June 11, 2024 Wheaton Planning and Zoning Board I. Call To Order and Roll Call Vote Acting Chair Plunkett called the Tuesday, June 11, 2024, Wheaton Planning and Zoning Board meeting to order at 7:00 p.m. in-person and via zoom. Upon roll call, the following were: Roll Call Vote Present: Chris Dabovich Chris Derrick Bob Gudmundson Cecilia Horejs Mark Plunkett Dan Wanzung Absent: Nicole Aranas City Staff Present: Tracy Jones, Staff Planner Joe Tebrugge, Director of Engineering II. Approval of Minutes - May 29, 2024 The minutes were approved as presented. III. Public Comment There was none. IV. New Business ZA #24-09/ Rear Yard Setback Variation/ 1501 Waldorth Court/ Van Prooyen Pursuant to notice duly published on May 23, 2024 and letters mailed to neighboring property owners on May 21, 2024, Acting Chair Plunkett called to order the June 11, 2024 public hearing requesting a variation to Article 3.4A.6 of the Wheaton Zoning Ordinance to allow a 10-foot deep by 12-foot wide as-built deck to remain with a rear (west) yard setback of 15.0 feet in lieu of the required 25.0 feet, all on property commonly known as 1501 Waldorth Court, Wheaton, IL 60189. The property is zoned R-3 Residential District. Two letters of support have been submitted by neighboring property owners, which are attached to this report. The first letter was submitted by Brady and Jolie Freeman at 1509 Waldorth Court. The second letter was submitted by Roger and Diane Lautz at 26W581 Plamondon Road. Wally Lang, 1633 Wadsworth Road, Wheaton was sworn in via zoom. Mr. Lang stated that the property owner recently constructed a new single-family residence on the subject property, and he was the builder. As a result of a change to the final grading of the property, what was to be a small, at grade stoop and stairs became a 10- foot deep by 12-foot-wide deck. Wheaton Planning and Zoning Board June 11, 2024 Page 2 of 3 Mr. Lang stated that they are requesting a variation to Article 3.4A.6 of the Wheaton Zoning Ordinance to allow the 10-foot deep by 12-foot wide as-built deck to remain with a rear (west) yard setback of 15.0 feet in lieu of the required 25.0 feet. Since the new house is built at the 25.0-foot rear yard setback line, the property owner has no ability to retain the existing deck without a variation. Mr. Lang addressed the ten variation evidence questions as required by the Wheaton Zoning Ordinance. He stated that the proposed variation would not negatively impact the neighboring property owners. Director Tebrugge stated that the as-built deck was constructed to be in an area that will be designated as a compensatory storage easement once the city receives the final as-builts for the residence. No buildings are allowed in a compensatory easement. However, a deck is not considered a building and does not negatively impact the free flow of stormwater. He recommended that no deck skirt is added to the deck. Mr. Gudmundson questioned whether the applicant was agreeable to the condition that no deck skirt is added to the deck to allow the free flow of stormwater. Mr. Lang stated that they were agreeable to this condition. Mr. Dabovich moved and then Ms. Horejs seconded the motion to close the public hearing. On a voice vote, all voted aye. Mr. Gudmunson moved and then Mr. Wanzung seconded the motion to waive the Board’s regular rules and vote tonight. On a voice vote, all voted aye. Mr. Wanzung moved and then Mr. Derrick seconded the motion to approve ZA #24-09, subject to the condition that a solid deck skirt is not added to the deck.
