WHEATON CITY COUNCIL PUBLIC HEARING MONDAY, JULY 24, 2017 ZONING APPLICATION #17-19/ PUD/ 1600 SOMERSET LANE/ GOLDSBOROUGH I. Call to Order and Roll Call The public hearing of the Wheaton City Council was called to order at 7:00 p.m. The public hearing was held in the Council Chambers, Wheaton City Hall, 303 W. Wesley Street, Wheaton, Illinois. Upon roll call, the following were: Present: Mayor Gresk Councilman Barbier Councilwoman Fitch Councilman Prendiville Councilman Rutledge Councilman Scalzo Councilman Suess Absent: None City Staff Present: Michael Dzugan, City Manager John Duguay, Assistant City Manager James Kozik, Director of Planning & Economic Development Robert Lehnhardt, Director of Finance Paul Redman, Director of Engineering James Volpe, Chief of Police Susan Bishel, Public Relations Coordinator II. Public Hearing – ZA #17-19/ PUD/ 1600 Somerset Lane/ Goldsborough A. Presentation Robert Goldsborough, 1600 Somerset Lane, the applicant, requested a special use permit for a Planned Unit Development to allow the House of Seven Gables to be moved from its current location in the east and central portion of the Loretto Convent property to lots 7 and 8 of the Loretto Club Subdivision. He stated he and his wife intend to move the structure onto a new foundation for use as a single-family home. He stated the home would connect to City water and sewer service and would use Loretto Court as its public street right-of-way. Stormwater would be handled by the stormwater retention facility in the Loretto Club subdivision to the east. Mr. Goldsborough stated he is petitioning for the property to remain zoned I-1 along with the rest of the Loretto Club development. The 0.4-acre property is surrounded by I-1 zoned properties to the north and east, the Marywood subdivision to the west is zoned R-3, and to the south of the subject property is Seven Gables Park. Mr. Goldsborough outlined several exceptions requested in the PUD, including an exception from the floor area ratio (FAR) of greater than the 40% allowed in the I-1 zoning district. He stated due to the elevation of the lot, the FAR for the home includes the basement and is calculated as 70.88%. The basement would contain the garage spaces and would otherwise be unfinished. Without the basement City Council Public Hearing July 24, 2017 Page 2 level included, the FAR would be closer to 47%. He stated other mitigating factors include a large park to the south of the property, a subdivision outlot and a portion of the property is adjacent to the Loretto Club’s retention basin. He stated the top level of the home, which is also included in the FAR, is effectively like an attic with a pitched roof and would lessen the bulk feel of the home. The staff memo about this request also covered the applicant’s request for an exception for a height of 41.5 feet versus a maximum height of 35.0 feet in the I-1 zoning district. Mr. Goldsborough stated the roof of the home is pitched, and the height is being calculated from the sloped driveway and garage level, which is on the basement level. He stated the design required raising the house several feet for the driveway to not be too steep. The final exception requested is a side yard setback of 12.6 feet versus the minimum required setback of 16.1 feet to allow for the addition of a heavily landscaped porch. Mr. Goldsborough stated his support for the City staff’s recommendation that because of the historical significance of this house, there is a community benefit to preserving the structure. He stated the location has been chosen to isolate it from neighboring properties, and except for the requested exceptions, it would comply with all other PUD requirements. He stated it would not have a negative effect on surrounding properties or neighboring property values. In response to Councilwoman Fitch’s question, Mr. Goldsborough confirmed that after renovation, his family intends to live in this home. B. Public Comment Lisa Dichiera, director of advocacy for Landmarks Illinois, expressed the organization’s support for the preservation of the House of Seven Gables. She stated this would allow the City to retain one of its most historically significant icons, noting the significance of the exclusive Chicago Golf Club and The Colony homes built between 1896 and 1916. Many of the homes, including the House of Seven Gables, were designed by noted architect Jarvis Hunt. She cited the Wheaton Comprehensive Plan’s support for historic preservation and urged the Council to approve the request. Dennis Garlick, 61 Christina Circle, stated this proposal is a win-win solution without impacting surrounding neighbors, parking or traffic. He stated this is a building worth saving and thanked the applicants for saving this home. Nancy Flannery, 816 W. Elm St., voiced her support of this project as a citizen and as chair of Wheaton’s Historic Commission. She stated this is an important historic building, and this can serve as the beginning for the City to work toward historic preservation and possibly creating a historic district or promoting historic tourism. Chris Enck, 455 Birch, Winnetka, stated he has been helping with the logistics of the project, which is very challenging. He stated the applicant is asking for minor exceptions and saving the house would set an example in historic preservation and reuse of a building from a sustainability standpoint. C. Council Comment City Council Public Hearing July 24, 2017 Page 3 Councilman Prendiville expressed his support for the