December 8, 2020 WHEATON PLANNING AND ZONING BOARD I. CALL TO ORDER AND ROLL CALL VOTE Chair Weller called the December 8, 2020 Wheaton Planning and Zoning Board meeting to order at 7:00 p.m. via Zoom. Upon roll call, the following were: Roll Call Vote Present: Nicole Aranas Christopher Dabovich Bob Gudmundson Cecilia Horejs Mark Plunkett Dan Wanzung Scott Weller Absent: None City Staff Present: Tracy Jones, Staff Planner Joseph Tebrugge, Director of Engineering II. APPROVAL OF MINUTES - NOVEMBER 10, 2020 The minutes were approved as presented. III. PUBLIC COMMENT There was none. IV. OLD BUSINESS ZA #20-10/ TEXT AMENDMENT, SUBDIVISION AND VARIATION/ HUMMINGBIRD PLACE - 1764 WIESBROOK ROAD/ MATHIESON HOUSE, LLC Chair Weller reconvened the public hearing on Tuesday, December 8, 2020. He stated that the public hearing was called to order on November 10, 2020 but was continued until December 8, 2020 to give the applicant time to provide the following information: Communication from emergency responders on their ability to access proposed Lot 1 and 2; the western setback dimension of proposed Lot 2; the southern setback dimension of proposed Lot 1; floor plans for both residences; a footprint of a deck or patio with setback dimensions on proposed Lot 2; and communication from emergency responders on their ability to access a fire hydrant for proposed Lot 1. The Board also asked staff to research the rear/ side yard setbacks of the existing homes on the southern portion of the Water Tower Court and Burning Trail Court cul-de-sacs from the Prairie Path. Ms. Paloian stated that since the November 10, 2020 public hearing, she had submitted a slightly revised copy of the preliminary plat of subdivision that includes the building envelopes for both lots. The revised preliminary plat of subdivision continues to note the 10 foot required setback from the west property line and a proposed 20 foot public utility and drainage easement along the west property line (crosshatched area). She stated that the proposed drive could accommodate a ladder truck for emergencies and is within the recommended distance to a fire hydrant. She provided the preliminary floor plans for both homes. Wheaton Planning and Zoning Board December 8, 2020 Page 2 of 4 Ms. Paloian stated that her client could maintain a 25 foot setback from the west property line for both residences but would prefer a 20 foot setback from the west property line for any deck and/ or patio space constructed on proposed Lot 1 and proposed Lot 2. She further stated that her client does not intend to build anything within the proposed 20 foot public utility and drainage easement along the west property line. The Board decided to add the 25 foot building setback line to the preliminary plat of subdivision along the west property line of proposed Lot 1 and proposed Lot 2. The Board felt this setback line should apply to any residence, deck and/ or patio space constructed on proposed Lot 1 and proposed Lot 2. Staff Planner Jones stated that she researched the rear/ side yard setbacks of the existing homes on the southern portion of the Water Tower Court and Burning Trail Court cul-de-sacs from the Prairie Path. A total of four houses on the two cul-de-sacs have frontage on the Illinois Prairie Path, two houses on Water Tower Court and two houses on Burning Trail Court. The house at 1662 Water Tower Court has a setback of approximately 50 feet and the house at 1663 Water Tower Court has a setback of approximately 20 feet. The house at 1650 Burning Trail Court has a setback of approximately 55 feet (42 feet from the deck) and the house at 1655 Burning Trail Court has a setback of approximately 13 feet. Chair Weller stated that he had a reservation with granting the setback variation to the south property line for proposed Lot 1 given its proximity to the Illinois Prairie Path. Mr. Witte stated that the south property line of proposed Lot 1 is approximately 35 feet to the pavement of the Illinois Prairie Path. Chair Weller stated that knowing there is an additional 35 foot buffer between the south property line of proposed Lot 1 and the pavement of the Illinois Prairie Path, he was more comfortable with the variation request now. Ms. Aranas questioned where cars would park for a party at proposed Lot 1 or proposed Lot 2. Mr. Witte stated that two cars could park on the driveway and the rest would have to park along the private drive. Mr. Wanzung questioned whether a connection to the Illinois Prairie Path would be provided. Ms. Paloian stated that based on the proposed lot configuration and the private drive, no connection to the Illinois Prairie Path could be provided. The Board discussed the connection to the Illinois Prairie Path. While both the Board and Staff would have liked to see a connection to the Prairie Path, everyone agreed that the proposed lot configuration and the private drive made it impossible to provide the connection, while protecting the privacy of the adjacent homes. Mr. Gudmundson moved and then Mr. Wanzung seconded the motion to close the public hearing. On a voice vote, all voted aye. The Board decided to vote this evening. Wheaton Planning and Zoning Board December 8, 2020 Page 3 of 4 Mr. Plunkett moved and then Mr. Dabovich seconded the motion to approve the text amendment portion of ZA 20-10 as presented. Roll Call Vote Ayes: Nicole Aranas Christopher Dabovich Bob Gudmundson Cecilia Horejs Mark Plunkett Dan Wanzung Scott Weller Nays: None Absent: None Motion Passed Unanimously Mr. Dabovich moved and then Mr. Gudmundson seconded the motion to approve the subdivision and variation portion of ZA 20-10, subject to the following conditions: 1. That a 25 foot building setback line be added to the preliminary plat of subdivision along the west property line of proposed Lot 1 and proposed Lot 2; and 2. The location of the compensatory storage be delineated and any impacts to the wetland the grading required to create the compensatory storage be determined prior to final approval.
