Monday, August 25, 2025 I. Call to Order and Roll Call The public hearing of the Wheaton City Council was called to order at 7 p.m. by Mayor Suess. The public hearing was held in the Council Chambers, Wheaton City Hall, 303 W. Wesley Street, Wheaton, Illinois. Public Hearing – Special Service Area No. 9 a. Staff Comment City Manager Dzugan stated the Public Hearing is being held in accordance with the City Council’s approval of Ordinance O-2025-29 at its June 16, 2025, meeting, which proposes the establishment of a new Special Service Area (SSA). The last day to close the public hearing is Sept. 8, 2025, followed by the end of the 60-day objection period on Oct. 25. The City Council is scheduled to consider an ordinance establishing SSA 9 on Nov. 17, hold the first reading of the SSA 9 tax levy on Dec. 1, and adopt the tax levy on Dec. 15. City Manager Dzugan stated that the proposed ordinance establishing SSA 9 sets parameters similar to those of SSA 8 with several updates. The boundary is the same as SSA 8 but also includes certain City-owned properties. The purpose remains the same as SSA 8, with the addition of funding for maintenance of public garages and public art. The term is proposed for seven years, consistent with SSA 8. WHEATON CITY COUNCIL PUBLIC HEARING MINUTES Monday, Aug. 25, 2025 The maximum tax rate in the proposed ordinance is set at 0.45, the same as SSA 8, while the initial levy is $500,000. By comparison, the most recent SSA 8 levy was $425,500, representing an increase of about 17.5%. The $500,000 levy is based on revenue needed to support SSA 9 services. The levy dictates the tax rate based upon properties’ total Equalized Assessed Value (EAV), with tax paid to the SSA by the taxpayer. City staff showed the impact of this increase on 10 sample properties within the SSA. Of the $500,000 amount, the Downtown Wheaton Association (DWA) would receive $325,000 for 2026, and the City would receive $175,000 for the same year. He stated that the City Council had previously reviewed the DWA budget, which included the City’s extraordinary expenses in supporting the downtown area. Two written comments were received regarding the proposed SSA from the owners of 303 E. Front St. and 420 S. Main St. Both petitioners requested removal of their properties from the SSA, as both expressed the opinion that their properties do not directly benefit from the services of the special service area. City Manager Dzugan stated that the criteria used to include properties in SSA 9 are: properties previously in SSA 8, they directly or indirectly benefit from the SSA by contributing to a vibrant downtown, they pay property taxes (not tax-exempt), and they are not owner-occupied residential properties. Petitioners may request removal from the SSA through the City Council. They also have the option to petition the court for exemption after SSA 9 is officially adopted by the City Council. b. Public Comment Jennifer Meyer, 221 E. Illinois St., is requesting for her property to be excluded from SSA 9. Ms. Meyer stated that her property does not receive any benefits from the prior SSA 8 or from the proposed SSA 9. These services include business promotion, management of community events, parking operations and maintenance, streetscape and aesthetic enhancements, holiday and event decorations, and funding for DWA activities. In response, City Manager Dzugan stated that there are both direct and indirect benefits. He stated that, for example, being part of the SSA 9 helps support a vibrant, strong downtown, which adds value to the property. Ms. Meyer stated that residences are typically exempt from the SSA and that her building is a mixed- use property, zoned commercial with a special exemption for residential use. She stated that she lives on the property. She clarified that the building’s residential and office spaces are separate, and that the commercial portion could change tenants or uses in the future. Mayor Suess stated that properties in the SSA receive City services not available to other parts of the community, particularly parking operations and maintenance, including public garages. Ms. Meyer stated that her property exceeds the amount of parking required for her building and does not utilize street parking. 2 WHEATON CITY COUNCIL PUBLIC HEARING MINUTES Monday, Aug. 25, 2025 In response to a question from Ms. Meyer, City Manager Dzugan stated that property owners have the option to petition the court for exemption after the SSA 9 is officially adopted by the City Council. Nancy Singer representing College Church at 303 E. Front St., stated that the property was originally owned by Toms Price, a high-end retail furniture and household store, which expanded over many years. She explained that Toms Price likely benefited from inclusion in the SSA. However, her organization purchased the property in 2018, and it now houses a Christian school, church classes, and the nonprofit Stars Resale Shop. Ms. Singer stated that, under Illinois law, nonprofit-owned properties are generally tax-exempt unless they operate resale shops that sell goods. Since Stars Resale Shop sells merchandise, that portion of the property is taxed. Ms. Singer stated that she was unaware the property had been included in the prior SSA 8 until receiving notification of SSA 9. She emphasized that, unlike the previous retail use, this property does not benefit from City services funded by the SSA, such as marketing or snow removal