project, stating preserving this home is good for the City and would be done without government assistance. He stated the City values history and culture, and it should move forward with this approval. Councilwoman Fitch expressed agreement with Councilman Prendiville’s statement and stated it could serve as an example of historic preservation. Councilman Scalzo expressed support for the project and thanked the applicants for their work to save this structure. Councilman Prendiville expressed appreciation to Pulte Homes for their flexibility and patience in allowing this home to be preserved. In response to Councilman Rutledge and Councilman Suess’s questions, City Manager Dzugan stated the Council will vote on an ordinance approving or denying the PUD request at the Aug. 7 Council meeting. II. Goldsborough PROPO SAL An application requesting a special use permit for a Planned Unit Development (PUD) to allow the Flouse of Seven Gables (aka the Jarvis Hunt mansion) to be moved from its current location, generally in the east central portion of the Loretto Convent property, to lots 7 and 8 of the Loretto Club Subdivision for use as a single-family dwelling. Pursuant to Article 5.1 lB of the Wheaton Zoning Ordinance, a Planned Unit Development (PUD) may be permitted in any zoning district. The subject property is zoned I-I Institutional District and is adjacent to the Marywood Subdivision to the vest and Seven Gables Park to the south. The front of the home would be elevated to provide for a garage entrance under the terrace. Retaining walls are proposed along the east side of the driveway and the west property line. The application has been submitted by Katy and Robert Goldsborough, 1671 Hawthorne Lane, Wheaton, IL 60189 on behalf ofthe property owner, Pulte Home Company, 1900 E. Golf Road, Suite 300, Schaumburg, IL 60173. BACKGROUND An application requesting a special use permit for a Planned Unit Development (PUD) to allow the llouse of Seven Gables (aka the Jarvis 1-lunt mansion) to be moved from its current location to lots 21 and 22 of the proposed Loretto Club Subdivision was previously submitted. However, due to significant neighbor opposition, this request was withdrawn and then the current application was submitted. BULK REGULATIONS The subject property. consisting of Lots 7 and 8 of the Loretto Club subdivision, is 20,766 square feet in size. Per Article 5.ll.D3, the minimum land area to be developed as a Planned Unit Development shall be as approved by the City Council. The applicant shall have the burden of establishing that the subject property is of sufficient size and shape to be planned and developed as a unified whole capable of meeting the objectives for which planned unit developments may be established pursuant to this section. Article 5.1118 of the Wheaton Zoning Ordinance further states that following approval of a Planned Unit Development, the approved plans, rather than any other provision of this Code, shall constitute the use, parking, loading, sign, bulk, space, and yard regulations applicable to the subject property. The house would have a lot coverage ratio of 20.98 percent. In the I-i Distric t, the maximum lot coverage pennitted is 40.0 percent. Lot coverage is defined as the amount of roofed structures on a lot. The house would have a floor area ratio (FAR) of 70.88 percent. In the I-i Distric t, the maximum floor area ratio permitted is 40.0 percent. Floor area ratio is defined as the ratio of living square footage to lot square footage. To date, however, staff has not received a floor plan of the home to verify that the floor area ratio (FAR) provided on the site plan by the applicant’s architect is correct . The house would have a front setback of 30.0 feet to the edge of the terrace , an east side yard setback of 12.2 foot, a west side yard setback of 12.6 feet and a rear setback of4l .0 feet. The width of the property is 115.0 feet. On a lot of this width, the minimum side setback for a one-sto ry structure is 9.2 feet (8 percent of lot the width) and the minimum side setback for a two-story structu re isI6,l feet (14 percent of lot the width). A pool and patio area are proposed on the rear of the residence on a raised terrace . The pooi and patio area are shown to have a 15.0 rear yard setback. Article 24.4.3 and Article 24.5.8 of the Zoning Ordinance requires a rear yard setback of 10.0 feet for pools and 25.0 feet for patios. The residence would have a height of 41.5 feet. In the 1-1 District, single-family residences are permitted a maximum height of 35.0 feet. BUILDING ELEVATIONS No building elevations have been provided to date. The applicant has indicat ed that a rendering of the relocated House of Seven Gables (aka the Jarvis Hunt mansion) will be presen ted at the public hearing. PUD OBJECTIVES AND STANDARDS Article 5.1 IC of the Wheaton Zoning Ordinance requires PUD’s to meet certain objectives, which state in part, that a PUD should promote harmonious architectural styles, building forms, building massing, and building relationships, both within the development and between the development and its surroundings, The PUD should also promote diversity in the types of developments permitted, so as to provide a variety of living, working and other enviromnents attractive to all ages and income levels. According to Article 5.IOD of the \‘Vheaton Zoning Ordinance, the applicant must also provide sufficient evidence at the public hearing that the following special use standards will be met: 1. The