I. Call to Order and Roll Call
The public hearing of the Wheaton City Council was called to order at 7:00 p.m. by Mayor Suess. The
public hearing was held in the Council Chambers, Wheaton City Hall, 303 W. Wesley Street, Wheaton,
Illinois. Upon roll call, the following were:

II. Public Hearing – Wilson Right-of-Way
a. Petitioner Comment
Walter Plavsic, 1970 Briarcliffe Boulevard, stated he was available to answer any questions the
Council or staff had about the project.
City Manager Dzugan stated that the board of 1000 S. Lorraine Road Condominiums filed a
petition to vacate a right-of-way (ROW) on a portion of Wilson Avenue. The parcel is
approximately 5,500 square feet and includes part of the property’s drive approach. The board
is seeking a permit to expand the parking lot, but since part of the drive approach is within City
ROW, the ROW must be vacated to move forward with the project. City Manager Dzugan
stated that the City would maintain an easement over the entire ROW.

hearing at 7:02 p.m.

MEMORANDUM

SUBJECT: Public Hearing Vacation: Wilson Right-of-Way
Background
The board of 1000 S. Lorraine Rd. Condominiums has filed a petition to vacate a
certain right-of-way (ROW) which is a portion of Wilson Avenue (displayed on the
right). A copy of the petition for this property is attached as Exhibit A and a copy of
the Plat of Vacation is included as Exhibit B. Property owners within a 250-foot
radius of the property were notified of the public hearing; notice of the public
hearing was printed in the Daily Herald.
Existing Conditions and Proposed Use – Wilson ROW
The parcel is approximately 5,500 square feet in area and includes part of the
property’s drive approach. The board is currently seeking a permit to expand the
property’s parking lot, but since a portion of the drive approach to be expanded lies
within City right-of-way, a vacation of the ROW is required to complete the project.
Compensation
Section 58-138(a)(4) of the Wheaton City Code details the appropriate
compensation for requests for vacation. Since the City is maintaining an easement
over the ROW, no compensation is required.
The City will be maintaining an easement over the ROW for utilities; letters from
utility companies – AT&T, Commonwealth Edison, Nicor, and Comcast - were
included with the petition and are in Exhibit A. None of the utility companies
objected to the request for vacation.
The only other compensation required is the application fee, which covers the cost
of legal notice, court reporting, and recording fees; this fee was submitted with the
petition.
Recommendation
The petitioner has satisfied the Code’s requirements. Therefore, staff recommends that Council grant the
petitioner’s request and vacate the Wilson ROW.

RE: Proposed Street Vacation – 55’ Part of Wilson Avenue
Dear Mr. Plavsic,
In reply to your correspondence regarding vacating and acquiring the 55’ road right of way adjacent to
1000 S. Lorraine Road in Wheaton, ComEd has not objection to the vacation of right of way. ComEd
wishes to retain its rights within the right of way per its Franchise Agreement with the Village. ComEd
must maintain rights for our existing facilities. If you wish to have the existing facilities relocated, please
contact New Business at 866-639-3532.
The contents herein shall in no way modify, limit, terminate, release, abrogate, nullify, or waive any of
the rights and interests of ComEd, its successors and assigns, in and to the easement premises.