support, and they maintain their own areas. She requested that this property be removed from SSA 9. Councilwoman Bray-Parker stated that areas along Illinois Street, including near the property, benefit from City-managed and -monitored parking. She also noted that the SSA 9 designation should consider potential future use changes to the property. In response to a question from Councilman Clousing, City Manager Dzugan stated that the SSA 8 tax for this property is $850. c. Council Comment Councilman Brown stated that properties within SSA 9 receive both direct and indirect benefits. He stated that property uses within SSA 9 may change over time, and the City considers these potential future changes when establishing the SSA. The indirect value of services justifies the SSA’s economic impact on the properties. Councilman Clousing stated that the benefits from the SSA, such as the vitality of downtown, provide significant indirect value to properties within the boundaries. Councilman Weller concurred with the other Council members’ comments. Mayor Suess stated that it is important to maintain consistency in SSA 9, noting that the City intentionally maintained the existing boundaries and the maximum tax rate of 0.45. He highlighted the value of indirect benefits, such as downtown vitality, shared services, and parking, which benefit all properties. He explained that SSA 9 was structured to fund services not provided citywide, and that properties are included or exempted based on clear criteria, such as whether they contain a commercial or retail component or pay real estate tax. Councilwoman Bray-Parker moved and Councilwoman Brice seconded a motion to close the public hearing. Dzugan, City Manager DATE: August 25, 2025 SUBJECT: Public Hearing Special Service Area 9 PUBLIC HEARING On Monday, August 25, 2025, the City Council will conduct a public hearing to consider the creation of Special Service Area 9 (SSA 9). The proposed SSA 9 would serve as the replacement for Special Service Area 8 (SSA 8) which expired at the end of December 2024. Notice of this public hearing was provided for pursuant to State Statute and Ordinance No. O-2025-29, “AN ORDINANCE PROPOSING THE ESTABLISHMENT OF A SPECIAL SERVICE AREA No. 9 IN THE CITY OF WHEATON, ILLINOIS AND PROVIDING FOR A PUBLIC HEARING AND OTHER PROCEDURES IN CONNECTION THEREWITH” adopted on June 16, 2025. Ordinance Proposing SSA 9 - The City Council approved Ordinance O-2025-29 which set the parameters for SSA 9 (attached as Exhibit A is copy of said Ordinance). The five major parameters contained in the Ordinance are provided below. • Maximum Tax Rate - $.45 (SSA 8 maximum tax rate was $.45). • Initial Tax Levy - $500,000; $325,000 to DWA and $175,000 to City. SSA 8 2024 levy was $425,500. • Boundary – The proposed boundary includes all the properties contained within SSA 8 with the addition of City owned properties. • Purpose – “to provide special municipal services to the designated Area that include: efforts to promote business within the special service area which generally includes the provision of enhanced marketing and education promoting benefits and activities in the Area; managing special community events and activities including set up and tear down for those events; parking operations and maintenance, including the public garages; maintenance of streetscapes, holiday, and event decorations; together with aesthetic enhancements including landscaping, public art, and signage/banners.” • Term – 7 years (SSA 8 had a 7-year term). SSA 9 RATE COMPARISON/IMPACT Table 1 provides information showing 10 selected properties currently within SSA 8 and the tax impact on those properties given certain changes in the proposed initial levy for SSA 9 of $500,000. Column 4 represents that property’s current tax payment to SSA 8 based upon a levy of $425,500. Column 7 represents the estimated property’s tax under SSA 9 for the 2025 levy paid in 2026, based upon a proposed levy of $500,000. The SSA 9 tax represents a 17.5% increase in the amount a property tax paid under SSA 8. Process - Pursuant to State Statute, if there is a change in the provisions of Ordinance O-2025-29 (maximum tax rate, initial levy, boundary, and/or purpose) at the first regular meeting of the City Council after the closing of the Public Hearing, the City Council shall consider an ordinance modifying the provisions of Ordinance O-2025-29. The City Council has the authority to modify certain provisions “down” after the Public Hearing. In other words, the Council could decrease the maximum tax rate, decrease the initial levy, reduce the term, and/or decrease the boundary. If the Council closes the Public Hearing on August 25 and directs staff to modify any provision(s) of Ordinance O-2025-29, said ordinance will appear on the September 2 City Council agenda for consideration. Statute provides that if a petition, signed by at least fifty-one percent (51%) of the electors residing within the special service area AND by at least fifty-one percent (51%) of the owners of record of land included within the boundaries of the special service area, is filed with the City Clerk within 60 days following the final adjournment of the Public Hearing objecting to the creation of the SSA, the SSA shall not be created. ORDINANCE NO. 0-2025-29 AN ORDINANCE PROPOSING THE ESTABLISHMENT OF A SPECIAL SERVICE AREA NO. 9 IN THE CITY OF WHEATON, ILLINOIS AND PROVIDING FOR A PUBLIC HEARING AND OTHER PROCEDURES IN CONNECTION