September 12, 2023 Wheaton Planning and Zoning Board I. Call To Order and Roll Call Vote Chair Aranas called the Tuesday, September 12, 2023, Wheaton Planning and Zoning Board meeting to order at 7:00 p.m. in-person and via zoom. Upon roll call, the following were: Roll Call Vote Present: Nicole Aranas Chris Dabovich Chris Derrick Bob Gudmundson Mark Plunkett Dan Wanzung Absent: Cecilia Horejs City Staff Present: Tracy Jones, Staff Planner II. Approval of Minutes - September 12, 2023 The minutes were approved as presented. III. Public Comment Peter Sherrill addressed the Board. Mr. Sherrill questioned whether a traffic study had recently been completed for the intersection of Fairway Lane and Main Street. Staff Planner Jones stated that she wasn’t sure, but she would investigate it for him. IV. New Business ZA #23-17/ Text Amendment/ Article 24.10.11/ Short-Term Home Sharing Rentals Pursuant to notice duly published on August 25, 2023 and letters mailed to the approved short-term home sharing hosts on August 23, 2023, Chair Aranas called to order the September 12, 2023 public hearing requesting a staff initiated text amendment to Article 24.10.11 of the Wheaton Zoning Ordinance for Short-Term Home Sharing Rentals to address various public safety concerns that have arisen since the existing language was adopted in September 2020. These public safety concerns include limiting the number of adult guests based on bedroom count, defining where guests can park on a property, and restricting commercial activity by guests during a rental. Staff Planner Jones stated that staff was proposing to add language to existing Article 24.10.11D as follows: “The maximum number of occupants allowed during a Short-Term Home Sharing Rental shall not exceed two (2) per bedroom exclusive of minors aged twelve (12) and under. Kitchens, bathrooms, living rooms, family rooms and similar areas are not considered bedrooms and shall not be used in the calculation for determining the maximum number of occupants.” Wheaton Planning and Zoning Board August 8, 2023 Page 2 of 2 Staff Planner Jones stated that staff was further proposing to add language to new Article 24.10.11E as follows: “All vehicles of the occupants and guests of the Short-Term Home Sharing Rental must be parked on the Short-Term Home Sharing Rental property. Parking spaces may include garage and driveway parking and may include tandem parking.” Staff Planner Jones stated that staff was further proposing to add language to new Article 24.10.11F as follows: “A Short-Term Home Sharing Rental shall not be used for any commercial activity and uses which are inconsistent with the Zoning Ordinance.” Staff Planner Jones added that the rest of the language contained in Article 24.10.11 was existing text and would remain unchanged. Liz Corry, 719 S. Naperville Road, Wheaton was sworn in. Ms. Corry stated that she has owned her home for 33 years and has been a short-term home sharing host for 8 years. She stated that her rental space was a one- bedroom unit with a sleeper sofa. She added that the proposed two occupant limit for a one-bedroom unit was too restrictive. She added that she had many three and four occupant reservations over the past year and these rentals won’t be permitted if the proposed language is approved as presented. The Board discussed the application in detail. The Board unanimously agreed that the two occupant limit was too restrictive, and they requested that the proposed language be changed to allow a maximum of two (2) occupants per bedroom and an additional two (2) occupants per living room and/or family room containing a sleeper sofa under existing Article 24.10.11D. The Board further requested that language be added under existing Article 24.10.11G requiring staff to establish a maximum occupancy limit per unit. Staff Planner Jones recommended continuing the public hearing to a future meeting to give her time to modify the proposed language based on the feedback from the Board. Then she would bring it back to the Board for another look. The Board concurred with this recommendation. Mr. Gudmunson moved and then Mr. Derrick seconded the motion to continue this public hearing until Tuesday, October 10, 2023 to give staff time to modify the proposed language. On a voice vote, all voted aye. V. Miscellaneous There was none. IV.
