MINUTES OF A SPECIAL MEETING
OF THE BOARD OF TRUSTEES
OCTOBER 28, 2020
A special meeting of the Wheaton Police Pension Fund Board of Trustees was held on Wednesday, October
28, 2020 at 5:00 p.m. at the Wheaton Police Department located at 900 W. Liberty Drive, Wheaton, Illinois
60187, pursuant to notice.
CALL TO ORDER: Trustee Craig called the meeting to order at 5:03 p.m.
ROLL CALL:
PRESENT: Trustees, James Craig, Tim Bayee, Don Wilson (arrived at 5:10 p.m.) and Angela
Smith
ABSENT: Trustee Brett Mathieson
ALSO PRESENT: Rick Reimer and John Gaw, Reimer Dobrovolny & LaBardi PC; Court Reporter
Michelle Marvin, C.S.R. Notary Public; Kelley Murray, Lauterbach & Amen, LLP
(L&A); Active Member Bradley Caliendo, Wheaton Police Department
The Board discussed appointing Attorney Reimer as the Hearing Officer. A motion was made by Trustee
Craig and seconded by Trustee Smith to appoint Attorney Reimer as Hearing Officer for the hearing
regarding the reinstatement of creditable service for Bradley Caliendo. Motion carried unanimously by
voice vote.
HEARING REGARDING REINSTATEMENT OF CREDITABLE SERVICE – BRADLEY
CALIENDO: The Board discussed the reinstatement of creditable service for Bradley Caliendo; a verbatim
transcript detailing the hearing was prepared by Court Report Michelle Marvin.
CLOSED SESSION, IF NEEDED: A motion was made by Trustee Craig and seconded by Trustee Wilson
to enter into closed session at 5:40 p.m. for the purpose of deliberation under 5 ILCS 120/2 (c)(4) of the
Open Meetings Act. Motion carried by roll call vote.
AYES: Trustees Craig, Wilson, Bayee and Smith
NAYS: None
ABSENT: Trustee Mathieson
A motion was made by Trustee Craig and seconded by Trustee Wilson to return to open session at 6:25
p.m. Motion carried by roll call vote.
AYES: Trustees Craig, Wilson, Bayee and Smith

ABSENT: Trustee Mathieson
HEARING REGARDING REINSTATEMENT OF CREDITABLE SERVICE – BRADLEY
CALIENDO (CONTINUED): The Board continued the discussion to reinstate the creditable service for
Bradley Caliendo. A motion was made by Trustee Craig and seconded by Trustee Wilson to enter a
settlement agreement contingent upon the following terms and conditions: 1) Officer Caliendo can purchase
creditable service previously held with the Wheaton Police Pension Board from December 27, 1999 to
September 20, 2004 under Section 3-124 of the Pension Code; and the two percent required interest will be
recalculated at the date of payment of refund which was January 3, 2005 to July 3, 2012, to be calculated
by the Board’s accounting firm as expeditiously as possible; 2) It will be subject to execution of a written
settlement agreement that would contain, among other things, a waiver and release of all claims that the

Board would execute, as well as an indemnification and hold harmless provision; 3) any amounts calculated
would be due within 30 calendar days of the execution of the Board’s written agreement. Motion carried
by roll call vote.
AYES: Trustees Craig, Wilson, Bayee and Smith
NAYS: None
ABSENT: Trustee Mathieson
Attorney Reimer informed the Board that this hearing will now be held in abeyance. A motion was made
by Trustee Craig and seconded by Trustee Wilson to commence and continue this matter generally for
status. Motion carried unanimously by voice vote.
PUBLIC COMMENT: There was no public comment.
ADJOURNMENT: A motion was made by Trustee Craig and seconded by Trustee Wilson to adjourn the
meeting at 6:30 p.m. Motion carried unanimously by voice vote.
The next regular meeting is scheduled for November 11, 2021 at 5:00 p.m.