THEREWITH WHEREAS, the City of Wheaton (“City”) has a history of providing special services to the Central Business District and paying for those services with revenue collected from the property owners in the Central Business District area through a special service area tax; and WHEREAS, Wheaton’s Central Business District poses unique challenges for the City in part because of its age, the widths of its rights of ways, its deficient parking immediately adjacent to retail business, aging infrastructure, ownership patterns, changing retail markets, the fact that vehicular and pedestrian traffic is impeded by a very active railroad right of way and changing residential rental markets; and WHEREAS, residential rental properties, which will be included in Special Service Area No. 9, use their proximity to the City’s Central Business District to promote the marketing ofthose properties to potential tenants; and WHEREAS, Special Service Area No. 9 contains a substantial portion of the City’s Central Business District; and WHEREAS, Special Service Area No. 8, approved on November 19, 2018 by Ordinance No. 0-2018-67, generated revenue to pay for the promotion of business within the special service area which generally included the provision of advertising and other marketing activities as well as the hosting and support of community events within the City’s Central Business District aimed at creating a positive business environment, and the management of the special service area through providing of funds directly to the Downtown Wheaton Association (”DWA”); and WHEREAS, Special Service Area No. 8 expired on December 31, 2024, and it is the City’s intent to replace it with a new special service area to be known as Special Service Area No. 9 (”Area”); and WHEREAS, the City has concluded that Special Service Area No. 8 benefited the properties within Special Service Area No. 8 by helping to stabilize and enhance the Area’s unique and challenging retail and residential rental qualities and the overall vitality and quality of the Area; and WHEREAS, the City has concluded that the special services provided in conformance with this ordinance will benefit the properties within Special Service Area No. 9 by helping to stabilize and enhance the Area’s unique and challenging retail and residential rental’s qualities and the overall vitality of the Area; and WHEREAS, the City owns and maintains infrastructure and facilities, including but not limited to parking garages and streetscape, within the Area, which supports the retail and residential rental qualities and overall vitality of the Area; and WHEREAS, some or all of the revenue generated from Special Service Area No. 9 will be collected to directly fund activities of the DWA in furtherance of the purposes of the Area as set forth herein; and Ordinance 0-2025—29 Page 2 of 14 WHEREAS, the approval of Special Service Area No. 9 is reasonably expected to assist in meeting the unique retail and residential rental challenges by making the Area a better place. NOW, THEREFORE, BE lT ORDAINED by the Mayor and City Council of the City of Wheaton, lllinois, in the exercise of its home rule powers, as follows: SECTION 1: Incorporation of Recitals. The foregoing Recitals are a material part of this Ordinance and constitute legislative findings and are incorporated in this Section 1 as though fully set forth. SECTION 2: Authority to Establish Special Service Areas. The City of Wheaton has the authority pursuant to its home rule powers pursuant to Article Vll, Section 6(l) of the 1970 Constitution of the State of lllinois, and pursuant to the Special Service Area Tax Law, 35 ILCS 200/27-5 et. seq., to provide special services to contiguous areas within its corporate boundaries and to provide the manner of levying and imposing additional taxes to pay for the cost of such special services. SECTION 3: Findings of the City Council. The City Council of the City of Wheaton makes the following findings of fact: A. It is in the public interest that a special service area be proposed and considered for the area and purposes described herein, and that the City Council conduct a public hearing as required by law to consider the establishment ofthe special service area for the property legally described in, and shown on the Map, all set forth in Notice Exhibit A attached to Exhibit 1 (Notice of Hearing), which is attached hereto and incorporated herein as if fully set forth. B. The special service area is compact and contiguous, and located within the corporate limits of the City of Wheaton. C. The proposed special service area is zoned for commercial and residential uses and the property owners in the special service area will benefit from the services proposed to be provided, and the proposed services are unique and in addition to the municipal services generally provided to the City as a whole. Therefore, it is in the best interest of the City to consider the levy of special taxes against the special service area for the services to be provided. SECTION 4: Public Hearing—Tax Rates. A public hearing shall be held on the 25th day of August, 2025, at 7:00 p.m., or as soon thereafter as possible, in the City Council Chambers of the City, 303 West Wesley Street, ”Special Wheaton, lllinois, to consider the establishment of the special service area described herein, to be titled Services Area No. 9" of the City of Wheaton, in the territory legally described in, and shown on the