NOTICE OF PUBLIC HEARING The Wheaton Planning and Zoning Board will hold a public hearing on Tuesday, December 13, 2022, at 7:00 p.m. in the Council Chambers of the Wheaton City Hall, 303 West Wesley Street, Wheaton, Illinois, in-person and via zoom at https://us02web.zoom.us/j/86399780406 or dial (312) 626-6799, Meeting ID: 863 9978 0406, Passcode: 789467 to consider the following zoning application: Zoning Application #22-28. The City of Wheaton is proposing amendments to the text of the Wheaton Zoning Ordinance, Article II, to improve upon the definition of “Family” for compliance with the Fair Housing Act, 42 U.S.C. § 3601, et seq. by deleting the definition of “Family” in its entirety and replacing it with the following language: “Family: Either (a) an individual or two (2) or more persons related by blood, marriage, or adoption, including foster children, living together as a single housekeeping unit in a dwelling unit; or (b) a group of not more than four (4) persons who need not be related by blood, marriage, or adoption, living together as a single housekeeping unit in a dwelling unit; plus in either case, usual domestic servants. Notwithstanding the foregoing, nothing herein shall be construed to prevent any group of individuals whose right to live together is protected by state or federal fair housing laws.” The application further proposes to amend Article II by repealing the definition of “Group Care Home” in its entirety and to amend Articles II, VII, VIII, IX, X, XI, XII, XIII, XIV and XIX to remove Group Care Homes as permitted and special uses in the R-1, R-2, R-3, R-4, R-5, R-6, and R-7 Residential Districts, in the I-1 Institutional District and in the C-4 CBD Perimeter Commercial District. At the public hearing, anyone wishing to make a public statement will be encouraged to do so. Written comments may be submitted to the Board prior to or at the public hearing. A copy of the application is available for review in the office of the Director of Planning and Economic Development, 303 West Wesley Street, Wheaton, Illinois during normal business hours.