establishment, maintenance, or operation of the special use shall not be detrim ental to the public health, safety, morals, comfort, convenience, and general welfare; 2. The special use shall not be injurious to the uses and enjoyment of other proper ty in the immediate vicinity for the purposes already permitted, not substantially diminish proper ty values within the neighborhood; 3. The establishment of the special use shall not impeded the normal and orderly develo pment and improvement of the surrounding property for uses already permitted; 4. Adequate utilities, access ways, drainage, and other necessary facilities shall be provided; 5. Adequate measures shall be taken to provide ingress and egress designed to minimize traffic congestion in the public streets; 6. The special use shall comply with the objectives of the Wheaton Comprehensi ve Plan; and 7. The special use shall conform to the applicable requirements of the district which in it is located as well as any other applicable requirements of this ordinance, except as many be varied by the Planning and Zoning Board or City Council. RECOMMENDATION The House of Seven Gables (aka the Jarvis Hunt mansion) has significant historical value and staff believes there is conirnunity benefit in preserving this structure. Lots 7 and 8 of the Loretto Club Subdivision is a relatively isolated corner of the property adjacent to a landscaped outlot and the Marywood Subdivision to the west and the Seven Gables Park to the south. The closest existing residence, located within the Marywood Subdivision, is approximately 150 feet west of the proposed location, Provided the applicant sufficiently addresses the required PUD objectives and standards at the public hearing, staff would recommend that direction should be given to the City Attomey to prepare an Ordinance approving the special use pennit for a Planned Unit Development (PUD) request. The propeily, which has no assigned City address at present, is currently vacant and is at the south end of the Loretto Club development, east of the Maiywood subdivision. Our plan is to move the 1897 House of Seven Gables (from its current location generally in the east central poion of the Loretto Convent propey) to the south onto a new foundation on Lots 7 and 8. Upon PUD approval, we would renovate and then occupy the House of Seven Gables as a single-family residence. Per our discussions with City staff and with Loretto Club developer Pulte Homes, we are seeking planned unit development approval, as it’s the most appropriate way to address several aspects of the plan that may not confonn to the I-I district’s existing regulations. Attached, we address each of the PUI) standards. Aspects of the plan that the PUD covers or potentially will cover include building height and floor area ratio of 40%. However, the home’s FAR may be a bit misleading because of some elevation issues; the house’s walkout basement may require the inclusion of the basement level in the FM calculation. The site plan also calls for side-yard setbacks of about 15 feet. Unlike our earlier submittal, this plan requires no private street access and would simply use the public street right of way on Loretto Cowi. We believe that our proposal for access is consistent with the general trend of development in the area paicularly as this lot’s size is consistent with the size of properties in Maivood to the west and with the Wheaton Comprehensive Plan, as it will allow — a historic home to have public street access while allowing Pulte’s Loretto Club to exist as a consistent and unified development. We also believe that the establishment of this PL shall not impede the normal and orderly development and improvement of the surrounding area for uses already pennitted, We believe that our PUD will comply with the overall objectives and desires of the Wheaton Comprehensive Plan. And per the City’s Planned Unit Development Ordinance, the preservation of the House of Seven Gables will offer diversity in terms of housing and development types, use the land and utilities efficiently, and provide harmonious architectural styles. This includes placing the House of Seven Gables in a location that will not unduly burden City infrastructure. As a result, allowing this planned unit development and allowing us to relocate the home will be complementary to the surrounding area. 2. The Special Use I Planned Unit Development shall not be injurious to the uses and enjoyment of other property in the immediate vicinity for the purposes already permitted, not substantially diminish property values within the neighborhood: The property to which the I-louse of Seven Gables will be relocated is approximately 0.41 acres in size. That’s actually larger than the lots in the Loretto Club. It’s also larger than some of the lots in Marywood and slightly smaller than others As such, the creation of this larger lot in the Loretto Club will allow for more of a transition in land use from Marywood to the Loretto Club. In addition, this special use and plamed unit development will be for a house that already stands and is simply several hundred feet to the north. We believe the house’s size and renovation will boost property values in the Loretto Club. 3. The Marywood subdivision is to the west, and that use is not likely to change. The lands to the north and cast will be the Loretto Club subdivision, which is in the process of being permitted, And the land to the south is Seven Gables Park—also a use that is not expected to change.