Map, all set forth in Notice Exhibit A to Exhibit 1 attached hereto. At the public hearing the City Council will consider: A. The establishment of Special Service Area No. 9 to provide special municipal services to the designated Area that include: efforts to promote business within the special service area which generally includes the provision of enhanced marketing and education promoting benefits and activities in the Area; managing special community events and activities including set up and tear down for those events; parking operations and maintenance, including the public garages; maintenance of streetscapes, holiday, and event decorations; together with aesthetic enhancements including landscaping, public art, and signage/banners. ln furtherance of these purposes, revenue from the special service area will fund certain activities ofthe Downtown Wheaton Association. The levy of a special annual tax in an amount not to exceed an annual rate of forty-five hundredths of one-percent (45%) of the assessed value, as equalized, of the property included in the proposed Special Service Area No. 9; the tax to be levied for a maximum of seven (7) years from the date ofthe establishing Ordinance. The proposed amount ofthe tax levy for special services for the initial year for which taxes will be levied within Special Service Area No. 9 is $500,000. SECTION 5: Notice of Hearing. Notice of the public hearing (”Notice”) shall be published not less than fifteen (15) days prior to the public hearing in one or more newspapers in general circulation in the City of Wheaton. ln addition, notice by mailing shall be given by depositing the Notice in the U.S. mail addressed to the person or persons in whose name the general taxes for the last preceding year were paid on each lot, block, tract or parcel of land lying within the proposed special service area. The Notice shall be mailed not less than ten (10) days prior to the time set for the public hearing. in the event taxes for the preceding year were not paid, the Notice shall be sent to the person last listed on the tax rolls prior to that year as the owner of the property. The Notice shall be in substantially the same form as Exhibit 1, attached hereto. SECTION 6: Conflicting Ordinances Repealed. All ordinances or parts of ordinances in conflict with the provisions of this Ordinance are hereby repealed. SECTION 7: Full Force and Effect. This Ordinance shall be in full force and effect from and after its passage and publication as provided by law. All interested parties, including all persons owning taxable real property located within the proposed special service area, will be given an opportunity to file written objections and to be orally heard regarding the formation of and the boundaries of the special service area and may object to the formation of the special service area, the boundaries of the special service area, and the levy of taxes affecting said area. The purpose for the formation of Wheaton Special Service Area No. 9 in general is to provide special municipal services to the area, including but not limited to: efforts to promote business within the special service area which generally includes the provision of enhanced marketing and education promoting benefits and activities in the Area; managing special community events and activities including set up and tear down for those events; parking operations and maintenance, including the public garages; maintenance of streetscapes, holiday, and event decorations; together with aesthetic enhancements including landscaping, public art, and signage/banners. In furtherance of these purposes, revenues from the special service area will fund certain activities of the Downtown Wheaton Association. A special tax will be considered at the hearing to be levied against the real property included in the special service area for a period not to exceed seven (7) years and in an amount not to exceed an annual rate of forty-five hundredths of one percent (.45%) of the assessed value, as equalized. Said tax would be levied upon all taxable property within the proposed special service area and said tax would be in addition to the annual real estate tax and all other taxes provided by law and shall be levied pursuant to the provisions of the Revenue Act of 1939, as amended. The proposed amount of the tax levy for the initial year for which taxes will be levied within the special service area is $500,000. The hearing may be adjourned by the Council to another date without further notice other than a motion to be entered upon the minutes of its meeting fixing the time and place of its adjournment. At the public hearing, or the first regular meeting of the corporate authorities thereafter, the City may delete area from the special service area. If a petition signed by at least fifty-one percent (51%) of the electors residing within the special service area and by at least fifty-one percent (51%) of the owners of record of land included within the boundaries of the special service area is filed with the City Clerk within 60 days following the final adjournment of the public hearing objecting to the creation of the special service area, the enlargement thereof, the levy or imposition of a tax for the provision of special services to the area, or to the proposed increase in the tax rate, no such district shall be created or enlarged, or tax may be levied or imposed nor the rate increased, except as otherwise permitted by law.
