting is desired in the future, an amendment to the special use permit shall be required. Roll Call Vote Ayes: Nicole Aranas Christopher Dabovich Bob Gudmundson Dan Wanzung Scott Weller Nays: None Absent: Cecilia Horejs Mark Plunkett Motion Passed Unanimously Wheaton Planning and Zoning Board November 12, 2019 Page 3 of 4 ZA #19-20/ FRONT YARD SETBACK VARIATION/ 1524 FOOTHILL COURT/ AIROOM ARCHITECTS Pursuant to notice duly published on October 26, 2019 and letters mailed to neighboring property owners on October 24, 2019, Chair Weller called to order the November 12, 2019 public hearing requesting a variation to Article 9.2.5 of the Wheaton Zoning Ordinance to allow the construction and use of a second-story addition on the property located at 1524 Foothill Court with a front yard setback of 40.16 feet in lieu of the required 55.24 feet. Chair Weller stated that the subject property is located on the west side of the Foothill Court cul-de-sac. The site is improved with an existing single-family home and attached garage. A front yard setback variation was previously granted for the subject property in 2014 to allow a covered porch. Lance Shalzi, 6825 N. Lincoln Avenue, Lincolnwood was sworn in. Mr. Shalzi stated that he is the architect working on the project and his client is requesting a front yard setback variation to allow the construction and use of a second-story addition on the property located at 1524 Foothill Court with a front yard setback of 40.16 feet in lieu of the required 55.24 feet. The front yard setback of the adjacent residence to the north is 31.86 feet and the front yard setback of the adjacent residence to the southeast is 77.61 feet. These setbacks are averaged to determine the required front yard setback of 54.74 feet for the subject property. Due to the unusual configuration of the lots on the cul-de-sac, the averaging method creates an abnormally large front yard setback requirement for the subject property. Mr. Shalzi stated that the existing home has a front yard setback of 33.01 feet. The second-floor addition would be constructed over the existing one-story garage with a front yard setback of 40.16 feet. The addition would accommodate an expansion of the existing master bedroom suite, including a sitting room and additional closet space. He added that he has reviewed the maximum Floor Area Ratio (FAR) and the maximum building height for the subject property and the addition is in full compliance with these requirements. Mr. Shalzi addressed the variation standards as required by the Zoning Ordinance. He stated that the proposed variation would not be detrimental to the public health, safety, morals, comfort, convenience or general welfare of the neighboring property owners. Mr. Gudmundson questioned whether other homes on the street have added rooms above their garages. David Bagley, 1524 Foothill Court, Wheaton sworn in. Mr. Bagley stated that he is the homeowner. He added that most of the other homes on the street have added rooms above their garages. Mr. Wanzung moved and then Mr. Dabovich seconded the motion to close the public hearing. On a voice vote, all voted aye. The Board decided to vote this evening. Ms. Aranas moved and then Mr. Gudmundson seconded the motion to approve ZA #19-20 requesting a variation to Article 9.2.5 of the Wheaton Zoning Ordinance to allow the construction and use of a second-story addition on the property located at 1524 Foothill Court with a front yard setback of 40.16 feet in lieu of the required 55.24 feet.
